8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 22 O.S. 2021, Section 60.4, as
8585 amended by Section 7, Chapter 318, O.S.L. 2022 (22 O.S. Supp. 2023,
8686 Section 60.4), is amended to read as follows:
8787 Section 60.4 A. 1. A copy of a petition for a protective
8888 order, any notice of hearing and a copy of any emergency temporary
8989 order or emergency ex parte or der issued by the court shall be
9090 served upon the defendant in the same manner as a bench warrant. In

143143 may issue service to the sheriff by facsimile or other electronic
144144 transmission for service by the sheriff and receive t he return of
145145 service from the sheriff in the same manner. Any fee for service of
146146 a petition for protective order, notice of hearing , and emergency ex
147147 parte order shall only be charged pursuant to subsection C of
148148 Section 60.2 of this title and, if charged, shall be the same as the
149149 sheriff's service fee plus mileage expenses.
150150 2. Emergency temporary ord ers, emergency ex parte orders and
151151 notice of hearings shall be given priority for service and can be
152152 served twenty-four (24) hours a day when the location of the
153153 defendant is known. When service cannot be made upon the defendant
154154 by the sheriff, the sherif f may contact another law enforcem ent
155155 officer or a private investigator or private process server to serve
156156 the defendant.
157157 3. An emergency temporary order, em ergency ex parte order, a
158158 petition for protective order, and a notice of hearing shall have
159159 statewide validity and may be transferre d to any law enforcement
160160 jurisdiction to effect service upon the defendant. The sheriff may
161161 transmit the document by electr onic means.
162162 4. The return of service shall be submitted to the sheriff's
163163 office or court clerk in the court where the petition, not ice of
164164 hearing or order was issued.
165165 5. When the defendant is a minor child who is orde red removed
166166 from the residence of the victim, in addition to those documents

218218 served upon the defendant, a copy of the petition, notice of hearing
219219 and a copy of any tempo rary order or ex parte order issued by the
220220 court shall be delivered with the child to t he caretaker of the
221221 place where such child is taken pursuant to Section 2-2-101 of Title
222222 10A of the Oklahoma Statutes.
223223 B. 1. Within fourteen (14) days of the filing of the petition
224224 for a protective order, the court shall schedule a full hearing on
225225 the petition, if the court finds sufficient grounds within the scope
226226 of the Protection from Domestic Abuse Act stated in the petition to
227227 hold such a hearing, regardless of whe ther an emergency temporary
228228 order or ex parte order has been previously issued, reques ted or
229229 denied. Provided, however, whe n the defendant is a minor child who
230230 has been removed from the residence pursuant to Section 2-2-101 of
231231 Title 10A of the Oklahoma St atutes, the court shall schedule a full
232232 hearing on the petition within seventy -two (72) hours, regardless of
233233 whether an emergency temporary order or ex parte order has been
234234 previously issued, requested or denied.
235235 2. The court may schedule a full hearing o n the petition for a
236236 protective order within seventy-two (72) hours when the court is sues
237237 an emergency temporary order or ex parte order suspending child
238238 visitation rights due to physical violence or threat of abuse.
239239 3. If service has not been made on the defendant at the time of
240240 the hearing, the court shall, at the request of the petiti oner,
241241 issue a new emergency order reflec ting a new hearing date and direct

293293 service to issue. If after two attempts service has not been made,
294294 service by publication is pe rmitted. Service by publication is only
295295 permitted in those cases where all other means of s ervice have been
296296 unsuccessful or are not possible due to lack of any known p hysical
297297 or electronic address of the respondent. Publication must be made
298298 in a newspaper of general circulation in the county where the
299299 petition was brought and in the county of th e last-known address of
300300 the respondent once a week for three consecutive weeks. The
301301 newspaper selected must be one of the three most widely cir culated
302302 papers in the county. The publication of summons must not be made
303303 until the court orders service by p ublication pursuant to this
304304 section. Service of the summons is considered complete on the date
305305 of the third publication when publication has been made f or three
306306 consecutive weeks. The summons must be signed by the petitione r.
307307 The summons must contain the dat e of the first publication and shall
308308 require the respondent upon whom service by p ublication is desired
309309 to appear and answer the petition on the date set for t he hearing.
310310 The summons must also contain a brie f statement of the reason for
311311 the petition and a summary of the provisions under the temporary
312312 protection order. The summons must be essentially in the following
313313 form:

390390 4. A petition for a protective order shall, upon the request of
391391 the petitioner, renew every fourteen (14) d ays with a new hearing
392392 date assigned until the defenda nt is served. A petition for a
393393 protective order shall not expire unless the petitioner fails to
394394 appear at the hearing or fails to request a new order. A petitioner
395395 may move to dismiss the petition and emergency or final order at any
396396 time; however, a prot ective order must be dismissed by court o rder.

448448 If a petitioner begins the process of service by publication, a new
449449 hearing date will be scheduled after serv ice by publication has been
450450 perfected.
451451 5. If traditional methods of service have failed, the court is
452452 authorized to accept alternative forms of service at the court's
453453 discretion, provided the petitione r can show by clear and c onvincing
454454 evidence that the re spondent has been notified of the proceedings
455455 and has been given the opportunity to appear.
456456 6. Failure to serve the defendant shall not be grounds for
457457 dismissal of a petition or an ex parte order unless the victim
458458 requests dismissal or fails to appear for the hearing thereon.
459459 6. 7. A final protective order shall be granted or denied
460460 within six (6) months of service on the defendant unless all parties
461461 agree that a temporary protective order remain in effect; provided,
462462 a victim shall have the right to request a final protective order
463463 hearing at any time after the passage of six (6) months.
464464 C. 1. At the hearing, the court may impose any terms and
465465 conditions in the protective order that the court reasonably
466466 believes are necessar y to bring about the cessation of domestic
467467 abuse against the victim or stal king or harassment of the victim or
468468 the immediate family of the victim but shall not impose any term and
469469 condition that may compromise the safety of the victim including,
470470 but not limited to, mediation, couples counseling, family
471471 counseling, parenting class es or joint victim-offender counseling

523523 sessions. The court may order the defendant to obtain domestic
524524 abuse counseling or treatment in a program certified by the Attorney
525525 General at the expense of the defendant pursuant to Section 644 of
526526 Title 21 of the Oklahoma Statutes.
527527 2. If the court grants a protective order and the defendant is
528528 a minor child, the court shall order a preliminary inquiry in a
529529 juvenile proceeding to determine wh ether further court action
530530 pursuant to the Oklahoma Juvenile Code should b e taken against a
531531 juvenile defendant.
532532 D. Final protective orders authorized by this section shall be
533533 on a standard form developed by the Administrative Office of the
534534 Courts.
535535 E. 1. After notice and hearing, protective orders authorized
536536 by this section may require the defendant to undergo treatment or
537537 participate in the court-approved counseling services necessary to
538538 bring about cessation of domestic abuse against the victim pursuant
539539 to Section 644 of Title 21 of the Oklahoma Statutes but shall not
540540 order any treatment or counseling that may compromis e the safety of
541541 the victim including, but not limited to, mediation, couples
542542 counseling, family counseling, parenting classes or joint vi ctim-
543543 offender counseling sessions.
544544 2. The defendant may be required to pay all or any part of the
545545 cost of such treatme nt or counseling services. The court shall not
546546 be responsible for such cost.

598598 3. Should the plaintiff choose to undergo treatment or
599599 participate in court-approved counseling services for victims of
600600 domestic abuse, the court may order the defendant to pay all or any
601601 part of the cost of such treatment or counseling services if the
602602 court determines that payment by the defendant is appropriate .
603603 F. When necessary to protect the victim and when authorized by
604604 the court, protective orders granted pursuant to the provisions of
605605 this section may be served upon the defendant by a peace officer,
606606 sheriff, constable, or policeman or other officer whose d uty it is
607607 to preserve the peace, as defined by Section 99 of Title 21 of the
608608 Oklahoma Statutes.
609609 G. 1. Any protective order issued on or after November 1,
610610 2012, pursuant to subsection C of this section shall be:
611611 a. for a fixed period not to exceed a perio d of five (5)
612612 years unless extended, modified, vacated or rescinded
613613 upon motion by either party or if the court approve s
614614 any consent agreement entered into by the plaintiff
615615 and defendant; provided, if the defendant is
616616 incarcerated, the protective order sha ll remain in
617617 full force and effect during the period of
618618 incarceration. The period of incarceration, in any
619619 jurisdiction, shall not be included in the calculation
620620 of the five-year time limitation, or

672672 b. continuous upon a specific finding by the court of on e
673673 of the following:
674674 (1) the person has a history of violating the orders
675675 of any court or governmental entity,
676676 (2) the person has previously been convicted of a
677677 violent felony offense,
678678 (3) the person has a previous felony conviction for
679679 stalking as provided in Section 1173 of Title 21
680680 of the Oklahoma Statutes,
681681 (4) a court order for a final Victim Protection Order
682682 has previously been issued against the person in
683683 this state or another state, or
684684 (5) the victim provides proof that a continuous
685685 protective order is necessary for his or her
686686 protection.
687687 Further, the court may take into consideration whether the person
688688 has a history of domestic violence or a history of other violent
689689 acts. The protective order shall remain in effect until modifie d,
690690 vacated or rescinded upon motion by either party or if the court
691691 approves any consent agreement entered into by the plaintiff and
692692 defendant. If the defendant is incarcerated, the protective order
693693 shall remain in full force and effect during the period of
694694 incarceration.

746746 2. The court shall notify the parties at the time of the
747747 issuance of the protective order of the duration of the protec tive
748748 order.
749749 3. Upon the filing of a motion by either party to modify,
750750 extend, or vacate a protective order, a hearing shall be scheduled
751751 and notice given to the parties. At the hearing, the issuing court
752752 may take such action as is necessary under the cir cumstances.
753753 4. If a child has been removed from the residence of a parent
754754 or custodial adult because of domestic abus e committed by the chi ld,
755755 the parent or custodial adult may refuse the return of such child to
756756 the residence unless, upon further consider ation by the court in a
757757 juvenile proceeding, it is determined that the child is no longer a
758758 threat and should be allowed to return to the re sidence.
759759 H. 1. It shall be unlawful for any person to knowingly and
760760 willfully seek a protective order against a sp ouse or ex-spouse
761761 pursuant to the Protection from Domestic Abuse Act for purposes of
762762 harassment, undue advantage, inti midation, or limitatio n of child
763763 visitation rights in any divorce proceeding or separation action
764764 without justifiable cause.
765765 2. The violator shall, upon conviction thereof, be guilty of a
766766 misdemeanor punishable by imprisonment in the county jail for a
767767 period not exceeding one (1) year or by a fine not to exceed Five
768768 Thousand Dollars ($5,000.00), or by both such fine and imprisonment.

820820 3. A second or subsequent conviction under this subsection
821821 shall be a felony punishable by imprisonment in the custody of the
822822 Department of Corrections for a period not to exceed two (2) years,
823823 or by a fine not to exceed Ten Thousand Dollars ($10,000.00), or by
824824 both such fine and imprisonment.
825825 I. 1. A protective order issued under the Protection from
826826 Domestic Abuse Act shall not in any manner aff ect title to real
827827 property, purport to grant to the parties a divorce or otherwise
828828 purport to determine the issues b etween the parties as to child
829829 custody, visitation or visitation schedules, child support or
830830 division of property or a ny other like relief o btainable pursuant to
831831 Title 43 of the Oklahoma Statutes, except child visitation orders
832832 may be temporarily suspended or modified to protect from threats of
833833 abuse or physical violence by the defendant or a threat to violate a
834834 custody order. Orders not affecting title may be entered for good
835835 cause found to protect an animal owned by either of the parties or
836836 any child living in the household.
837837 2. When granting any protective order for the protection of a
838838 minor child from violence or thre ats of abuse, the cour t shall allow
839839 visitation only under conditions that provide adequate supervision
840840 and protection to the child while m aintaining the integrity of a
841841 divorce decree or temporary order.
842842 J. 1. In order to ensure that a petitioner can maintain an
843843 existing wireless telephone number or household utility account, the

895895 court, after providing notice and a hearing, may issue an ord er
896896 directing a wireless service provider or public utility provider to
897897 transfer the billing responsibility for and rig hts to the wireless
898898 telephone number or numbers of any minor children in the care of the
899899 petitioning party or household utility account to the petitioner if
900900 the petitioner is not the wireless service or public utility account
901901 holder.
902902 2. The order transferring billing responsib ility for and rights
903903 to the wireless telephone number or numbers or household utility
904904 account to the petitioner shal l list the name and billing telephone
905905 number of the account holder, the name and contact information of
906906 the person to whom the telephone num ber or numbers or household
907907 utility account will be transferred and each telephone number or
908908 household utility to be transferred to that person. The court shall
909909 ensure that the contact information of the petitioner is not
910910 provided to the account holder in proceedings held under this
911911 subsection.
912912 3. Upon issuance, a copy of the final order of protection shall
913913 be transmitted, either electronically or by certified mail, to the
914914 registered agent of the wireless service provider or public u tility
915915 provider listed with the Secretary of State or Corporation
916916 Commission of Oklahoma or electronically to the email address
917917 provided by the wireless service provider or public utility

969969 provider. Such transmittal shall constitute adequate notice for the
970970 wireless service prov ider or public utility provider.
971971 4. If the wireless service provider or public utility provider
972972 cannot operationally or technically effectuate the order due to
973973 certain circumstances, the wireless service provider or public
974974 utility provider shall notify th e petitioner. Such circumstances
975975 shall include, but not be limited to, the following:
976976 a. the account holder has alr eady terminated the account,
977977 b. the differences in network technology prevent the
978978 functionality of a mobile device on the network, or
979979 c. there are geographic or other limitations on network
980980 or service availability.
981981 5. Upon transfer of billing responsibili ty for and rights to a
982982 wireless telephone number or numbers or household utility account to
983983 the petitioner under the p rovisions of this subs ection by a wireless
984984 service provider or public utility provider, the petitioner shall
985985 assume all financial responsi bility for the transferred wireless
986986 telephone number or numbers or household utility account, monthly
987987 service and utility billing costs and costs for any mobile device
988988 associated with the wireless telephone number or numbers . The
989989 wireless service provider or public utility provider shall have the
990990 right to pursue the original account holder for purposes of
991991 collecting any past due amounts owed to the wireless service
992992 provider or public utility provider.

10441044 6. The provisions of this subsection shall not preclud e a
10451045 wireless service provider or public utility provider from applying
10461046 any routine and customary requirements for acco unt establishment to
10471047 the petitioner as part of this transfer of billing responsibility
10481048 for a household utility account or for a wireless t elephone number
10491049 or numbers and any mobile devices attached to that number including,
10501050 but not limited to, identificatio n, financial informati on and
10511051 customer preferences.
10521052 7. The provisions of this subsection shall not affect the
10531053 ability of the court to appo rtion the assets and debts of the
10541054 parties as provided for in law or the ability to determine the
10551055 temporary use, posses sion and control of p ersonal property.
10561056 8. No cause of action shall lie against any wireless service
10571057 provider or public utility provider, its officers, employees or
10581058 agents for actions taken in accordance with the terms of a court
10591059 order issued under the pro visions of this subs ection.
10601060 9. As used in this subsection:
10611061 a. "wireless service provider" means a provider of
10621062 commercial mobile service u nder Section 332(d) of the
10631063 federal Telecommunications Act of 1996,
10641064 b. "public utility provider" means every corporatio n
10651065 organized or doing business in this state that owns,
10661066 operates or manages any plant or equipment for the
10671067 manufacture, production, transmi ssion, transportation,

11191119 delivery or furnishing of water, heat or light with
11201120 gas or electric current for heat, light or power, for
11211121 public use in this state, and
11221122 c. "household utility account" shall include utility
11231123 services for water, heat, light, power or ga s that are
11241124 provided by a public utility provider.
11251125 K. 1. A court shall not issue any mutual protective orders.
11261126 2. If both parties allege domestic abuse by the other party,
11271127 the parties shall do so by separate petitions . The court shall
11281128 review each petition separately in an individual or a consolidated
11291129 hearing and grant or deny each petition on its individual merits.
11301130 If the court finds cause to grant both motions, the court shall do
11311131 so by separate orders and with specific findings justifying the
11321132 issuance of each order.
11331133 3. The court may only consolidate a hearing if:
11341134 a. the court makes specific findings that:
11351135 (1) sufficient evidence exists of domestic abuse,
11361136 stalking, harassment or rape against each party,
11371137 and
11381138 (2) each party acted primarily as aggressors,
11391139 b. the defendant filed a petition with the court for a
11401140 protective order no less than three (3) days, not
11411141 including weekends or holidays, prior to the first

11951195 c. the defendant had no less than forty-eight (48) hours
11961196 of notice prior to the full hearing on the petition
11971197 filed by the plaintiff.
11981198 L. The court may allow a plaintiff or victim to be accompanied
11991199 by a victim support person at court proceedings . A victim support
12001200 person shall not make leg al arguments; however, a victim support
12011201 person who is not a licensed attorney may offer the plaintiff or
12021202 victim comfort or support and may remain in close proximity to the
12031203 plaintiff or victim.
12041204 SECTION 2. This act shall become effective November 1, 2024.
