57 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

58 | 53 | | SECTION 1. AMENDATORY Rule 2.48 of the Rules of the |

59 | 54 | | Ethics Commission, is amended to read as follows : |

60 | 55 | | Rule 2.48. Candidate Committee Surplus Funds. |
---|
61 | 56 | | Surplus funds of a candidate committee are those funds not |
---|
62 | 57 | | otherwise obligated following the election at which the office fo r |
---|
63 | 58 | | which the candidate committee was formed has been determined which, |
---|
64 | 59 | | in the candidate's discretion, are not required to be used for |
---|
65 | 60 | | campaign expenses or officeholder expenses. Such surp lus funds may |
---|
66 | 61 | | be: |
---|
96 | 90 | | (B) Retained for a future c ampaign for a different state |
---|
97 | 91 | | elective office, excluding a judicial office; |
---|
98 | 92 | | (C) Donated to a charitabl e organization as described in |
---|
99 | 93 | | Section 501(c)(3) of Title 26 of the U nited States Code as it |
---|
100 | 94 | | currently exists or as it may be amended; |
---|
101 | 95 | | (D) Returned to any contributor, as long as the amount returned |
---|
102 | 96 | | does not exceed the contributor 's aggregate contribution during the |
---|
103 | 97 | | immediately preceding primary, runoff primary and general elections; |
---|
104 | 98 | | (E) Contributed to a political party committee in any amount |
---|
105 | 99 | | not to exceed Twenty-five Thousand Dollars ($25,000.00) in the |
---|

107 | 101 | | (F) Used to purchase item(s) for donat ion to a charitable |

108 | 102 | | organization as described in Section 501(c)(3) of Title 26 of the |

111 | 105 | | (1) the donated item(s) are sold by the charitable organiz ation |

115 | 109 | | and cost of the item(s) pu rchased; |

116 | 110 | | (3) the donation of the item(s) is reported on a Contributions |
---|
117 | 111 | | and Expenditures Report as an in-kind expenditure to the charitable |

147 | 140 | | (4) the donated item(s) may not b e purchased or used by the |

148 | 141 | | candidate whose committee is donating the item, any other candidate, |
---|
149 | 142 | | a committee, or officer, board member or employee of the charitable |

151 | 144 | | (G) Donated in accordance with the provisions of Section 381 et |

152 | 145 | | seq. of Title 60 of the Oklahoma Statutes to the State of Oklahoma, |

154 | 147 | | Oklahoma; or |

155 | 148 | | (H) Used to retain legal co unsel for the successful defense of |
---|
156 | 149 | | an investigation or prosecution of the candidate's campaign, |

157 | 150 | | campaign finances, or any other violation of the candidate's or |

158 | 151 | | office holder's official duties. |

159 | 152 | | Any surplus funds remaining in the candidate committee 's |
---|
160 | 153 | | possession within ninety (90) days after the expiration of the term |

161 | 154 | | to which the candidate was elected or, for candidates who were not |
---|
162 | 155 | | elected, within ninety (90) days after the second year following the |
---|
163 | 156 | | general election, shall be deposited in the general reven ue fund of |
---|
164 | 157 | | the state. |
