66	66	Server Minimum Wage Act ; declaring purpose; amending
67	67	40 O.S. 2021, Section 197.2, which relates to the
68	68	Oklahoma Minimum Wage Act ; establishing minimum wage
69	69	for servers; providing for noncodification; and

75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law not to be
77	77	codified in the Oklahoma Statutes reads as follows:
78	78	A. This act shall be known and may be cited as the "Oklahoma
79	79	Server Minimum Wage Act ".
80	80	B. The purpose of this act is to ensure fair compensation for
81	81	servers in the hospitali ty industry by adjusting the minimum wage to
82	82	reflect the unique compensation structure for tipped employees.
83	83	SECTION 2. AMENDATORY 40 O.S. 2021, Section 197.2, is
84	84	amended to read as follows:
85	85	Section 197.2 A. It shall be unlawful to employ workers in any
86	86	industry or occupation within the State of Oklahoma under conditions
87	87	of labor detrimental to their health or morals and it shall be

139	139	unlawful to employ workers in any industry within the State of
140	140	Oklahoma at wages which are not ade quate for their maintenance.
141	141	Except as otherwise provided in the Oklahoma Minimum Wage Act, no
142	142	employer within the State of Oklahoma shall pay any employee a wage
143	143	of less than the current federal minimum wage for all hours worked.
144	144	B. Effective November 1, 2024, the minimum wage for servers in
145	145	the State of Oklahoma shall be set at Five Dollars ($5.00) per hour.
146	146	This wage rate shall apply exclusively to employees in the food
147	147	service industry who regularly receive tips as a substantial part of
148	148	their income.
149	149	SECTION 3. This act shall become effective November 1, 2024.
