1343 An Act relating to state government; amending 74 O.S.
1444 2021, Section 150.27, which relates to the
1545 deoxyribonucleic acid (DNA) labo ratory of the
1646 Oklahoma State Bureau of Investigation; directing the
1747 Oklahoma State Bureau of Investigation to promulgate
1848 policies, procedures, and forms for statewide rapid

2857 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3058 SECTION 1. AMENDATORY 74 O.S. 2021, Section 150.27, is
3159 amended to read as follows:

3360 Section 150.27 A. There shall be established within the
3461 Oklahoma State Bureau of Investigation (OSBI) a deoxyribonucleic
3562 acid (DNA) laboratory for the purpose of determining DN A profiles to
3663 be used for evidence in criminal proceedings. The OSBI shall
3764 coordinate the use of this laboratory and equipment with federal,
3865 state, county, and munici pal law enforcement agencies. All county

4094 may participate in this laboratory. The OSBI shall establish
4195 standards and guidelines for the deoxyribonucleic acid (DNA)
4296 laboratory and shall comply with any regulations applicable to DNA
4397 testing, sampling and laboratory standards.

4598 B. The OSBI may make a DNA profile of any blood or saliva
46-specimen received for any other pu rpose by the Bureau and place the ENR. H. B. NO. 3568 Page 2
99+specimen received for any other purpose by the Bureau and place the
47100 DNA profile in its DNA population database. The DNA population
48101 database shall not be indexed by donor name, and the Bureau shall
49102 promulgate rules to protect the privacy of the DNA donors.

51103 C. The OSBI may contract for the services of a Forensic DNA
52104 Technical Manager as reasonably necessary to ensure the continued
53105 operations of the DNA laboratory. The OSBI shall be exempt from the
54106 competitive bidding requirements of the Oklahoma Central Purchasing
55107 Act for the purpose of soliciting, negotiating, and effectuating
56108 such a contract or contracts.

58109 D. The OSBI shall promulgate necessary policies, procedures,
59110 and forms for participation in a r apid DNA investigative lead
60111 program, a statewide program for law enforcement agencies, outlining
61112 the collection and processing of crime scene samples utilizing rapid
62113 DNA instrumentation. The provisions of this subsection authorize
63114 the OSBI to promulgate p rogram parameters as well as provide the
64115 procedures on technical and practical procedures for law enforcement
65116 agencies concerning the training, maintenance, and use of rapid DNA
66117 instruments throughout the state.
