150 | 150 | | 2. Emergency temporary ord ers, emergency ex parte orders and |
---|
151 | 151 | | notice of hearings shall be given priority for service and can be |
---|
152 | 152 | | served twenty-four (24) hours a day when the location of the |
---|
153 | 153 | | defendant is known. When service cannot be made upon the defendant |
---|
154 | 154 | | by the sheriff, the sherif f may contact another law enforcem ent |
---|
155 | 155 | | officer or a private investigator or private process server to serve |
---|
156 | 156 | | the defendant. |
---|
157 | 157 | | 3. An emergency temporary order, em ergency ex parte order, a |
---|
158 | 158 | | petition for protective order, and a notice of hearing shall have |
---|
159 | 159 | | statewide validity and may be transferre d to any law enforcement |
---|
160 | 160 | | jurisdiction to effect service upon the defendant. The sheriff may |
---|
161 | 161 | | transmit the document by electr onic means. |
---|
162 | 162 | | 4. The return of service shall be submitted to the sheriff's |
---|
163 | 163 | | office or court clerk in the court where the petition, not ice of |
---|

226 | 226 | | of the Protection from Domestic Abuse Act stated in the petition to |

227 | 227 | | hold such a hearing, regardless of whe ther an emergency temporary |
---|
228 | 228 | | order or ex parte order has been previously issued, reques ted or |
---|
229 | 229 | | denied. Provided, however, whe n the defendant is a minor child who |
---|
230 | 230 | | has been removed from the residence pursuant to Section 2-2-101 of |
---|
231 | 231 | | Title 10A of the Oklahoma St atutes, the court shall schedule a full |
---|
232 | 232 | | hearing on the petition within seventy -two (72) hours, regardless of |
---|
233 | 233 | | whether an emergency temporary order or ex parte order has been |
---|
234 | 234 | | previously issued, requested or denied. |

235 | 235 | | 2. The court may schedule a full hearing o n the petition for a |
---|

759 | 759 | | H. 1. It shall be unlawful for any person to knowingly and |

760 | 760 | | willfully seek a protective order against a sp ouse or ex-spouse |
---|
761 | 761 | | pursuant to the Protection from Domestic Abuse Act for purposes of |
---|
762 | 762 | | harassment, undue advantage, inti midation, or limitatio n of child |

763 | 763 | | visitation rights in any divorce proceeding or separation action |
---|

765 | 765 | | 2. The violator shall, upon conviction thereof, be guilty of a |

978 | 978 | | functionality of a mobile device on the network, or |

979 | 979 | | c. there are geographic or other limitations on network |

980 | 980 | | or service availability. |
---|
981 | 981 | | 5. Upon transfer of billing responsibili ty for and rights to a |
---|
982 | 982 | | wireless telephone number or numbers or household utility account to |
---|
983 | 983 | | the petitioner under the p rovisions of this subs ection by a wireless |
---|
984 | 984 | | service provider or public utility provider, the petitioner shall |
---|
985 | 985 | | assume all financial responsi bility for the transferred wireless |
---|
986 | 986 | | telephone number or numbers or household utility account, monthly |
---|
987 | 987 | | service and utility billing costs and costs for any mobile device |
---|
988 | 988 | | associated with the wireless telephone number or numbers . The |
---|
989 | 989 | | wireless service provider or public utility provider shall have the |

990 | 990 | | right to pursue the original account holder for purposes of |
---|
991 | 991 | | collecting any past due amounts owed to the wireless service |

1052 | 1052 | | 7. The provisions of this subsection shall not affect the |

1053 | 1053 | | ability of the court to appo rtion the assets and debts of the |

1054 | 1054 | | parties as provided for in law or the ability to determine the |
---|
1055 | 1055 | | temporary use, posses sion and control of p ersonal property. |
---|
1056 | 1056 | | 8. No cause of action shall lie against any wireless service |
---|
1057 | 1057 | | provider or public utility provider, its officers, employees or |
---|
1058 | 1058 | | agents for actions taken in accordance with the terms of a court |
---|
1059 | 1059 | | order issued under the pro visions of this subs ection. |
---|
1060 | 1060 | | 9. As used in this subsection: |

1061 | 1061 | | a. "wireless service provider" means a provider of |
---|
1062 | 1062 | | commercial mobile service u nder Section 332(d) of the |
---|
1063 | 1063 | | federal Telecommunications Act of 1996, |

1064 | 1064 | | b. "public utility provider" means every corporatio n |
---|
1065 | 1065 | | organized or doing business in this state that owns, |
---|
1066 | 1066 | | operates or manages any plant or equipment for the |

1067 | 1067 | | manufacture, production, transmi ssion, transportation, |

1125 | 1125 | | K. 1. A court shall not issue any mutual protective orders. |
---|
1126 | 1126 | | 2. If both parties allege domestic abuse by the other party, |
---|
1127 | 1127 | | the parties shall do so by separate petitions . The court shall |
---|
1128 | 1128 | | review each petition separately in an individual or a consolidated |
---|
1129 | 1129 | | hearing and grant or deny each petition on its individual merits. |
---|
1130 | 1130 | | If the court finds cause to grant both motions, the court shall do |
---|
1131 | 1131 | | so by separate orders and with specific findings justifying the |
---|
1132 | 1132 | | issuance of each order. |
---|
1133 | 1133 | | 3. The court may only consolidate a hearing if: |
---|
1134 | 1134 | | a. the court makes specific findings that: |
---|
1135 | 1135 | | (1) sufficient evidence exists of domestic abuse, |
---|
1136 | 1136 | | stalking, harassment or rape against each party, |
---|
1137 | 1137 | | and |

1138 | 1138 | | (2) each party acted primarily as aggressors, |
---|
1139 | 1139 | | b. the defendant filed a petition with the court for a |
---|
1140 | 1140 | | protective order no less than three (3) days, not |
---|
