7575 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new section of law to be codified
7777 in the Oklahoma Statutes as Section 6060.5b of Title 36, unless
7878 there is created a duplication in numbering, reads as follows:
7979 A. As used in this section:
8080 1. "Evidence-based cancer imaging " means evidence-based cancer
8181 imaging modalities in accordance with the most recent version of the
8282 National Comprehensive C ancer Network (NCCN) clinical practice
8383 guidelines;
8484 2. "Genetic testing for an inherited mutation " means germline
8585 multi-gene testing for an inherited mutation associated with an
8686 increased risk of canc er in accordance with NCCN clinical practice

139139 3. "Health benefit plan" means a health benefit plan as define d
140140 pursuant to Section 6060.4 of Title 36 of the Oklahoma Statutes; and
141141 4. "Health care provider " means any physician, hospital, or
142142 other entity or person that is licensed or other wise authorized in
143143 this state to furnish health care services.
144144 B. Any health benefit plan including the Oklahoma Employees
145145 Insurance Plan that is offered, issued, or renewed in this state on
146146 or after the effecti ve date of this act shall provide cover age for:
147147 1. Clinical genetic testing for an inherited gene mutation for
148148 individuals with a personal or family history of cancer that is
149149 recommended by a health care provider; and
150150 2. Evidence-based cancer imaging for individuals with an
151151 increased risk of cancer as recommended by the NCCN clinical
152152 practice guidelines.
153153 C. Coverage under this section shall not be subject to any
154154 annual deductible, copayments, or coinsurance limits as established
155155 for all covered benefits under the health benefit plan.
156156 D. If application of this act would result in health savings
157157 account ineligibility under Section 223 of the federal Internal
158158 Revenue Code, as amended, the provisions of this section shall only
159159 apply to health savings account s with qualified high deductible
160160 health plans with respect to the deductible of such a plan after the
161161 enrollee has satisfied the minimum deduct ible. Provided, however,
