81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. NEW LAW A new section of law to be codified
83	83	in the Oklahoma Statutes as Section 43-121 of Title 11, unless there
84	84	is created a duplication in numbering, reads as follows:
85	85	As used in this act:
86	86	1. "Federal standards" mean the Federal Manufactured Home
87	87	Construction and Safety Standards promulgated by the United States
88	88	Department of Housing and Urban Development under the autho rity of
89	89	42 U.S.C., Section 5401 et seq. as it existed on January 1, 1976;

141	141	2. "Manufactured home" means a dwelling unit constructed in a
142	142	factory in accordance with the federal standards and meeting the
143	143	definitions set forth in the federal standards ; and
144	144	3. "Mobile home" means a dwelling unit const ructed in a factory
145	145	before the enactment of the federal standards.
146	146	SECTION 2. NEW LAW A new section of law to be codified
147	147	in the Oklahoma Statutes as S ection 43-122 of Title 11, unless there
148	148	is created a duplication in numbering, reads as follows:
149	149	A. Municipalities shall not establish or continue in effect any
150	150	ordinance or regulation that sets standards for manufactur ed home
151	151	construction or safety that are not identical to the federal
152	152	standards.
153	153	B. Municipalities shall not establish or continue in effect any
154	154	ordinance or regulation that sets standards for manufactured home
155	155	installation that are inconsistent with the s tate standards for
156	156	installation.
157	157	SECTION 3. NEW LAW A new section of law to be codified
158	158	in the Oklahoma Statutes as Section 43-123 of Title 11, unless there
159	159	is created a duplication in numbering, reads as follows:
160	160	A. 1. Municipalities that have z oning ordinances shall allow
161	161	the placement of manufactured hom es on individually owned lots in at
162	162	least one or more residential districts or zones within the
163	163	municipality.

215	215	2. Municipalities shall not establish or continue in effect any
216	216	ordinance or regulation that restricts the placement of manufactured
217	217	homes only to mobile home parks, subdivisions or land lease
218	218	communities.
219	219	B. Municipalities may establish reasonable regulations or
220	220	conditions for the placement of manufactured homes within the
221	221	jurisdiction, including, but not limited to:
222	222	1. Perimeter foundation encl osures;
223	223	2. Connection to utilities;
224	224	3. Building setbacks;
225	225	4. Side or rear yard offsets;
226	226	5. Off-street parking;
227	227	6. Construction of carports, garages and other outbuildings;
228	228	7. Entry and exits, porches, decks, and stairs; and
229	229	8. Other regulations or c onditions that are applicable to other
230	230	single family dwellings in the same residential district or zone.
231	231	C. Municipalities shall not impose regulations or conditions on
232	232	manufactured homes th at prohibit the placement of manufactured homes
233	233	or that are inconsistent with the regulations or conditions imposed
234	234	on other single family dwellings permitted in the same residential
235	235	district or zone.
236	236	SECTION 4. NEW LAW A new sect ion of law to be codified
237	237	in the Oklahoma Statutes as Section 43-124 of Title 11, unless there
238	238	is created a duplication in numbering, reads as follows:

293	293	mobile homes to designated mobile home p arks, subdivisions, or land

295	295	SECTION 5. NEW LAW A new section of law to be codified
296	296	in the Oklahoma Statutes as Section 43-125 of Title 11, unless there
297	297	is created a duplication in numbering, reads as follows:
298	298	A. This act shall not supersede, prevent, or preempt any valid
299	299	covenants.
300	300	B. This act shall not require that manufactured homes be
301	301	permitted in historic districts.
302	302	SECTION 6. This act shall become effective November 1, 2024.
