79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 12 O.S. 2021, Section 3252, is
81	81	amended to read as follows:
82	82	Section 3252. A. To request issuance of a subpoena under this
83	83	section, a party must submit a foreign subpoena to a clerk of court
84	84	in the county in which discovery is sought to be conducted in this
85	85	state and pay any applicable fee as prescribed by law. A request
86	86	for the issuance of a subpoena under this act does not constitute an
87	87	appearance in the courts of this state.

139	139	B. When a party submits a foreign subpoena to a clerk of court
140	140	in this state, the clerk, in accordance with that court 's procedure,
141	141	shall promptly:
142	142	1. Promptly issue a subpoena for service upon the person to
143	143	which the foreign subpoena is directed ; and
144	144	2. Assign the subpoena a case file number and enter it on the
145	145	docket as a civil action for foreign su bpoena.
146	146	C. A subpoena under subsec tion B of this section must:
147	147	1. Incorporate the terms used in the foreign subpoena; and
148	148	2. Contain or be accompanied by the names, addresses and
149	149	telephone numbers of all couns el of record in the proceeding to
150	150	which the subpoena relates and of any party not represen ted by
151	151	counsel.
152	152	SECTION 2. AMENDATORY 28 O.S. 202 1, Section 152.1, is
153	153	amended to read as follows:
154	154	Section 152.1 A. In civil cases, the court clerk shall collect
155	155	and deposit in the c ourt fund the following charges in addition to
156	156	the flat fee:
157	157	1. For posting notices and filing
158	158	certificates required by s tatute...............$30.00
159	159	2. For the filing of any counterclaim or
160	160	setoff pursuant to Section 1758 of
161	161	Title 12 of the Oklahoma Statutes ..............$20.00
