AS INTRODUCED 
 
An Act relating to motor vehicles; amending Section 
1, Chapter 210, O.S.L. 2023 (47 O.S. Supp. 2023, 
Section 8-105), which relates to additional mandatory 
charges; requiring certain estimate of entire rental 
when advertising; requiring charges be clearly 
disclosed on same page; limiting dollar amount of 
certain holds on funds; requiring certain standards; 
and providing an effective date. 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     Section 1, Chapter 210, O.S.L. 
2023 (47 O.S. Supp. 2023, Section 8 -105), is amended to read as 
follows: 
Section 8-105. A. If a motor vehicle rental company imposes 
additional mandatory charges, th e rental company shall: 
1.  Provide a good-faith estimate of the total charges for t he 
entire rental, including all additional mandatory charges, whenever 
a vehicle is advertised for rent or a quote is provided to a 
potential customer.  All charges shall be clearly disclosed on the 
same page in the advertisement in a 10-point font or larger.  The

good-faith estimate may exclude mileage charge s and charges for 
optional items that cannot be determined prior to completing a 
rental reservation based on the information provided by the 
potential customer; and 
2.  Disclose in the rental contract pro vided to the renter the 
total charges for the entire rental, including all additional 
mandatory charges.  Total charges for the entire rental do not 
include any charges that cannot be determined at the time the ren tal 
commences; and 
3.  Not charge or place a hold on a consumer's credit or debit 
card funds for an amount greater than One Hundred Fifty Dollars 
($150.00).  Consumers using credit cards and debit cards shall be 
held to the same standards when renting vehicles from motor vehicle 
rental companies. 
B.  As used in this section : 
1. "Additional mandatory charge" means any separately stated 
charges that a motor vehicle rental company requires a renter to pay 
that specifically relate to the operation of a rental vehicle.  
Additional mandatory charge includes, but is not limited to, a 
customer facility charge, airport concession reco very fee, road 
safety program fee, vehicle license recovery f ee, or any government 
imposed taxes or fees; 
2.  "Motor vehicle" means the same as set forth in Section 562 
of Title 47 of the Oklahoma Statutes;

3. "Motor vehicle rental agreement " means an agreement for the 
rental of a motor vehicle for transportation p urposes, for a period 
no more than ninety (90) days, in return for a fee that is 
calculated on a daily, weekly, or monthly basis; 
4.  "Motor vehicle rental company" means an entity that is in 
the business of renting, pursuant to motor vehicle rental 
agreements; 
5.  "Quote" means an estimated cost of rental provided by a 
motor vehicle rental company to a pot ential customer based on 
information provided by the customer, including potential dates of 
rental, location, or class of vehicle; and 
6.  "Vehicle license recovery fee" means a charge to recover 
costs incurred by a motor vehicle rental company to license, title, 
register, plate, or inspect a re ntal vehicle. 
SECTION 2.  This act shall become effective November 1, 2024.
