6565 An Act relating to law enforcement officers; amending

7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3311, as
8181 amended by Section 3, Chapter 272, O.S.L. 2023 (70 O.S. Supp. 2023,
8282 Section 3311), is amended to read as follows:
8383 Section 3311. A. There is hereby created a Council on Law
8484 Enforcement Education and Training which shall be, and is hereby
8585 declared to be, a governmental law enforcement agency of the State
8686 of Oklahoma, body politic and corporate, with powers of government
8787 and with the authority to exercise the rights, privileges and
8888 functions necessary to ensure the professiona l training and
8989 continuing education of law enforcement officers i n this state.

141141 These rights, privileges and functions include, but are not limited
142142 to, those specified in Sections 3311 through 3311.15 of this title
143143 and in the Oklahoma Security G uard and Private Investigator Act and
144144 the Bail Enforcement and Licensing Act . The Council shall be
145145 authorized to require agency employees and the employees of agency
146146 contractors in positions to have access to Oklahoma Peace Officer
147147 records, Oklahoma Security Guard and Private Investigator records ,
148148 Bail Enforcement and Licensing Act r ecords, to be subject to a
149149 criminal history search by the Oklahoma State Bureau of
150150 Investigation, as well as be fingerprinted for submission of the
151151 fingerprints through the Oklahoma State Bureau of Investigation to
152152 the Federal Bureau of Investigation for a national criminal history
153153 check. The Council shall be the recipient of the results of t he
154154 record check. In accordance with Section 150.9 of Title 74 of the
155155 Oklahoma Statutes, this includes a national criminal record with a
156156 finger print analysis . The Council shall be composed of thirteen
157157 (13) members as follows:
158158 1. The Commissioner of the Department of Public Safety, or
159159 designee;
160160 2. The Director of the Okl ahoma State Bureau of Narcotics and
161161 Dangerous Drugs Control, or designee;
162162 3. The Director of the Oklahoma State Bureau of Investigation,

218218 5. One member appointed by the Governor who shall be a chief of
219219 police of a municipality with a population over one hundred thousand
220220 (100,000), as determined b y the latest Federal Decennial Census;
221221 6. One member appointed by th e Board of Directors of the
222222 Oklahoma Sheriffs' Association who shall be a sheriff of a county
223223 with a population under twenty-five thousand (25,000), as determined
224224 by the latest Federal De cennial Census;
225225 7. One member appointed by the Oklahoma Association of Chiefs
226226 of Police who shall be a chief of police representing a municipality
227227 with a population over ten thousand (10,000), as determined by the
228228 latest Federal Decennial Ce nsus;
229229 8. One member shall be appointed by the Board of Directors of
230230 the Oklahoma Sheriffs' Association who shall be a sheriff of a
231231 county with a population of twenty -five thousand (25,000) or more,
232232 as determined by the latest Federal Decennial Census;
233233 9. One member appointed by the Board of Directors of the
234234 Fraternal Order of Police who s hall have experience as a training
235235 officer;
236236 10. One member appointed by the Chancellor of Higher Education
237237 who shall be a representative of East Central University;

289289 11. One member appointed by the Board of Directors of the
290290 Oklahoma Sheriffs and Peace Off icers Association who shall be a
291291 full-time law enforcement officer in good standing with CLEET wit hin
292292 a county with a population under fifty thousand (50,000);
293293 12. The President Pro Tempore of the Senate shall appoint one
294294 member from a list of three or mo re nominees submitted by a
295295 statewide organization representing cities and towns that is exempt
296296 from taxation under federal law and designated pursuant to the
297297 provisions of the Internal Revenue Code, 26 U.S.C., Section 170(a);
298298 and
299299 13. The Speaker of the Ho use of Representatives shall appoint
300300 one member from a list of three or more nominees submitted by an
301301 organization that assists in the establishment of accreditation
302302 standards and training programs for law enforcement agencies
303303 throughout this state.
304304 The Executive Director selected by the Council shall be an ex
305305 officio member of the Council and shall act as Secretary. The
306306 Council on Law Enforcement Ed ucation and Training shall select a
307307 chair and vice-chair from among its members. Members of the Council
308308 on Law Enforcement Education and Training shall not receive a salary
309309 for duties performed as members of the Council, but shall be
310310 reimbursed for their actual and necessary expenses incurred in the
311311 performance of Council duties pursuant to the provi sions of the
312312 State Travel Reimbursement Act.

364364 B. The Council on Law Enforcement Education and T raining is
365365 hereby authorized and direct ed to:
366366 1. Appoint a larger Advisory Council to discuss problems and
367367 hear recommendations concerning necessary research, m inimum
368368 standards, educational needs, and other matters imperative to
369369 upgrading Oklahoma law en forcement to professional status;
370370 2. Promulgate rules with respe ct to such matters as
371371 certification, revocation, suspension, withdrawal and reinstatement
372372 of certification, minimum courses of study, testing and test scores,
373373 attendance requirements, equipm ent and facilities, minimum
374374 qualifications for instructors, minimu m standards for basic and
375375 advanced in-service courses, and seminars for Oklahoma police and
376376 peace officers;
377377 3. Authorize research, basic and advanced courses, and seminars
378378 to assist in program planning directly and through subcomm ittees;
379379 4. Authorize additional staff and services necessary for
380380 program expansion;
381381 5. Recommend legislation necessary t o upgrade Oklahoma law
382382 enforcement to professional status;
383383 6. Establish policies and reg ulations concerning the number,
384384 geographic and police unit distributio n, and admission requirements
385385 of those receiving tuition or scholarship aid available through the
386386 Council. Such waiver of costs shall be limited to duly appointed

439439 enforcement agencies on the basi s of educational and financial need;
440440 7. Appoint an Executive Director to direct the staff, inform
441441 the Council of compliance with the provisions of this sectio n and
442442 perform such other duties impo sed on the Council by law . An
443443 Executive Director appointed by the Council must qualify for the
444444 position with a bachelor or higher degree in law enforcement from an
445445 accredited college or university, or a bachelor or high er degree in
446446 a law-enforcement-related subject area, and a minimum of f ive (5)
447447 years of active law enforcement experience including, b ut not
448448 limited to, responsibility for enforcement, investigation,
449449 administration, training, or curriculum implementation.
450450 The Executive Director of the Counc il on Law Enforcement
451451 Education and Training may hire an Assistant Director to perform
452452 such duties as directed by the Executive Director.
453453 The Executive Director of the Council on Law Enforcement
454454 Education and Training m ay commission CLEET staff as peace o fficers
455455 for purposes consistent with the duties of CLEET as set out in state
456456 law. The powers and duties conferred on the Executive Director or
457457 any staff member appointed by the Executive Director as a peace
458458 officer shall not limit the powers and duties of other peace
459459 officers of this state o r any political subdivision thereof. The

512512 Director as a peace officer may, upon request, assist any federal,
513513 state, county or municipal law enforcement a gency;
514514 8. Enter into contracts and a greements for the payment of
515515 classroom space, food, and lodging expenses as may be necessary for
516516 law enforcement officers attending any official course of
517517 instruction approved or con ducted by the Council. Such expenses may
518518 be paid directly to the contract ing agency or business
519519 establishment. The food and lodging exp enses for each law
520520 enforcement officer shall not exceed the authorized rates as
521521 provided for in the State Travel Reimbu rsement Act; provided,
522522 however, the Council may provide food and lodging t o law enforcement
523523 officials attending any official course of in struction approved or
524524 conducted by the Council rather than paying for the provision of
525525 such food and lodging by an outs ide contracting agency or business
526526 establishment;
527527 9. a. Certify canine teams, consisting of a dog and a
528528 handler working together as a tea m, trained to detect:
529529 (1) controlled dangerous substances, or
530530 (2) explosives, explosive materials, explosive
531531 devices, or materials which could be used t o
532532 construct an explosive device;
533533 provided, the dog of a certified canine team shall not
534534 be certified at any time as both a drug dog and a bomb
535535 dog, and any dog of a certified canine team who has

587587 been previously certifie d as either a drug dog or a
588588 bomb dog shall not be eligible at any time to be
589589 certified in the other category.
590590 b. Upon retiring the dog from t he service it was
591591 certified to perform, the law enforcement department
592592 that handled the dog shall retain possessio n of the
593593 dog. The handler shall hav e first option of adopting
594594 the dog. If that option is not exercised, the law
595595 enforcement department shall provide for its adoption.
596596 Once adopted the dog shall not be placed back into
597597 active service;
598598 10. Enter into a lease, loan or other agreement with the
599599 Oklahoma Development Finance Authority o r a local public trust for
600600 the purpose of facilitating the fina ncing of a new facility for its
601601 operations and use and pledge, to the extent authorized by law, all
602602 or a portion of its receipts of the assessment pe nalty herein
603603 referenced for the payment of i ts obligations under such lease, loan
604604 or other agreement. It is the intent of the Legislature to increase
605605 the assessment penalty to such a level or appropriate sufficient
606606 monies to the Council on Law Enforcement Education and Training to
607607 make payments on the lease, loan or other agreement for the purpose
608608 of retiring the bonds to be issued by the Oklahoma Development
609609 Finance Authority or local public trust . Such lease, loan or other
610610 agreement and the bonds issued to finance such facilities shall not

662662 constitute an indebtedness of this state or be backed by the full
663663 faith and credit of this state, and the lease, loan or other
664664 agreement and the bonds shall contain a statement to such effect;
665665 11. Accept gifts, bequests, devises, contributions and grants,
666666 public or private, of real or personal property;
667667 12. Appoint an advisory committee composed of representatives
668668 from security guard and private investigative agencies to advise the
669669 Council concerning necessary resea rch, minimum standards for
670670 licensure, education, and other matters related to licensure of
671671 security guards, security guard agencies, private investigators, and
672672 private investigative agencies;
673673 13. Enter into agreements with individuals, educational
674674 institutions, agencies, and business and tribal entities for
675675 professional services, the use of facilities and suppli es, and staff
676676 overtime costs incurred as a result of the user 's requests to
677677 schedule functions after -hours, on weekends, or anytime such
678678 requests extend staff beyond its normal capacity, whereby
679679 contracting individuals, educational institutions, agencies, and
680680 business and tribal entities shall pay a fee to be determined by the
681681 Council by rule. All fees collected pursuant to facilities usage
682682 shall be deposited to the credit of the C.L.E.E.T. Training Center
683683 Revolving Fund created pursuant to Section 3311.6 of this title.
684684 All other fees collected pursuant to these agreeme nts shall be
685685 deposited to the credit of the Peace Officer Revolving Fund created

738738 to promulgate emergency rules to effectu ate the provisions of this
739739 paragraph;
740740 14. Promulgate rules to es tablish a state firearms
741741 requalification standard for active peace officers and meet any
742742 requirements imposed on the Council by the federal Law Enforcement
743743 Officers Safety Act of 2004;
744744 15. Set minimal criteria relating to qualifications for chief
745745 of police administrative training pursuant to Section 34 -102 of
746746 Title 11 of the Oklahom a Statutes, assist in developing a course of
747747 training for a Police Chief Administrative School, and approve all
748748 police chief administrative training offered in this state;
749749 16. Appoint a Curriculum Review Board to be composed of six (6)
750750 members as follows:
751751 a. one member shall be selected by the Chancellor for
752752 Higher Education, who possesses a background of
753753 creation and review of curriculum and experience
754754 teaching criminal just ice or law enforcement courses,
755755 who shall serve an initial term of one (1) year,
756756 b. one member shall represent a municipal jurisdiction
757757 with a population of fifty thousand (50,000) or more
758758 and who shall be a management-level CLEET-certified
759759 training officer, who shall serve an initial term of
760760 two (2) years,

813813 a population of fifty thousand (50,000) or more and
814814 who shall be a management -level CLEET-certified
815815 training officer, who shall serve an initial term of
816816 three (3) years,
817817 d. one member shall represent a municipal jurisdiction
818818 with a population of less than fifty thousand (50,000)
819819 and who shall be a CLEET -certified training officer,
820820 who shall serve an initial term of two (2) years,
821821 e. one member shall represent a county jurisdiction with
822822 a population of less than fifty thousan d (50,000) and
823823 who shall be a CLEET-certified training officer, who
824824 shall serve an initial term of one (1) year, and
825825 f. one member selected by the Oklahoma Department of
826826 Career and Technology, who shall have experience in
827827 the creation and review of curric ulum as well as
828828 experience in teaching criminal justice or law
829829 enforcement courses, who shall serve an initial term
830830 of three (3) years.
831831 After the initial terms of office, all members shall be
832832 appointed to serve three -year terms. Any member may be reappoi nted
833833 to serve consecutive terms. Members shall serve without
834834 compensation, but may be reimbursed for travel expenses p ursuant to
835835 the State Travel Reimbursement Act. The Board shall review and

887887 establish curriculum for all CLEET academies and training cour ses
888888 pursuant to procedures established by the Council on Law Enforcement
889889 Education and Training;
890890 17. Conduct review and verification of any records relating to
891891 the statutory duties of CLEET;
892892 18. Receive requested reports including investigative reports ,
893893 court documents, statements, or other applicable information from
894894 local, county and state agencies and other agencies f or use in
895895 actions where a certification or license issu ed by CLEET may be
896896 subject to disciplinary or other actions provided by law;
897897 19. Summarily suspend a certification of a peace officer,
898898 without prior notice but otherwise subject to administrative
899899 proceedings, if CLEET finds that the actions of the certif ied peace
900900 officer may present a danger to the peace officer, the public, a
901901 family or household member, or involve a crime against a minor. A
902902 certified copy of the information or indictment charging suc h a
903903 crime shall be considered clear and convincing evi dence of the
904904 charge; and
905905 20. Approve law enforcement agencies and police depar tments in
906906 accordance with the following:
907907 a. this section applies only to an entity authorized by
908908 statute or by the Constitu tion to create a law
909909 enforcement agency or police de partment and
910910 commission, appoint, or employ officers that first

962962 creates or reactivates an inactive law enforcement
963963 agency or police department and first begins to
964964 commission, appoint, or employ officers o n or after
965965 November 1, 2011,
966966 b. the entity shall submit to CLEET, a minimum of sixty
967967 (60) days prior to creation of the law enforce ment
968968 agency or police department, information regarding:
969969 (1) the need for the law enforcement agency or police
970970 department in the community,
971971 (2) the funding sources for the la w enforcement
972972 agency or police department, and proof that no
973973 more than fifty percent (50%) of the fu nding of
974974 the entity will be derived from ticket revenue or
975975 fines,
976976 (3) the physical resources available to o fficers,
977977 (4) the physical facilities that the l aw enforcement
978978 agency or police department will operate
979979 including descriptions o f the evidence room,
980980 dispatch area, restroom facilities, and public
981981 area,
982982 (5) law enforcement policies of the law enforcement
983983 agency or police department including published
984984 policies on:
985985 (a) use of force,

10511051 authorization or denial to create a la w enforcement
10521052 agency or police depa rtment and commission, appoint,
10531053 or employ officers, signed by the Executive Director
10541054 of CLEET, and
10551055 d. in cases of denial, the entity may appeal the decision
10561056 of the Executive Director to the full CLEET Council .
10571057 The Executive Director shall ensure that the final
10581058 report is provided to all members of the Council. The
10591059 Council shall review and make recommendations

11191119 C. 1. Payment of any fee provided for in this se ction may be
11201120 made by a nationally recogn ized credit or debit card issued to the
11211121 applicant. The Council may publicly post and collect a fee for the
11221122 acceptance of the nationally recognized credit or debit card not to
11231123 exceed five percent (5%) of the amount o f the payment. For purposes
11241124 of this subsection, "nationally recognized credit card" means any
11251125 instrument or device, whether known as a credit card , credit plate,
11261126 charge plate, or by any other name, issued with or without fee by an
11271127 issuer for the use of th e cardholder in obtaining goods, service s,
11281128 or anything else of value and which is accepted by over one thousand
11291129 merchants in this state . "Debit card" means an identification card
11301130 or device issued to a person by a business organization which
11311131 permits such person to obtain access to or activate a consumer
11321132 banking electronic facility. The Council shall determine which
11331133 nationally recognized credit or de bit cards will be accepted as
11341134 payment for fees.

11861186 2. Payment for any fee provided for in this title may be ma de
11871187 by a business check. The Council may:
11881188 a. add an amount equal to the amount of the service
11891189 charge incurred, not to exceed three percent (3%) of
11901190 the amount of the check as a service charge for the
11911191 acceptance and verification of the check, or
11921192 b. add an amount of no more than Five Dollars ($5.00) as
11931193 a service charge for the acceptance and verification
11941194 of a check. For purposes of this subsection,
11951195 "business check" shall not mean a money order,
11961196 cashier's check, or bank certified check.
11971197 D. Failure of the Legislature to appropriate necessary funds to
11981198 provide for expenses and operations of the Council on Law
11991199 Enforcement Education and Training shall not inv alidate other
12001200 provisions of this section relating to the creation and duties of
12011201 the Council.
12021202 E. 1. No person shall be eligible for employment as a peace
12031203 officer or reserve peace officer until the employing law enforcement
12041204 agency has conducted a backgroun d investigation of such person
12051205 consisting of the following:
12061206 a. a fingerprint search submitted to the Ok lahoma State
12071207 Bureau of Investigation with a re turn report to the
12081208 submitting agency that such person has no felony

12721272 e. such person is not participating in a defer red
12731273 sentence agreement for a felony, a crime involving
12741274 moral turpitude or a crime of domestic viole nce, and
12751275 does not have any criminal charges pendin g in any
12761276 court in this state, another state, in tribal court or
12771277 pursuant to the United States Code,
12781278 f. such person is not currently subject to an order of
12791279 the Council revoking, suspending, or accepting a
12801280 voluntary surrender of peace officer certification,
12811281 g. such person is not currently undergoing treatment for
12821282 a mental illness, condition or disorder . For purposes
12831283 of this subsection, "currently undergoing treatment
12841284 for mental illness, condition or disorde r" means the

13371337 psychologist, or licensed mental health professional
13381338 as being afflicted with a substantial diso rder of
13391339 thought, mood, perception, psychological orientation
13401340 or memory that significantly impairs judgment,
13411341 behavior, capacity to recognize reality, or ability to
13421342 meet the ordinary demands of life and such condition
13431343 continues to exist,
13441344 h. such person is twenty-one (21) years of age.
13451345 Provided, this requirement shall not affect those
13461346 persons who are already employed as a police or peace
13471347 officer prior to November 1, 1985, and
13481348 i. such person has provided proof of United States
13491349 citizenship or resident alien sta tus, pursuant to an
13501350 employment eligibility verification form from the
13511351 United States Citizenship and Immigration Services.
13521352 2. To aid the evaluating p sychologist in interpreting the test
13531353 results including automated scoring and interpretations, the
13541354 employing agency shall provide the psychologist a statement
13551355 confirming the identity of the individual t aking the test as the
13561356 person who is employed or seeking employment as a peace officer of
13571357 the agency and attesting that it administered the psychological
13581358 instrument in accordance with standards within the test document .

14131413 whether to certify to the Council on Law Enforcement Education and
14141414 Training that the person being eva luated is suitable to serve as a
14151415 peace officer in this state. No additional procedures or
14161416 requirements shall be imposed for performance of the psychologic al
14171417 evaluation. The psychological instrument utilized shall be
14181418 evaluated by a psychologist licensed b y the State of Oklahoma, and
14191419 the employing agency shall certify to the Council that the
14201420 evaluation was conducted in accordance with this provision and that
14211421 the employee or applicant is suitable to serve as a peace officer i n
14221422 this state.
14231423 a. Any person found not to be suitable for employment or
14241424 certification by the Council shall not be empl oyed,
14251425 retained in employment as a peace officer, or
14261426 certified by the Council for at least one (1) year, at
14271427 which time the employee or applicant may be
14281428 reevaluated by a psy chologist licensed by the State of
14291429 Oklahoma. This section shall also be applicable t o
14301430 all reserve peace officers in this state.
14311431 b. Any person who is certified by CLEET and has undergone
14321432 the psychological evaluation required by this
14331433 subparagraph and has been found to be suitable as a
14341434 peace officer shall not be required to be ree valuated

14901490 officer may present a danger to himself or herself,
14911491 the public, or a family or household member.
14921492 c. All persons seeking certification shall have their
14931493 name, gender, date of birth, and address of such
14941494 person submitted to the Department of Mental Health
14951495 and Substance Abuse Services by the Council . The
14961496 Department of Mental He alth and Substance Abuse
14971497 Services shall respond to the Council within ten (10)
14981498 days whether the computerized records of the
14991499 Department indicate the applicant has ever been
15001500 involuntarily committed to an Oklahoma state mental
15011501 institution. In the event that the Department of
15021502 Mental Health and Subst ance Abuse Services reports to
15031503 the Council that the applicant has been involuntarily
15041504 committed, the Council shall immediately inform the
15051505 employing agency.
15061506 All basic police courses shall in clude a minimum of four (4)
15071507 hours of education and training in recog nizing and managing a person
15081508 appearing to require mental health treatment or services . The
15091509 training shall include training in crime and drug prevention, crisis

15651565 Subject to the availability of funding, for full -time salaried
15661566 police or peace officers a basic police course academy shall consist
15671567 of a minimum of six hundred (600) hours.
15681568 For reserve deputies a basic reserve academy shall consist of a
15691569 minimum of two hundred forty (240) hours.
15701570 3. Beginning January 1, 2018, any reserve pe ace officer who has
15711571 completed the two-hundred-forty-hour reserve peace officer
15721572 certification program and who has been in active service in that
15731573 capacity for the past six (6) months shall be eligible to attend a
15741574 three-hundred-sixty-hour basic full-time training academy to become
15751575 certified as a full-time peace or police offi cer.
15761576 4. Every person who has not been certified as a police or peace
15771577 officer and is duly appointed or elected as a police or peace
15781578 officer shall hold such position on a temporary basis on ly, and
15791579 shall, within six (6) months from the date of appointment or taking
15801580 office, qualify as required in this subsection or forfeit such
15811581 position. In computing the tim e for qualification, all service
15821582 shall be cumulative from date of first appointment or taking office
15831583 as a police or peace officer with any department in t his state.

16361636 in this paragraph for good cause a s determined by the

16381638 b. A duty is hereby imposed upon the employing agency to
16391639 withhold payment of the com pensation or wage of such
16401640 unqualified officer.
16411641 c. If the police or peace officer fails to forfeit the
16421642 position or the employing agency fails to require the
16431643 officer to forfeit the position, the district attorney
16441644 shall file the proper action to cause the for feiting
16451645 of such position. The district court of the county
16461646 where the officer is employed shall have jurisdiction
16471647 to hear the case.
16481648 5. The Council may certify officers who have completed a course
16491649 of study in another state deemed by the Council to meet st andards
16501650 for Oklahoma peace officers provid ing the officer's certification in
16511651 the other state has not been revoked or voluntarily surrendered and
16521652 is not currently under suspension.
16531653 6. For purposes of this section, a police or peac e officer is
16541654 defined as a full-time duly appointed or elected office r who is paid
16551655 for working more than twenty-five (25) hours per week and whose
16561656 duties are to preserve t he public peace, protect life and property,
16571657 prevent crime, serve warrants, transport p risoners, and enforce law s
16581658 and ordinances of this state, or any poli tical subdivision thereof;

17151715 shall not apply to persons designated by the Director of the
17161716 Department of Corrections as peace officers pursuan t to Section 510
17171717 of Title 57 of the Oklahom a Statutes.
17181718 F. No person shall be certified as a police or peace officer by
17191719 the Council or be employ ed by the state, a county, a city, or any
17201720 political subdivision thereof, who is:
17211721 1. Is currently subject to an order o f the Council revoking,
17221722 suspending, or accep ting a voluntary surrender of peace officer
17231723 certification or who has;
17241724 2. Has been convicted of a felony, a cr ime involving moral
17251725 turpitude, or a crime of domestic violence, unless a full pardon has
17261726 been granted by the proper agency; however or
17271727 3. Has been arrested for a felony criminal offense, unless at
17281728 least ten (10) years have passed since the person was arrested, no
17291729 misdemeanor or felony charges are pending against the person , and
17301730 the person has been granted a criminal arrest record expungement as
17311731 provided for in Sections 18 and 19 of Title 22 of the Oklahoma
17321732 Statutes.

17891789 G. 1. The Council is hereby authorized to provide to any
17901790 employing agency the follow ing information regarding a person who is
17911791 or has applied for employment as a police or peace officer of such
17921792 employing agency:
17931793 a. Oklahoma State Bureau of I nvestigation and Federal
17941794 Bureau of Investigation reports,
17951795 b. administration of the psychological t ests provided for
17961796 herein,
17971797 c. performance in the course of study or other bas is of
17981798 certification,
17991799 d. previous certifications issued, and
18001800 e. any administrative or judicial determination denying
18011801 certification.
18021802 2. An employing agency shall not be liable i n any action
18031803 arising out of the release of contents of personnel information
18041804 relevant to the qualifications or ability of a person to perform the
18051805 duties of a police or peace officer when such information is
18061806 released pursuant to written authorization for re lease of
18071807 information signed by such person and is provided to another

18611861 3. As used in this subsection, "employing agency" means a
18621862 political subdivision or l aw enforcement agency which either has

18641864 employed, would be subject to this section.
18651865 H. 1. A law enforcement agency employing police or peace
18661866 officers in this state shall report the hiri ng, resignation, or
18671867 termination for any reason of a police or peace officer to the
18681868 Council within ten (10) days. Failure to comply with the provisions
18691869 of this subsection may disqualify a law enforcement agency from
18701870 participating in training programs spons ored by the Council. Every
18711871 law enforcement agency employing police or peace offic ers in this
18721872 state shall submit to CLEET on or before October 1 of each calendar
18731873 year a complete list of all commissioned employees with a current
18741874 mailing address and phone nu mber for each such employee. In
18751875 addition to the above, CLEET may impose an admini strative fine for
18761876 violations of this section.
18771877 2. A tribal law enforcement agency that has peace officers
18781878 commissioned by an Oklahoma law enforcement agency pursuant to a
18791879 cross-deputization agreement with the State of Oklahoma or any
18801880 political subdivision of the State of Oklahoma pursuant to the
18811881 provisions of Section 1221 of Title 74 of the Oklahoma Statutes
18821882 shall report the commissioning, resignation, or terminati on of

19371937 of this subsection may disqualify a tribal law enfor cement agency
19381938 from participating in training programs sponsored by the Council.
19391939 I. It is unlawful for any person to willfully make any
19401940 statement in an application to CLEET kno wing the statement is false
19411941 or intentionally commit fraud in any application to the Council for
19421942 attendance in any CLEET-conducted or CLEET-approved peace officer
19431943 academy or Collegiate Officer Program or for the purpose of
19441944 obtaining peace officer certificat ion or reinstatement. It is
19451945 unlawful for any person to willfully submit false o r fraudulent
19461946 documents relating to continuing education rosters, transcripts or
19471947 certificates, or any canine license application. Any person
19481948 convicted of a violation of this su bsection shall be guilty of a
19491949 felony punishable by imprisonment in the Departmen t of Corrections
19501950 for a term of not less than two (2) years nor more than five (5)

20902090 recognize reality, or ability to meet the ordinary
20912091 demands of life. Provided, the peace officer
20922092 certification may be reinstated upon the Council
20932093 receiving notification of a psyc hological evaluation
20942094 conducted by a licensed physician, psychologist or
20952095 licensed mental health professional which attests and
20962096 states by affidavit that the officer and the
20972097 evaluation test data of the officer have been examined
20982098 and that, in the professional opinion of the
20992099 physician, psychologist or licensed mental health
21002100 professional, the officer is psychologically suitable
21012101 to return to duty as a peace officer . Notwithstanding
21022102 any other provision of state law pertaining to
21032103 confidentiality of hospital or othe r medical records,
21042104 and as allowable under federal law, CLEET may subpoena
21052105 or request a court to subpoena records necessary to
21062106 assure compliance with these provisi ons. Any

21662166 2. Disciplinary proceedings shall be commenced by filing a
21672167 complaint with the Council on a form approved by the Council . Any
21682168 employing agency or other person having information may submit such
21692169 information to the Council for consider ation as provided in this
21702170 subsection.
21712171 3. Upon the filing of the compl aint, a preliminary
21722172 investigation shall b e conducted to determine whether:
21732173 a. there is reason to believe the person has violated any
21742174 provision of this subsecti on or any other provision o f
21752175 law or rule, or
21762176 b. there is reason to believe the person has been
21772177 convicted of a felony, a crime involving mo ral
21782178 turpitude or a domestic violence offe nse or is
21792179 currently participating in a deferred sentence for
21802180 such offenses.
21812181 4. When the investigation o f a complaint does not find the
21822182 person has violated any of the provisi ons of this subsection, or

22362236 disciplinary action shall be requi red and the person shall remain
22372237 certified as a police or peace officer . When the investigation of a
22382238 complaint finds that the person has violated any of the provisions
22392239 of this subsection, the matter shall be referred for discip linary
22402240 proceedings. The disciplinary proceedings shall be in accordance
22412241 with Articles I and II of the Administrative Procedures Act.
22422242 5. The Council shall revoke the certification of any person
22432243 upon determining that such person has been convicted of a fe lony or
22442244 a crime involving mora l turpitude or a domestic violence offense or
22452245 has entered a plea of gu ilty, or nolo contendere or an "Alford" plea
22462246 or any plea other than a not guilty p lea for a felony offense, a
22472247 crime of moral turpitude or a crime of domesti c violence or is the
22482248 respondent in a final victim protective order; provided, that if the
22492249 conviction has been reversed, vacated or otherwise invalidated by an
22502250 appellate court, such conviction shall not be the basis for
22512251 revocation of certification; provided further, that any person who
22522252 has been trained and certified by the Council on Law Enf orcement
22532253 Education and Training and is actively employe d as a full-time peace
22542254 officer as of November 1, 1985, shall not be subject to the
22552255 provisions of this subsection for convictions occurring prior to
22562256 November 1, 1985. The sole issue to be determined at the hearing
22572257 shall be whether the person has been convi cted of a felony, a crime

23112311 6. The Council shall revoke the certification of any perso n
23122312 upon determining that such person has r eceived a deferred sentence
23132313 for a felony, a crime involving moral turpitude or a domestic
23142314 violence offense.
23152315 7. The Council may suspend the certification of any person upon
23162316 a determination that such person has been involuntarily committed to
23172317 a mental institution or mental health facility for a mental illness,
23182318 condition or disorder as provided in sub paragraph f of paragraph 1
23192319 of this subsection.
23202320 8. Every law enforcement agenc y in this state shall, within
23212321 thirty (30) days of a final order of termination or r esignation
23222322 while under investigation of a CLEET-certified peace officer, report
23232323 such order or resignation in writing to the Executive Director of
23242324 the Council. Any report, upon receipt by the Council, shall be
23252325 considered as personnel records and shall be a fforded confidential
23262326 protection pursuant to Sections 24A.7 and 24A.8 of Title 51 of the
23272327 Oklahoma Statutes. Any medical or other confidential records
23282328 obtained by subpoena pu rsuant to this subsection shall not be mad e a
23292329 part of such report. The Executive Director shall ensure that the
23302330 report is provided to all members of the Council. The Council shall
23312331 review and make recommendations concerning the report at the first
23322332 meeting of the Council to occur after all members of the Council

23872387 are grounds for such actions pursuant to th is section and the peace
23882388 officer in question has been provided with notice and a n opportunity
23892389 for a hearing pursuant to the Administrati ve Procedures Act.
23902390 Suspension or revocation of CLEET certification pursuant t o this
23912391 paragraph shall be reported to the district attorney for the
23922392 jurisdiction in which the peace officer was employed, to the
23932393 liability insurance company of the law enforcemen t agency that
23942394 employed the peace officer, the chief elected official of the
23952395 governing body of the law enforcement agency and the chief law
23962396 enforcement officer of the law enforcement agency.
23972397 9. For all other violations of this subsection, the hearing
23982398 examiner shall take into consideration the severity of the
23992399 violation, any mitigati ng circumstances offered by the person
24002400 subject to disciplinary action, and any other evidence relevant to
24012401 the person's character to determine the appropriate disciplinary
24022402 action.
24032403 10. a. A police or peace officer may voluntarily surrender
24042404 and relinquish the peace officer certification to
24052405 CLEET. Pursuant to such surrender or relinquishment ,
24062406 the person surrendering the certifica tion shall be
24072407 prohibited from applying to CLEET for rein statement

24672467 c. Any person seeking reinstatement of police or peace
24682468 officer certification which has been suspended,
24692469 revoked, or voluntarily surrendered may apply for
24702470 reinstatement pursuant to promulgated CLEET rules
24712471 governing reinstatement . Except as provided in this
24722472 subsection, any person whose certif ication has been
24732473 revoked, suspended or vo luntarily surrendered for any
24742474 reason including failure to comply with mandatory
24752475 education and training requirements, shall pay a
24762476 reinstatement fee of One Hundred Fifty D ollars
24772477 ($150.00) to be deposited to the credit of the Peace
24782478 Officer Revolving Fund crea ted pursuant to Section
24792479 3311.7 of this title.
24802480 11. A duty is hereby imposed upon the district a ttorney who, on
24812481 behalf of the State of Oklahoma, prosecutes a person hold ing police

25412541 12. Any person or agency required or authorized to subm it
25422542 information pursuant to this section to the Council shall be immune
25432543 from liability arising f rom the submission of the information as
25442544 long as the information was sub mitted in good faith and without
25452545 malice.
25462546 13. Any peace officer employed by a law enforce ment agency in
25472547 this state which has int ernal discipline policies and procedures on
25482548 file with CLEET shall be exempt from the disciplinary proceedings
25492549 and actions provided for in this subsection; provided, however, su ch
25502550 exemption shall not apply if the peace officer has been convicted of
25512551 a felony crime, a crime of moral turpitude, or a crime of domest ic
25522552 violence.
25532553 14. All criminal proceedings initiated against a CLEET -
25542554 certified peace officer or reserve peace officer sh all be reported
25552555 by the officer to CLEET i mmediately after arrest or discovery of the
25562556 filing of such criminal proceeding. All CLEET-certified peace
25572557 officers and reserve peace officers shall be required to r eport when

26142614 15. As used in this subsection:
26152615 a. "law enforcement agenc y" means any department or
26162616 agency of the state, a county, a municipality, or
26172617 political subdivision thereof, with the duties to
26182618 maintain public order, make arrests, and enforce the
26192619 criminal laws of this state or muni cipal ordinances,
26202620 which employs CLEET-certified personnel,
26212621 b. "final order of termination" means a final notice of
26222622 dismissal from employment provided after all
26232623 grievance, arbitration, and court actions have been
26242624 completed, and
26252625 c. "resignation while under i nvestigation" means the
26262626 resignation from employment of a peace officer who is
26272627 under investigation for any felony violation of law, a
26282628 crime of moral turpitude, a crime of domestic
26292629 violence, or the resignation from employment of a
26302630 peace officer as part of an arbitration or plea
26312631 agreement.

26862686 recertified annually so long as the canine is used for such
26872687 detection purposes. The certification test and annua l
26882688 recertification test provisions of this subsection shall not be
26892689 applicable to canines that are own ed by a law enforcement agency and
26902690 that are certified and annually recertified in the detection of
26912691 controlled dangerous substances by the United States Cust oms
26922692 Service. No employee of CLEET may be involved in the training or
26932693 testing of a canine team.
26942694 2. The Council shall appoint a Drug Dog Advisory Council to
26952695 make recommendations c oncerning minimum standards, educational
26962696 needs, and other matters imperative to the certification of canines
26972697 and canine teams trained to detect controlled dangerous substances .
26982698 The Council shall promulgate rules based upon the recommendations of
26992699 the Advisory Council. Members of the Advisory Cou ncil shall
27002700 include, but need not be limited to, a commissioned officer with
27012701 practical knowledge of such canines and canine teams from e ach of
27022702 the following:
27032703 a. the Oklahoma State Bureau of Narcotics and Dangerous
27042704 Drugs Control,
27052705 b. the Department of Public Safety,

27662766 deposited to the credit of the CLEET Fund create d pursuant to
27672767 Section 1313.2 of Title 20 of the Oklahoma Statutes.
27682768 L. 1. Every canine team in the state trained to detect
27692769 explosives, explosive materials, explosive devices, and materials
27702770 which could be used to constru ct an explosive device shall be
27712771 certified, by test, in the detection of such explosives and
27722772 materials and shall be recertified a nnually so long as the canine is
27732773 used for such detection purposes . The certification test and annual
27742774 recertification test provi sions of this subsection shall not b e
27752775 applicable to canines that are owned by a law enforcement agency if
27762776 such canines are certi fied and annually recertified in the detection
27772777 of explosives and materials by the Unite d States Department of
27782778 Defense. No employee of CLEET may be involved in the training or
27792779 testing of a canine team.
27802780 2. The Council shall appoint a Bomb Dog Advisory Cou ncil to
27812781 make recommendations concerning minimum standards, educational

28522852 Section 1313.2 of Title 20 of the Oklahoma Statutes.
28532853 M. All tribal police officers of any Indian tribe or nation who
28542854 have been commissioned by an Oklahoma law enforcement agency
28552855 pursuant to a cross-deputization agreement with the State of
28562856 Oklahoma or any political subdivision of the State of Oklahoma

29082908 pursuant to the provisions of Section 1221 of Title 74 of the
29092909 Oklahoma Statutes shall be eligible for peace officer certification
29102910 under the same terms and condit ions required of members of the law
29112911 enforcement agencies of the State of Oklahoma and its political
29122912 subdivisions. CLEET shall issue peace officer certification to
29132913 tribal police officers who, as of July 1, 2003, are commissioned by
29142914 an Oklahoma law enforcem ent agency pursuant to a cross-deputization
29152915 agreement with the State of Oklahoma or any political subdivision of
29162916 the State of Oklahoma pursuant to the provisions of Section 1221 of
29172917 Title 74 of the Oklahoma Statutes and have met the training and
29182918 qualification requirements of this section.
29192919 N. If an employing law enforcement agency in t his state has
29202920 paid for CLEET training and the salary of a person while that person
29212921 is completing in this state a basic police course approved by the
29222922 Council and if within one ( 1) year after initial employment with the
29232923 original employing agency that person resigns and is hired by
29242924 another law enforcement agency in this state, the second agency or
29252925 the person receiving the training shall reimburse the original
29262926 employing agency for t he cost of CLEET training and salary paid to
29272927 the person while completing the bas ic police course by the original
29282928 employing agency. If the person leaves the original employing
29292929 agency later than one (l) year, but less than two (2) years, after
29302930 the initial employment, the second agency or the perso n receiving
29312931 the training shall reimburs e the original employing agency fifty

29832983 percent (50%) of the cost of CLEET training and salary paid to the
29842984 person while completing the basic police course by the original
29852985 employing agency. CLEET shall not be a party to any court action
29862986 based on this provisi on.
29872987 O. The Council on Law Enforcement Education and Training, in
29882988 its discretion, may waive all or part of any moneys due to the
29892989 Council, if deemed uncollectable by the Council .
29902990 P. Peace officers, reserve peace offic ers, tribal peace
29912991 officers, agencies, b ail enforcers, security guards and private
29922992 investigators shall maintain with the Council current mailing
29932993 addresses and shall notify the Council, in writing, of any change of
29942994 address or name. Notification of change of name shall require
29952995 certified copies of any marriage license or other court document
29962996 which reflects the change of name. Notice of change of address or
29972997 telephone number must be made within ten (10) days of the effec ted
29982998 change. Notices shall not be accepte d over the phone. In any
29992999 proceeding in which the Council is required to serve notice or an
30003000 order on an individual or an agency, the Council may send a letter
30013001 to the mailing address on file with the Council . If the letter is
30023002 returned and a notation of the U.S. Postal Service indicates
30033003 "unclaimed", or "moved", or "refused" or any other nondelivery
30043004 markings and the records of the Council indicate that no change of
30053005 address as required by this subsection has been receiv ed by the

30573057 Council, the notice and any sub sequent notices or orders shall be
30583058 deemed by the Court as having been legally served for all purposes.
30593059 Q. All CLEET records of Bail Enforcers may be released only in
30603060 compliance with this section and th e Bail Enforcement and Licensing
30613061 Act. All records in CLEET possession concerning ot her persons or
30623062 entities shall be released only in compliance with this section and
30633063 the Oklahoma Open Records Act.
30643064 SECTION 2. This act shall become effec tive November 1, 2024.
