8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. NEW LAW A new section of law to be codified
9191 in the Oklahoma Statutes as Section 428 of Title 3A, unless there is
9292 created a duplication in numbering, reads as follows:
9393 This act shall be known and may be cited as the "Electronic
9494 Pull-Tab Device Act".

146146 SECTION 2. NEW LAW A new section of law to be codified
147147 in the Oklahoma Statutes as Section 429 of Title 3A, unless there is
148148 created a duplication in numbering, reads as follows:
149149 A. Each electronic pull -tab device shall bear a seal approved
150150 by the Alcoholic Beverage Laws Enforcement (ABLE) Commission.
151151 B. An electronic pull-tab device shall not be capable of being
152152 used for the purpose of engaging in any game prohibited b y the
153153 Commission.
154154 C. In addition to a video monitor or touch screen, each
155155 electronic pull-tab device may include, but not be limited to, a
156156 bill acceptor, printer, and electromechanical butto ns for activating
157157 the game and providing player input, including a means for the
158158 player to make selections and choices in games.
159159 D. For each electronic pull -tab device, there shall be located
160160 anywhere within the distri buted pull-tab system, nonvolatile me mory
161161 or its equivalent. The memory shall be maintained in a secur e
162162 location for the purpose of storing and preserving a set of critical
163163 data that has been e rror-checked in accordance with the critical
164164 memory requirements of this regulation.
165165 E. An electronic pull-tab device shall not have any switches,
166166 jumpers, wire posts, or other means of manipulation that could
167167 affect the operation or outcome of a game. The electronic pull-tab
168168 device may not have any functions or pa rameters adjustable through

220220 any separate video display or input codes except for the adjustment
221221 of features that are wholly cosmetic.
222222 F. An electronic pull-tab device shall not have any of the
223223 following attributes:
224224 1. Spinning or mechanical reels;
225225 2. Pull handle;
226226 3. Sounds or music solely intended to entice a player to play;
227227 4. Flashing lights or tower light;
228228 5. Top box, coin tray, ticket acceptance, hopper, coin
229229 acceptor;
230230 6. Enhanced animation, cabinet, or payglass artwork; or
231231 7. Any other attribute identified by the Commission.
232232 G. An electronic pull-tab device shall be robust enough to
233233 withstand forced illegal entry that would leave behind physical
234234 evidence of the attempted entry or suc h entry that causes an error
235235 code that is displayed and transm itted to the distributed pull -tab
236236 system. Any such entry attempt shall inhibit game play until
237237 cleared and shall not affect the subsequent play or any other play,
238238 prize, or aspect of the game.
239239 H. The number of electronic pull -tab devices, other than thos e
240240 electronic pull-tab devices that are handheld, present at any
241241 premises at which charitable gaming is conducted shall be limited to
242242 ten devices. The Commission shall determine whether an elect ronic
243243 pull-tab device is handheld.

295295 I. The ABLE Commission sha ll promulgate rules necessary to
296296 implement and enforce the provisions of the Electronic Pull -Tab
297297 Device Act.
298298 SECTION 3. AMENDATORY 3A O.S. 2021, Section 402, is
299299 amended to read as follows:
300300 Section 402. As used in the Oklahoma Cha rity Games Act, Section
301301 401 et seq. of this title, and the Electronic Pull -Tab Device Act,
302302 as created in Section 1 of this act:
303303 1. "Bingo" means a game in which each player receives a bingo
304304 face and covers the squares according to the numbers, letters, or
305305 combination of numbers and letters that have been announced by the
306306 caller. The numbers and letters called are on an object selected at
307307 random either manually or mechanically from a receptacle in which
308308 have been placed the objects bearing the numbers, let ters, or
309309 combinations of numbers and letters corresponding to the system used
310310 for designating the bingo face squares. The winner of each bingo
311311 game is the player who first properly covers a pre determined and
312312 announced pattern of squares upon the bingo fac e being used by the
313313 player;
314314 2. "Bingo face" means a flat piece of paper which is marked off
315315 into any number of squares in any arrangement of rows, with each
316316 square being designated by number, l etter or combination of numbers
317317 and letters and with one or mo re squares designated as a "free"
318318 space with the word "Oklahoma" and a facsimile outline of a map of

371371 player has used it is over;
372372 3. "Breakopen ticket card " means a single folded or banded
373373 ticket or a card, the face of which is initially covered or
374374 otherwise hidden from view to conceal a number, letter, symbol, or
375375 set of letters or symbols, a few of which numbers, letters or
376376 symbols out of every set of charity game tickets have been
377377 designated in advance at random as prize winners and which is used
378378 in a breakopen ticket game;
379379 4. "Breakopen ticket game " means a game wherein a player
380380 receives a breakopen ticket card. A breakopen tick et game shall
381381 meet the following criteria:
382382 a. the game shall be assembled so that no placement of
383383 winners or losers exists that allows the possibility
384384 of prize manipulation,
385385 b. the concealed numbers, letters, or symbols shall not
386386 be visible from the outsid e of the game using high
387387 intensity lamps. Protection shall be provided by the
388388 opaque paper stock employed, with the possible
389389 addition of colors and printed blockout patterns or by
390390 use of an aluminum foil laminate,
391391 c. a unique symbol or printed security de vice, such as a
392392 specific number keyed to particular winners or the
393393 name of the symbol or some of the symbol colors

446446 shall be placed in the winning windows of prize
447447 windows to ensure that the winner image is unique,
448448 d. it shall not be possible to detect or pick out winn ing
449449 from losing tickets through variations in printing
450450 graphics, color, or use of different printing plates,
451451 e. it shall not be possible to isolate winning or
452452 potential winning tickets from mino r variations in
453453 size or cutting of the tickets comprising a pa rticular
454454 packet, and
455455 f. each ticket in a game shall have a serial number. All
456456 tickets in a game shall have the same serial number
457457 appearing in a conspicuous place on the ticket;
458458 5. "Business entity" means a person, company, corporation, or
459459 partnership organized for profit;
460460 6. "Charity game" means a bingo game, U-PIK-EM bingo game, or
461461 breakopen ticket game conducted by an organization pursuant to the
462462 provisions of the Oklahoma Charity Games Act ;
463463 7. "Charity game equipment " means any object uniquely desig ned
464464 for use in the conducting of a charity game including, but not
465465 limited to, bingo faces, U -PIK-EM bingo game sets, and breakopen
466466 ticket cards. Items used in conducting charity games which ar e not
467467 charity game equipment are ink markers, furniture and ge neral
468468 furnishings of rooms where charity games are conducted;

520520 8. "Commission" or "ABLE Commission" means the Alcoholic
521521 Beverage Laws Enforcement Commission;
522522 9. "Day session" means the set time frame within which
523523 conducting of charity games is authorized beginning no earlier than
524524 10:00 a.m. and ending no later than 5:00 p.m.;
525525 10. "Deal" means one series of breakopen ticket game cards
526526 which has a stated number of winner payouts and a stated amou nt of
527527 the payouts;
528528 11. "Distributor" means a person or busine ss entity that sells,
529529 markets, or otherwise provides charity game equipment to an
530530 organization;
531531 12. "Doing business" means either conducting a charity game by
532532 an organization or providing goods or services to an organization by
533533 a business entity;
534534 13. "Electronic pull-tab device" means an electronic device
535535 that displays an instant result from a pull -tab game by utilizing a
536536 touchscreen monitor. The device accumulates winnings for the player
537537 and prints out a voucher a t the conclusion of play that can be
538538 redeemed for cash or credited to use on another electronic pull-tab
539539 device for continued play;
540540 13. 14. "Employee" means a person who works for compensation in
541541 a licensed charity game establishment ;
542542 14. 15. "Immediate family member " means a spouse, parent, c hild
543543 or sibling or spouse of a parent, child or sibling of a resident of

595595 a facility exempt from specific provisions of the Oklahoma Ch arity
596596 Games Act as provided in subsection C of Section 405 o f this title;
597597 15. 16. "Licensee" means any person, organizati on, or business
598598 entity which has received a license from the Commission;
599599 16. 17. "Location" means the building, including the individual
600600 rooms and equipment in the rooms, grounds, and appurtena nces,
601601 including adjacent premises if subject to the direct or indirect
602602 control of the organization while conducting a charity game, which
603603 are used in connection with or in furtherance of the conducting of a
604604 charity game;
605605 17. 18. "Manager" means a person who:
606606 a. is an employee of an organization,
607607 b. has supervisory authority over other employees or over
608608 the conduct of charity games, and
609609 c. has been designated as such by the organization
610610 pursuant to the provisi ons of subsection D of Section
611611 408 of this title;
612612 18. 19. "Manufacturer" means a person or business entity th at
613613 assembles from raw materials, supplies, or subparts to form a
614614 completed series of charity game equipment for use in charity games
615615 and that sells, markets, or otherwise provides such equipment to a
616616 distributor;

668668 19. 20. "Night session" means the set time frame within which
669669 conducting of charity games is authorized beginning no earlier than
670670 5:00 p.m. and ending no later than 12:00 p.m. a.m. midnight;
671671 20. 21. "Organization" means a religious, ch aritable, labor,
672672 fraternal, educational, or other type of asso ciation or any branch,
673673 lodge, chapter, or auxiliary of such association which:
674674 a. operates without profit to its members,
675675 b. has been in existence and been operati ng as a
676676 nonprofit organization for not less than two (2) years
677677 prior to applying for an organ ization license,
678678 c. is exempt from taxation pursuant to the provisions of
679679 paragraphs (3), (4), (5), (6), (7), (8), (9), (10), or
680680 (19) of subsection (c) of Section 501 or paragraph (1)
681681 of subsection (a) of Section 509 of the United States
682682 Internal Revenue Code of 1986, as amended, 26 U.S.C.,
683683 Section 501(c) et seq. or Section 509(a)(1), and
684684 d. formulates bylaws which clearly identify and
685685 establish:
686686 (1) method of electing officers and their duties,
687687 (2) method by which members are elected, initiated or
688688 admitted,
689689 (3) the rights and privileges of each member,
690690 (4) that each member has one vote, and

742742 (5) that membership rights are personal to the member
743743 and not assignable;
744744 21. 22. "Progressive game" means a game in which prizes are
745745 allowed to be carried over and inc reased from session to session;
746746 22. 23. "U-PIK-EM bingo game" means a game played wherein a
747747 player writes the numbers on a U -PIK-EM bingo game set. The player
748748 retains one sheet of the set and deposits the second sheet in a
749749 receptacle in the control of th e organization. The player then
750750 covers the numbers as the caller announces a number. The numbers
751751 called are on an object selected at random either manually or
752752 mechanically from a receptacle in which have been placed the objects
753753 bearing the numbers. The winner of each U-PIK-EM bingo game is the
754754 player who first covers all the numbers appearing on the retained
755755 sheet in accordance with the pattern as designated on the sheet ; and
756756 23. 24. "U-PIK-EM bingo game set" means two paper sheets of
757757 carbonless paper both bearing identical serial numbers on which a
758758 player writes numbers or letters, wherein one sheet is retained by
759759 the player and used for playing and one sheet is held by the
760760 organization and used for verifying winners.
761761 SECTION 4. This act shall become effective November 1, 2024.
