6565 An Act relating to office of public defender;
6666 amending 19 O.S. 2021, Section 138.1a, which relates

6868 modifying population requirements; and providing an

7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 19 O.S. 2021, Section 138.1a, is
7777 amended to read as follows :
7878 Section 138.1a A. In each county of this state possessing a
7979 population of over three hundred thousand (300,000) six hundred
8080 thousand (600,000) according to the Federal Decennial Census of 1990
8181 2020, or any succeeding Fe deral Decennial Census, there is hereby
8282 created the office of public defender, and such office shall be
8383 charged upon the order of any judge of a court of record of such
8484 county, with the protection of the rights of any defendant to a
8585 criminal action. The b oard of county commissioners of such cou nty
8686 shall provide for necessary office supplies and equipment and
8787 arrange for sufficient office space in the county building, used by

139139 the courts of record of such county, to permit the efficient and
140140 effective operation of the office of public defender.
141141 B. Subject to available funding, the board of county
142142 commissioners, along with the office of the public defender, shall
143143 provide and coordinate training and continuing legal education for
144144 attorneys employed by the offic e of the public defender. Curriculum
145145 for training required under this section shall include, but not be
146146 limited to:
147147 1. Nationally recognized defense seminars; and
148148 2. Evidence-based practices regarding behavioral health and
149149 treatment of defendants with s ubstance abuse or mental health needs.
150150 C. For purposes of liability under the Governmental Tort Claims
151151 Act, any public defender, assistant public defender or employee
152152 thereof, who is employed under this section shall be deemed a state
153153 employee.
154154 SECTION 2. This act shall become effective November 1, 2024.
