7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 25 O.S. 2021, Section 307, as
7979 amended by Section 1, Chapter 182, O.S.L. 2022 (25 O.S. Supp. 2023,
8080 Section 307), is amended to read as follows:
8181 Section 307. A. No public body shall hold executive sessions
8282 unless otherwise specifically provided in this section.
8383 B. Executive sessions of public bodies w ill be permitted only
8484 for the purpose of:
8585 1. Discussing the employment, hirin g, appointment, promotion,
8686 demotion, disciplini ng or resignation of any individual sa laried

139139 2. Discussing negotiations concerning employees and
140140 representatives of employee g roups;
141141 3. Discussing the purchase or appraisal of rea l property;
142142 4. Confidential communications bet ween a public body and its
143143 attorney concerning a pending investigation, claim, or action if the
144144 public body, with the advice of its attorney, determines th at
145145 disclosure will seriously impair the ability of the public body to
146146 process the claim or conduct a pending investigation, litigation, or
147147 proceeding in the public interest;
148148 5. Permitting district boards of education to hear eviden ce and
149149 discuss the expulsion or suspension of a student when requested by
150150 the student involved or the student's parent, attorney or legal
151151 guardian;
152152 6. Discussing matters involving a specific handicapped child;
153153 7. Discussing any matter where disclosure of information would
154154 violate confidentiality requirements of state or federal la w;
155155 8. Engaging in deliberations or rendering a final or
156156 intermediate decision in an individual proceeding pursuant to
157157 Article II of the Administrative Procedures Act;
158158 9. Discussing matters involving s afety and security at state
159159 penal institutions or corr ectional facilities used to house state
160160 inmates;
161161 10. Discussing contract negotiation s involving contracts
162162 requiring approval of the State Board of Corrections, which shall be

215215 body, and the immediate staff of the public body. No person who may
216216 profit directly or indirectly by a proposed transaction which is
217217 under consideration may be present or participate in the executive
218218 session; or
219219 11. Discussing the following:
220220 a. the investigation of a plan or scheme to commit an act
221221 of terrorism,
222222 b. assessments of the vulnerability of government
223223 facilities or public improvements to an act of
224224 terrorism,
225225 c. plans for deterrence or prevention of or pro tection
226226 from an act of terrorism,
227227 d. plans for response or remediation after an act of
228228 terrorism,
229229 e. information technology of the public b ody but only if
230230 the discussion specifically identifies:
231231 (1) design or functional schematics t hat demonstrate
232232 the relationship or connections between devices
233233 or systems,
234234 (2) system configuration information,
235235 (3) security monitoring and response equipment

289289 components or devices,
290290 (5) system identification numbers, names, or
291291 connecting circuits,
292292 (6) business continuity and disaster planning, or
293293 response plans, or
294294 (7) investigation inform ation directly related to
295295 security penetrations or denial of services, or
296296 f. the investigation of an act of terrorism that has
297297 already been committed ; or
298298 12. Self-evaluation of the public body .
299299 For the purposes of this subsection, the term "terrorism" means any
300300 act encompassed by the definitions set forth in Section 1268.1 of
301301 Title 21 of the Oklahoma Statutes.
302302 C. Notwithstanding the provisions of subsection B of this
303303 section, the following public bodies may hold ex ecutive sessions:
304304 1. The State Banking Board, as provided for under Section 306.1
305305 of Title 6 of the Oklahoma Statutes;
306306 2. The Oklahoma Industrial Finance Authority, as provided for
307307 in Section 854 of Title 74 of the Oklahoma Statutes;
308308 3. The Oklahoma Dev elopment Finance Authority, as provided for
309309 in Section 5062.6 of Title 74 of the Oklahoma Statutes;

361361 4. The Oklahoma Center for the Advanc ement of Science and
362362 Technology, as provided for in Section 5060.7 of Title 74 of the
363363 Oklahoma Statutes;
364364 5. The Oklahoma Health Research Committee for purposes of
365365 conferring on matters pertaining to research and development of
366366 products, if public disclosu re of the matter discussed would
367367 interfere with the development of patents, copyrights, products, or
368368 services;
369369 6. The Workers' Compensation Commission for the purposes
370370 provided for in Section 20 of Title 85A of the Oklahoma Statutes;
371371 7. A review committe e, as provided for in Section 855 of Title
372372 62 of the Oklahoma Statutes;
373373 8. The Child Death Review Board for purposes of receiving and
374374 conferring on matters pertaining to materials declared confidential
375375 by law;
376376 9. The Domestic Violence Fatality Review Boa rd as provided in
377377 Section 1601 of Title 22 of the Oklahoma Statutes;
378378 10. The Opioid Overdose Fatality Review Board, a s provided in
379379 Section 2-1001 of Title 63 of the Oklahoma Statutes;
380380 11. All nonprofit foundations, boards, bureaus, commissions,
381381 agencies, trusteeships, authorities, councils, committees, public
382382 trusts, task forces or study groups supported in whole or par t by
383383 public funds or entrusted with the expenditure of public funds for
384384 purposes of conferring on matters pertaining to economic developme nt

436436 including the transfer of property, financing, or the creation of a
437437 proposal to entice a business to remain or to l ocate within their
438438 jurisdiction if public disclosure of the matter discussed would
439439 interfere with the development of products or services or if public
440440 disclosure would violate the confidentiality of the business;
441441 12. The Oklahoma Indigent Defense System B oard for purposes of
442442 discussing negotiating s trategies in connection with making possible
443443 counteroffers to offers to contract to provide l egal representation
444444 to indigent criminal defendants and indigent juveniles in cases for
445445 which the System must provide representation pursuant to the
446446 provisions of the Indigent Defense Act;
447447 13. The Quality Investment Committee for p urposes of discussing
448448 applications and confidential materials pursuant to the terms of the
449449 Oklahoma Quality Investment Act;
450450 14. The Oklahoma Municipal Power Authority established pursuant
451451 to Section 24-101 et seq. of Title 11 of the Oklahoma Statutes and
452452 in its role as an electr ic utility regulated by the federal
453453 government, for purposes of discussing security plans and procedures
454454 including, but not limited to, cybersecurity matters; and
455455 15. The Oklahoma Tax Commission for purposes of discussing
456456 confidential taxpayer matters as provided in Section 205 of Title 68
457457 of the Oklahoma Statutes, and in compliance with subsection E of
458458 this section.

510510 D. Except as otherwise specified in this subsection, an
511511 executive session for the purpose of discussing the purchase or
512512 appraisal of real pr operty shall be limited to members of the public
513513 body, the attorney f or the public body and the immediate staff of
514514 the public body. No landowner, real estate salesperson, broker,
515515 developer or any other person who may profit directl y or indirectly
516516 by a proposed transaction concerning real property which is under
517517 consideration may be present or participate in the executive
518518 session, unless they are operating under an existing agreement to
519519 represent the public body.
520520 E. No public body m ay go into an executive session unless the
521521 following procedures are strictly complied with:
522522 1. The proposed executive session is noted on the agenda as
523523 provided in Section 311 of this title;
524524 2. The executive session is authorized by a majority vote of a
525525 quorum of the members pr esent and the vote is a recorded vote; and
526526 3. Except for matters con sidered in executive sessions of the
527527 State Banking Board and the Oklahoma Tax Commission, and which are
528528 required by state or federal law to be confidential, any vo te or
529529 action on any item of business considered in an executive session
530530 shall be taken in public meeting with t he vote of each member
531531 publicly cast and recorded.
532532 F. A willful violation of the provisions of this section shall:
