5752 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5853 SECTION 1. AMENDATORY Rule 2.48 of the Rules of the
5954 Ethics Commission, is amended to read as follows :
6055 Rule 2.48. Candidate Committee Surplus Funds.
6156 Surplus funds of a candidate committee are those funds not
6257 otherwise obligated following the election at which the office fo r
6358 which the candidate committee was formed has been determined which,
6459 in the candidate's discretion, are not required to be used for
6560 campaign expenses or officeholder expenses. Such surp lus funds may
6661 be:
62+(A) Retained in any amount for use in a future cam paign for the
63+next succeeding term for the same office;

94-(A) Retained in any amount for use in a future cam paign for the
95-next succeeding term for the same office;
9690 (B) Retained for a future c ampaign for a different state
9791 elective office, excluding a judicial office;
9892 (C) Donated to a charitabl e organization as described in
9993 Section 501(c)(3) of Title 26 of the U nited States Code as it
10094 currently exists or as it may be amended;
10195 (D) Returned to any contributor, as long as the amount returned
10296 does not exceed the contributor 's aggregate contribution during the
10397 immediately preceding primary, runoff primary and general elections;
10498 (E) Contributed to a political party committee in any amount
10599 not to exceed Twenty-five Thousand Dollars ($25,000.00) in the
106100 aggregate;
107101 (F) Used to purchase item(s) for donat ion to a charitable
108102 organization as described in Section 501(c)(3) of Title 26 of the
109103 United States Code as it currently exists or as it may be amended;
110104 provided:
111105 (1) the donated item(s) are sold by the charitable organiz ation
112106 for fundraising purposes;
113107 (2) the purchase of the item(s) for donation is reported on a
114108 Contributions and Expenditures Report which includes a description
115109 and cost of the item(s) pu rchased;
116110 (3) the donation of the item(s) is reported on a Contributions
117111 and Expenditures Report as an in-kind expenditure to the charitable
112+organization which includes a description and the value of the
113+item(s) donated; and

145-organization which includes a description and the value of the
146-item(s) donated; and
147140 (4) the donated item(s) may not b e purchased or used by the
148141 candidate whose committee is donating the item, any other candidate,
149142 a committee, or officer, board member or employee of the charitable
150143 organization; or
151144 (G) Donated in accordance with the provisions of Section 381 et
152145 seq. of Title 60 of the Oklahoma Statutes to the State of Oklahoma,
153146 or, to any county, city, town or school d istrict within the State of
154147 Oklahoma; or
155148 (H) Used to retain legal co unsel for the successful defense of
156149 an investigation or prosecution of the candidate's campaign,
157150 campaign finances, or any other violation of the candidate's or
158151 office holder's official duties.
159152 Any surplus funds remaining in the candidate committee 's
160153 possession within ninety (90) days after the expiration of the term
161154 to which the candidate was elected or, for candidates who were not
162155 elected, within ninety (90) days after the second year following the
163156 general election, shall be deposited in the general reven ue fund of
164157 the state.
165158 SECTION 2. This act shall be come effective January 1, 2026.
