77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 25 O.S. 2021, Section 307, as
79	79	amended by Section 1, Chapter 182, O.S.L. 2022 (25 O.S. Supp. 2023,
80	80	Section 307), is amended to read as follows:
81	81	Section 307. A. No public body shall hold executive sessions
82	82	unless otherwise specifically provided in this section.
83	83	B. Executive sessions of public bodies w ill be permitted only
84	84	for the purpose of:
85	85	1. Discussing the employment, hirin g, appointment, promotion,
86	86	demotion, disciplini ng or resignation of any individual sa laried

141	141	3. Discussing the purchase or appraisal of rea l property;
142	142	4. Confidential communications bet ween a public body and its
143	143	attorney concerning a pending investigation, claim, or action if the
144	144	public body, with the advice of its attorney, determines th at
145	145	disclosure will seriously impair the ability of the public body to
146	146	process the claim or conduct a pending investigation, litigation, or
147	147	proceeding in the public interest;
148	148	5. Permitting district boards of education to hear eviden ce and
149	149	discuss the expulsion or suspension of a student when requested by
150	150	the student involved or the student's parent, attorney or legal
151	151	guardian;
152	152	6. Discussing matters involving a specific handicapped child;
153	153	7. Discussing any matter where disclosure of information would
154	154	violate confidentiality requirements of state or federal la w;
155	155	8. Engaging in deliberations or rendering a final or
156	156	intermediate decision in an individual proceeding pursuant to
157	157	Article II of the Administrative Procedures Act;
158	158	9. Discussing matters involving s afety and security at state
159	159	penal institutions or corr ectional facilities used to house state
160	160	inmates;
161	161	10. Discussing contract negotiation s involving contracts
162	162	requiring approval of the State Board of Corrections, which shall be

220	220	a. the investigation of a plan or scheme to commit an act
221	221	of terrorism,
222	222	b. assessments of the vulnerability of government
223	223	facilities or public improvements to an act of
224	224	terrorism,
225	225	c. plans for deterrence or prevention of or pro tection
226	226	from an act of terrorism,
227	227	d. plans for response or remediation after an act of
228	228	terrorism,
229	229	e. information technology of the public b ody but only if
230	230	the discussion specifically identifies:
231	231	(1) design or functional schematics t hat demonstrate
232	232	the relationship or connections between devices
233	233	or systems,
234	234	(2) system configuration information,
235	235	(3) security monitoring and response equipment

296	296	f. the investigation of an act of terrorism that has
297	297	already been committed ; or
298	298	12. Self-evaluation of the public body .
299	299	For the purposes of this subsection, the term "terrorism" means any
300	300	act encompassed by the definitions set forth in Section 1268.1 of
301	301	Title 21 of the Oklahoma Statutes.
302	302	C. Notwithstanding the provisions of subsection B of this
303	303	section, the following public bodies may hold ex ecutive sessions:
304	304	1. The State Banking Board, as provided for under Section 306.1
305	305	of Title 6 of the Oklahoma Statutes;
306	306	2. The Oklahoma Industrial Finance Authority, as provided for
307	307	in Section 854 of Title 74 of the Oklahoma Statutes;
308	308	3. The Oklahoma Dev elopment Finance Authority, as provided for
309	309	in Section 5062.6 of Title 74 of the Oklahoma Statutes;

370	370	provided for in Section 20 of Title 85A of the Oklahoma Statutes;
371	371	7. A review committe e, as provided for in Section 855 of Title
372	372	62 of the Oklahoma Statutes;
373	373	8. The Child Death Review Board for purposes of receiving and
374	374	conferring on matters pertaining to materials declared confidential
375	375	by law;
376	376	9. The Domestic Violence Fatality Review Boa rd as provided in
377	377	Section 1601 of Title 22 of the Oklahoma Statutes;
378	378	10. The Opioid Overdose Fatality Review Board, a s provided in
379	379	Section 2-1001 of Title 63 of the Oklahoma Statutes;
380	380	11. All nonprofit foundations, boards, bureaus, commissions,
381	381	agencies, trusteeships, authorities, councils, committees, public
382	382	trusts, task forces or study groups supported in whole or par t by
383	383	public funds or entrusted with the expenditure of public funds for
384	384	purposes of conferring on matters pertaining to economic developme nt

441	441	12. The Oklahoma Indigent Defense System B oard for purposes of
442	442	discussing negotiating s trategies in connection with making possible
443	443	counteroffers to offers to contract to provide l egal representation
444	444	to indigent criminal defendants and indigent juveniles in cases for
445	445	which the System must provide representation pursuant to the
446	446	provisions of the Indigent Defense Act;
447	447	13. The Quality Investment Committee for p urposes of discussing
448	448	applications and confidential materials pursuant to the terms of the
449	449	Oklahoma Quality Investment Act;
450	450	14. The Oklahoma Municipal Power Authority established pursuant
451	451	to Section 24-101 et seq. of Title 11 of the Oklahoma Statutes and
452	452	in its role as an electr ic utility regulated by the federal
453	453	government, for purposes of discussing security plans and procedures
454	454	including, but not limited to, cybersecurity matters; and
455	455	15. The Oklahoma Tax Commission for purposes of discussing
456	456	confidential taxpayer matters as provided in Section 205 of Title 68
457	457	of the Oklahoma Statutes, and in compliance with subsection E of
458	458	this section.

510	510	D. Except as otherwise specified in this subsection, an
511	511	executive session for the purpose of discussing the purchase or
512	512	appraisal of real pr operty shall be limited to members of the public
513	513	body, the attorney f or the public body and the immediate staff of
514	514	the public body. No landowner, real estate salesperson, broker,
515	515	developer or any other person who may profit directl y or indirectly
516	516	by a proposed transaction concerning real property which is under
517	517	consideration may be present or participate in the executive
518	518	session, unless they are operating under an existing agreement to
519	519	represent the public body.
520	520	E. No public body m ay go into an executive session unless the
521	521	following procedures are strictly complied with:
522	522	1. The proposed executive session is noted on the agenda as
523	523	provided in Section 311 of this title;
524	524	2. The executive session is authorized by a majority vote of a
525	525	quorum of the members pr esent and the vote is a recorded vote; and
526	526	3. Except for matters con sidered in executive sessions of the
527	527	State Banking Board and the Oklahoma Tax Commission, and which are
528	528	required by state or federal law to be confidential, any vo te or
529	529	action on any item of business considered in an executive session
530	530	shall be taken in public meeting with t he vote of each member
531	531	publicly cast and recorded.
532	532	F. A willful violation of the provisions of this section shall:
