38	49		An Act relating to schools; amending 70 O.S. 2021,
39	50		Section 1210.229-1, which relates to the Oklahoma
40	51		Alcohol and Drug Abuse Prevention and Life Skills
41	52		Education Act; expanding applicability of act;
42	53		requiring certain instruction on fentanyl abuse
43	54		prevention and drug pois oning awareness; prescribing
44	55		frequency of and grades for instruction; listing
45	56		information to be included in fentanyl abuse
46	57		instruction; authorizing organizations and persons to
47	58		provide instruction; directing Governor to designate
48	59		Fentanyl Poisoning Awarene ss Week in schools;
49	60		providing for certain instruction during designated
50	61		week; providing for codification; providing an
51	62		effective date; and declaring an emergency .

56	67		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	68		SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.229 -1,
58	69		is amended to read as follows:
59	70		Section 1210.229-1 Sections 1210.229-1 through 1210.229-5 of
60	71		this title and Section 2 of this act shall be known and may be cited
61		-	as the "Oklahoma Alcohol and Drug Abuse Prevention and Life Skills
62		-	Education Act".
63		-	SECTION 2. NEW LAW A new section of law to be codi fied
64		-	in the Oklahoma Statutes as Section 1210.229-8 of Title 70, unless
65		-	there is created a duplication in numbering, re ads as follows:

	101	+	SECTION 2. NEW LAW A new section of law to be codified
	102	+	in the Oklahoma Statutes as Section 1210.229-8 of Title 70, unless

92	104		A. As part of the comprehensive integrated curriculum for
93	105		substance abuse programs provided in Section 1210.229-5 of Title 70
94	106		of the Oklahoma Statutes, e ach school district shall annually
95	107		provide research-based instruction related to fenta nyl abuse
96	108		prevention and drug poisoning awareness to students in grades six
97	109		through twelve.
98	110		B. The instruction required by this section shall include:
99	111		1. Suicide prevention;
100	112		2. Prevention of the abuse of and addiction to fentanyl;
101	113		3. Awareness of local school and community resources and how to
102	114		access those resources; and
103	115		4. Health education that includes in formation about substance
104	116		use and abuse of fentanyl, including youth substance use and abuse
105	117		of fentanyl.
106	118		C. The instruction required by this secti on may be provided by
107	119		an organization or an employee or agent of an organization that is:
108	120		1. A public or private institution of higher education;
109	121		2. A library;
110	122		3. A community service organization;
111		-	4. A religious organization;
112		-	5. A local public health agency; or
113		-	6. An organization employing mental health professionals.
114		-	D. To educate students about the dang ers posed by fentanyl and
115		-	the risks of fentanyl poisoning, including overd ose, the Governor

	153	+	D. To educate students about the dang ers posed by fentanyl and
	154	+	the risks of fentanyl poisoning, including overd ose, the Governor
142	155		shall designate a week to be known as Fentanyl Poisoning Awareness
143	156		Week in public schools. Fentanyl Poisoning Awareness Week may
144	157		include age-appropriate instructio n, including instruction on the
145	158		prevention of the abuse of and addicti on to fentanyl, as determined
146	159		by each school district.
147	160		SECTION 3. This act shall become effective July 1, 2024.
148	161		SECTION 4. It being immediately necessar y for the preservation
149	162		of the public peace, health or safety, an emergency is hereby
150	163		declared to exist, by reason whereof this act shall take effect and
151	164		be in full force from and after its passage and approval.
