89	89	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
90	90	SECTION 1. NEW LAW A new section of law to be codified
91	91	in the Oklahoma Statutes as Section 428 of Title 3A, unless there is
92	92	created a duplication in numbering, reads as follows:
93	93	This act shall be known and may be cited as the "Electronic
94	94	Pull-Tab Device Act".

146	146	SECTION 2. NEW LAW A new section of law to be codified
147	147	in the Oklahoma Statutes as Section 429 of Title 3A, unless there is
148	148	created a duplication in numbering, reads as follows:
149	149	A. Each electronic pull -tab device shall bear a seal approved
150	150	by the Alcoholic Beverage Laws Enforcement (ABLE) Commission.
151	151	B. An electronic pull-tab device shall not be capable of being
152	152	used for the purpose of engaging in any game prohibited b y the
153	153	Commission.
154	154	C. In addition to a video monitor or touch screen, each
155	155	electronic pull-tab device may include, but not be limited to, a
156	156	bill acceptor, printer, and electromechanical butto ns for activating
157	157	the game and providing player input, including a means for the
158	158	player to make selections and choices in games.
159	159	D. For each electronic pull -tab device, there shall be located
160	160	anywhere within the distri buted pull-tab system, nonvolatile me mory
161	161	or its equivalent. The memory shall be maintained in a secur e
162	162	location for the purpose of storing and preserving a set of critical
163	163	data that has been e rror-checked in accordance with the critical
164	164	memory requirements of this regulation.
165	165	E. An electronic pull-tab device shall not have any switches,
166	166	jumpers, wire posts, or other means of manipulation that could
167	167	affect the operation or outcome of a game. The electronic pull-tab
168	168	device may not have any functions or pa rameters adjustable through

221	221	of features that are wholly cosmetic.
222	222	F. An electronic pull-tab device shall not have any of the
223	223	following attributes:
224	224	1. Spinning or mechanical reels;
225	225	2. Pull handle;
226	226	3. Sounds or music solely intended to entice a player to play;
227	227	4. Flashing lights or tower light;
228	228	5. Top box, coin tray, ticket acceptance, hopper, coin
229	229	acceptor;
230	230	6. Enhanced animation, cabinet, or payglass artwork; or
231	231	7. Any other attribute identified by the Commission.
232	232	G. An electronic pull-tab device shall be robust enough to
233	233	withstand forced illegal entry that would leave behind physical
234	234	evidence of the attempted entry or suc h entry that causes an error
235	235	code that is displayed and transm itted to the distributed pull -tab
236	236	system. Any such entry attempt shall inhibit game play until
237	237	cleared and shall not affect the subsequent play or any other play,
238	238	prize, or aspect of the game.
239	239	H. The number of electronic pull -tab devices, other than thos e
240	240	electronic pull-tab devices that are handheld, present at any
241	241	premises at which charitable gaming is conducted shall be limited to
242	242	ten devices. The Commission shall determine whether an elect ronic
243	243	pull-tab device is handheld.

295	295	I. The ABLE Commission sha ll promulgate rules necessary to
296	296	implement and enforce the provisions of the Electronic Pull -Tab
297	297	Device Act.
298	298	SECTION 3. AMENDATORY 3A O.S. 2021, Section 402, is
299	299	amended to read as follows:
300	300	Section 402. As used in the Oklahoma Cha rity Games Act, Section
301	301	401 et seq. of this title, and the Electronic Pull -Tab Device Act,
302	302	as created in Section 1 of this act:
303	303	1. "Bingo" means a game in which each player receives a bingo
304	304	face and covers the squares according to the numbers, letters, or
305	305	combination of numbers and letters that have been announced by the
306	306	caller. The numbers and letters called are on an object selected at
307	307	random either manually or mechanically from a receptacle in which
308	308	have been placed the objects bearing the numbers, let ters, or
309	309	combinations of numbers and letters corresponding to the system used
310	310	for designating the bingo face squares. The winner of each bingo
311	311	game is the player who first properly covers a pre determined and
312	312	announced pattern of squares upon the bingo fac e being used by the
313	313	player;
314	314	2. "Bingo face" means a flat piece of paper which is marked off
315	315	into any number of squares in any arrangement of rows, with each
316	316	square being designated by number, l etter or combination of numbers
317	317	and letters and with one or mo re squares designated as a "free"
318	318	space with the word "Oklahoma" and a facsimile outline of a map of

372	372	3. "Breakopen ticket card " means a single folded or banded
373	373	ticket or a card, the face of which is initially covered or
374	374	otherwise hidden from view to conceal a number, letter, symbol, or
375	375	set of letters or symbols, a few of which numbers, letters or
376	376	symbols out of every set of charity game tickets have been
377	377	designated in advance at random as prize winners and which is used
378	378	in a breakopen ticket game;
379	379	4. "Breakopen ticket game " means a game wherein a player
380	380	receives a breakopen ticket card. A breakopen tick et game shall
381	381	meet the following criteria:
382	382	a. the game shall be assembled so that no placement of
383	383	winners or losers exists that allows the possibility
384	384	of prize manipulation,
385	385	b. the concealed numbers, letters, or symbols shall not
386	386	be visible from the outsid e of the game using high
387	387	intensity lamps. Protection shall be provided by the
388	388	opaque paper stock employed, with the possible
389	389	addition of colors and printed blockout patterns or by
390	390	use of an aluminum foil laminate,
391	391	c. a unique symbol or printed security de vice, such as a
392	392	specific number keyed to particular winners or the
393	393	name of the symbol or some of the symbol colors

447	447	windows to ensure that the winner image is unique,
448	448	d. it shall not be possible to detect or pick out winn ing
449	449	from losing tickets through variations in printing
450	450	graphics, color, or use of different printing plates,
451	451	e. it shall not be possible to isolate winning or
452	452	potential winning tickets from mino r variations in
453	453	size or cutting of the tickets comprising a pa rticular
454	454	packet, and
455	455	f. each ticket in a game shall have a serial number. All
456	456	tickets in a game shall have the same serial number
457	457	appearing in a conspicuous place on the ticket;
458	458	5. "Business entity" means a person, company, corporation, or
459	459	partnership organized for profit;
460	460	6. "Charity game" means a bingo game, U-PIK-EM bingo game, or
461	461	breakopen ticket game conducted by an organization pursuant to the
462	462	provisions of the Oklahoma Charity Games Act ;
463	463	7. "Charity game equipment " means any object uniquely desig ned
464	464	for use in the conducting of a charity game including, but not
465	465	limited to, bingo faces, U -PIK-EM bingo game sets, and breakopen
466	466	ticket cards. Items used in conducting charity games which ar e not
467	467	charity game equipment are ink markers, furniture and ge neral
468	468	furnishings of rooms where charity games are conducted;

524	524	10:00 a.m. and ending no later than 5:00 p.m.;
525	525	10. "Deal" means one series of breakopen ticket game cards
526	526	which has a stated number of winner payouts and a stated amou nt of
527	527	the payouts;
528	528	11. "Distributor" means a person or busine ss entity that sells,
529	529	markets, or otherwise provides charity game equipment to an
530	530	organization;
531	531	12. "Doing business" means either conducting a charity game by
532	532	an organization or providing goods or services to an organization by
533	533	a business entity;
534	534	13. "Electronic pull-tab device" means an electronic device
535	535	that displays an instant result from a pull -tab game by utilizing a
536	536	touchscreen monitor. The device accumulates winnings for the player
537	537	and prints out a voucher a t the conclusion of play that can be
538	538	redeemed for cash or credited to use on another electronic pull-tab
539	539	device for continued play;
540	540	13. 14. "Employee" means a person who works for compensation in
541	541	a licensed charity game establishment ;
542	542	14. 15. "Immediate family member " means a spouse, parent, c hild
543	543	or sibling or spouse of a parent, child or sibling of a resident of

596	596	Games Act as provided in subsection C of Section 405 o f this title;
597	597	15. 16. "Licensee" means any person, organizati on, or business
598	598	entity which has received a license from the Commission;
599	599	16. 17. "Location" means the building, including the individual
600	600	rooms and equipment in the rooms, grounds, and appurtena nces,
601	601	including adjacent premises if subject to the direct or indirect
602	602	control of the organization while conducting a charity game, which
603	603	are used in connection with or in furtherance of the conducting of a
604	604	charity game;
605	605	17. 18. "Manager" means a person who:
606	606	a. is an employee of an organization,
607	607	b. has supervisory authority over other employees or over
608	608	the conduct of charity games, and
609	609	c. has been designated as such by the organization
610	610	pursuant to the provisi ons of subsection D of Section
611	611	408 of this title;
612	612	18. 19. "Manufacturer" means a person or business entity th at
613	613	assembles from raw materials, supplies, or subparts to form a
614	614	completed series of charity game equipment for use in charity games
615	615	and that sells, markets, or otherwise provides such equipment to a
616	616	distributor;

669	669	conducting of charity games is authorized beginning no earlier than
670	670	5:00 p.m. and ending no later than 12:00 p.m. a.m. midnight;
671	671	20. 21. "Organization" means a religious, ch aritable, labor,
672	672	fraternal, educational, or other type of asso ciation or any branch,
673	673	lodge, chapter, or auxiliary of such association which:
674	674	a. operates without profit to its members,
675	675	b. has been in existence and been operati ng as a
676	676	nonprofit organization for not less than two (2) years
677	677	prior to applying for an organ ization license,
678	678	c. is exempt from taxation pursuant to the provisions of
679	679	paragraphs (3), (4), (5), (6), (7), (8), (9), (10), or
680	680	(19) of subsection (c) of Section 501 or paragraph (1)
681	681	of subsection (a) of Section 509 of the United States
682	682	Internal Revenue Code of 1986, as amended, 26 U.S.C.,
683	683	Section 501(c) et seq. or Section 509(a)(1), and
684	684	d. formulates bylaws which clearly identify and
685	685	establish:
686	686	(1) method of electing officers and their duties,
687	687	(2) method by which members are elected, initiated or
688	688	admitted,
689	689	(3) the rights and privileges of each member,
690	690	(4) that each member has one vote, and

744	744	21. 22. "Progressive game" means a game in which prizes are
745	745	allowed to be carried over and inc reased from session to session;
746	746	22. 23. "U-PIK-EM bingo game" means a game played wherein a
747	747	player writes the numbers on a U -PIK-EM bingo game set. The player
748	748	retains one sheet of the set and deposits the second sheet in a
749	749	receptacle in the control of th e organization. The player then
750	750	covers the numbers as the caller announces a number. The numbers
751	751	called are on an object selected at random either manually or
752	752	mechanically from a receptacle in which have been placed the objects
753	753	bearing the numbers. The winner of each U-PIK-EM bingo game is the
754	754	player who first covers all the numbers appearing on the retained
755	755	sheet in accordance with the pattern as designated on the sheet ; and
756	756	23. 24. "U-PIK-EM bingo game set" means two paper sheets of
757	757	carbonless paper both bearing identical serial numbers on which a
758	758	player writes numbers or letters, wherein one sheet is retained by
759	759	the player and used for playing and one sheet is held by the
760	760	organization and used for verifying winners.
761	761	SECTION 4. This act shall become effective November 1, 2024.
