8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 43-121 of Title 11, unless there
8484 is created a duplication in numbering, reads as follows:
8585 As used in this act:
8686 1. "Federal standards" mean the Federal Manufactured Home
8787 Construction and Safety Standards promulgated by the United States
8888 Department of Housing and Urban Development under the autho rity of
8989 42 U.S.C., Section 5401 et seq. as it existed on January 1, 1976;

141141 2. "Manufactured home" means a dwelling unit constructed in a
142142 factory in accordance with the federal standards and meeting the
143143 definitions set forth in the federal standards ; and
144144 3. "Mobile home" means a dwelling unit const ructed in a factory
145145 before the enactment of the federal standards.
146146 SECTION 2. NEW LAW A new section of law to be codified
147147 in the Oklahoma Statutes as S ection 43-122 of Title 11, unless there
148148 is created a duplication in numbering, reads as follows:
149149 A. Municipalities shall not establish or continue in effect any
150150 ordinance or regulation that sets standards for manufactur ed home
151151 construction or safety that are not identical to the federal
152152 standards.
153153 B. Municipalities shall not establish or continue in effect any
154154 ordinance or regulation that sets standards for manufactured home
155155 installation that are inconsistent with the s tate standards for
156156 installation.
157157 SECTION 3. NEW LAW A new section of law to be codified
158158 in the Oklahoma Statutes as Section 43-123 of Title 11, unless there
159159 is created a duplication in numbering, reads as follows:
160160 A. 1. Municipalities that have z oning ordinances shall allow
161161 the placement of manufactured hom es on individually owned lots in at
162162 least one or more residential districts or zones within the
163163 municipality.

215215 2. Municipalities shall not establish or continue in effect any
216216 ordinance or regulation that restricts the placement of manufactured
217217 homes only to mobile home parks, subdivisions or land lease
218218 communities.
219219 B. Municipalities may establish reasonable regulations or
220220 conditions for the placement of manufactured homes within the
221221 jurisdiction, including, but not limited to:
222222 1. Perimeter foundation encl osures;
223223 2. Connection to utilities;
224224 3. Building setbacks;
225225 4. Side or rear yard offsets;
226226 5. Off-street parking;
227227 6. Construction of carports, garages and other outbuildings;
228228 7. Entry and exits, porches, decks, and stairs; and
229229 8. Other regulations or c onditions that are applicable to other
230230 single family dwellings in the same residential district or zone.
231231 C. Municipalities shall not impose regulations or conditions on
232232 manufactured homes th at prohibit the placement of manufactured homes
233233 or that are inconsistent with the regulations or conditions imposed
234234 on other single family dwellings permitted in the same residential
235235 district or zone.
236236 SECTION 4. NEW LAW A new sect ion of law to be codified
237237 in the Oklahoma Statutes as Section 43-124 of Title 11, unless there
238238 is created a duplication in numbering, reads as follows:

291291 Municipalities may prohibit the placement of mobile homes in all
292292 residential districts or zones, or may restrict the placement of
293293 mobile homes to designated mobile home p arks, subdivisions, or land
294294 lease communities.
295295 SECTION 5. NEW LAW A new section of law to be codified
296296 in the Oklahoma Statutes as Section 43-125 of Title 11, unless there
297297 is created a duplication in numbering, reads as follows:
298298 A. This act shall not supersede, prevent, or preempt any valid
299299 covenants.
300300 B. This act shall not require that manufactured homes be
301301 permitted in historic districts.
302302 SECTION 6. This act shall become effective November 1, 2024.
