66	66	amending 19 O.S. 2021, Section 138.1a, which relates
67	67	to the creation of office of public defender;
68	68	modifying population requirements; and providing an
69	69	effective date.

75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 19 O.S. 2021, Section 138.1a, is
77	77	amended to read as follows :
78	78	Section 138.1a A. In each county of this state possessing a
79	79	population of over three hundred thousand (300,000) six hundred
80	80	thousand (600,000) according to the Federal Decennial Census of 1990
81	81	2020, or any succeeding Fe deral Decennial Census, there is hereby
82	82	created the office of public defender, and such office shall be
83	83	charged upon the order of any judge of a court of record of such
84	84	county, with the protection of the rights of any defendant to a
85	85	criminal action. The b oard of county commissioners of such cou nty
86	86	shall provide for necessary office supplies and equipment and
87	87	arrange for sufficient office space in the county building, used by

139	139	the courts of record of such county, to permit the efficient and
140	140	effective operation of the office of public defender.
141	141	B. Subject to available funding, the board of county
142	142	commissioners, along with the office of the public defender, shall
143	143	provide and coordinate training and continuing legal education for
144	144	attorneys employed by the offic e of the public defender. Curriculum
145	145	for training required under this section shall include, but not be
146	146	limited to:
147	147	1. Nationally recognized defense seminars; and
148	148	2. Evidence-based practices regarding behavioral health and
149	149	treatment of defendants with s ubstance abuse or mental health needs.
150	150	C. For purposes of liability under the Governmental Tort Claims
151	151	Act, any public defender, assistant public defender or employee
152	152	thereof, who is employed under this section shall be deemed a state
153	153	employee.
154	154	SECTION 2. This act shall become effective November 1, 2024.
