75	75	BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law to be codified
77	77	in the Oklahoma Statutes as Section 6060.5b of Title 36, unless
78	78	there is created a duplication in numbering, reads as follows:
79	79	A. As used in this section:
80	80	1. "Evidence-based cancer imaging " means evidence-based cancer
81	81	imaging modalities in accordance with the most recent version of the
82	82	National Comprehensive C ancer Network (NCCN) clinical practice
83	83	guidelines;
84	84	2. "Genetic testing for an inherited mutation " means germline
85	85	multi-gene testing for an inherited mutation associated with an
86	86	increased risk of canc er in accordance with NCCN clinical practice

139	139	3. "Health benefit plan" means a health benefit plan as define d
140	140	pursuant to Section 6060.4 of Title 36 of the Oklahoma Statutes; and
141	141	4. "Health care provider " means any physician, hospital, or
142	142	other entity or person that is licensed or other wise authorized in
143	143	this state to furnish health care services.
144	144	B. Any health benefit plan including the Oklahoma Employees
145	145	Insurance Plan that is offered, issued, or renewed in this state on
146	146	or after the effecti ve date of this act shall provide cover age for:
147	147	1. Clinical genetic testing for an inherited gene mutation for
148	148	individuals with a personal or family history of cancer that is
149	149	recommended by a health care provider; and
150	150	2. Evidence-based cancer imaging for individuals with an
151	151	increased risk of cancer as recommended by the NCCN clinical
152	152	practice guidelines.
153	153	C. Coverage under this section shall not be subject to any
154	154	annual deductible, copayments, or coinsurance limits as established
155	155	for all covered benefits under the health benefit plan.
156	156	D. If application of this act would result in health savings
157	157	account ineligibility under Section 223 of the federal Internal
158	158	Revenue Code, as amended, the provisions of this section shall only
159	159	apply to health savings account s with qualified high deductible
160	160	health plans with respect to the deductible of such a plan after the
161	161	enrollee has satisfied the minimum deduct ible. Provided, however,
162	162	the provisions of this section shall apply to items or services that

215	215	Internal Revenue Code, as amended, regardless of whether the minimum
216	216	deductible has been satisfied.
217	217	SECTION 2. This act shall become effective November 1, 2024.
