7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 70 O.S. 2021, Section 5 -142, is
8181 amended to read as follows:
8282 Section 5-142. A. Except as otherwise provided for in
8383 subsection F of this section, for purposes of employment, a board of
8484 education may request in writing to the State Board of Education
8585 that a national criminal history record check be conducted of any
8686 employee of the school and shall request such inform ation for any
8787 person seeking employment with the school; provided that a board of
8888 education shall not be required to obtain a new criminal h istory
8989 record check for an individual who has obtained certification from

141141 the State Department of Education within t he previous twelve (12)
142142 months. The State Department of Education shall not be required to
143143 obtain fingerprints of an employee or prospective employee of the
144144 Department if that person's fingerprints are a lready on file for
145145 other state education certification or state education employment
146146 processes. The Oklahoma State Bureau of Investigation (OSBI) shall
147147 obtain fingerprints of the employee or prospective employee and
148148 require that the person pay a search fee not to exceed Fifty Dollars
149149 ($50.00) or the cost o f the search, whichever is the lesser amount .
150150 The fee shall be deposited in the OSBI Revolving Fund. School
151151 districts may reimburse employees for the cost of the search. The
152152 State Board of Education shal l contact the Oklahoma State Bureau of
153153 Investigation for any national criminal history record check of the
154154 person within fourteen (14) working days of receiving a written
155155 request from the board of education.
156156 B. The Oklahoma State Bureau of Investigation shall p rovide the
157157 national criminal history record c heck requested by the State Board
158158 of Education within fourteen (14) working days from the receipt of
159159 the request. The Bureau may contact the Federal Bureau of
160160 Investigation to obtain the information requested.
161161 C. The State Board of Education shall provid e the information
162162 received from the Oklahoma State Bureau of Investigation to the
163163 board of education within fourteen (14) days from the receipt of the
164164 information. The State Board of Education shall provide any follow-

217217 a national criminal history record check was requested to the
218218 employing board of education.
219219 D. For the purpose of this sectio n:
220220 1. "Board of education" includes both public and p rivate boards
221221 of education within or outside this state;
222222 2. "Employing agency" means a political subdivision or law
223223 enforcement agency in this state;
224224 3. "Law enforcement officer " means a peace or poli ce officer
225225 who is certified by the Council on Law Enfo rcement Education and
226226 Training;
227227 4. "National criminal history record check " means a national
228228 criminal history record check as defined in Section 150.9 of Title
229229 74 of the Oklahoma Statutes; and
230230 5. "Prospective employee" means an individual who has receive d
231231 an offer of temporary employment from a sch ool district pending the
232232 results of the national criminal history record check.
233233 E. Each public board of education within this state shall
234234 promulgate a statement regarding the felony record search policy for
235235 that school district. The policy may permit tem porary employment of
236236 prospective employees for a maximum of sixty (60) days pending
237237 receipt of results of national criminal history record check
238238 requests. The temporary employment of the prospective employee
239239 shall terminate after sixty (60) days unless th e school district

291291 receives the results of the national criminal history record check.
292292 The sixty-day temporary employment period shall begin on the first
293293 day the prospective employee reports for duty at the empl oying
294294 school district. Prospective employees shall be notified of the
295295 requirement, the fee and the reimbursement policy when first
296296 interviewed concerning employment. The school district 's
297297 reimbursement policy shall provide, at a minimum, that employees
298298 shall be promptly reimbursed in full for the f ee if employed by the
299299 district at the time the national criminal history record check
300300 request is made unless the person was employed pending receipt of
301301 results as set forth above.
302302 F. 1. Any person who has been employed as a full-time teacher
303303 by a school district in this state and applies for employment as a
304304 full-time teacher in another school district in this state may not
305305 be required to have a obtained an Oklahoma criminal history record
306306 check from the OSBI or national criminal history record check for
307307 certification, as required by Section 6 -190 of this title, or for
308308 employment with a school, as required by this section , in the
309309 immediately preceding five (5) years shall be exempt from any
310310 additional Oklahoma criminal history record check from the OSBI or
311311 national criminal history record check if the teacher produces a
312312 copy of a national criminal history record check completed within
313313 the preceding five (5) years and a letter from the school district

365365 in which the teacher was employed stating the teacher left in good
366366 standing required for those same purposes.
367367 2. For any person applying for employment as a substitute
368368 teacher, a national criminal history record check shall be required
369369 for the school year; provided, however, a board of education may
370370 choose whether to require a national criminal history reco rd check
371371 from a prospective substitute teacher who has been employed by the
372372 school district in the last year. Any person applying for
373373 employment as a substitute teacher in more than one school district
374374 shall only be required to have one national criminal history record
375375 check, and, upon the request of the substitute teacher, that record
376376 check shall be sent to all other school districts in which the
377377 substitute teacher is appl ying to teach.
378378 3. Any person employed as a full-time teacher by a school
379379 district in this state in the five (5) years immediately preceding
380380 an application for employment as a substitute teacher may not be
381381 required to have a national criminal history recor d check, if the
382382 teacher produces a cop y of a national criminal history record check
383383 completed within the preceding five (5) years and a letter from the
384384 school district in which the teacher was last employed stating the
385385 teacher left in good standing.
386386 4. Any person employed as a substitute teac her by a school
387387 district in this state for a m inimum of five (5) years immediately
388388 preceding an application for employment as a full -time teacher in a

440440 school district in this state may not be required to have a nationa l
441441 criminal history record check if the teacher produces a copy of a
442442 national criminal history record check completed within the
443443 preceding five (5) years and a letter from the school district in
444444 which the teacher was employed as a substitute teacher stating the
445445 teacher left in good standing.
446446 5. Any person employed as a full-time teacher by a school
447447 district in this state for ten (10) or more consecutive years
448448 immediately preceding an application for employment as a substitute
449449 teacher in the same school dist rict may not be required to have a
450450 national criminal history record check for as lon g as the person
451451 remains employed for consecutive years by that school district as a
452452 substitute teacher, if the teacher left full -time employment in good
453453 standing. If the teacher applies for employment as a sub stitute
454454 teacher in another school district, a national criminal history
455455 record check shall be required.
456456 G. 1. Except as otherwise provided by this subsection, any
457457 teacher employed by an Oklahoma school district prior to the
458458 effective date of this act who does not have an Oklahoma criminal
459459 history record check from the Oklahoma State Bureau of Investigation
460460 as well as a national criminal history record check, as defined in
461461 Section 150.9 of Title 74 of the Oklahoma Stat utes, on file with his
462462 or her employing district as required by this section shall c omplete
463463 the criminal history record checks upon the next renewal of his or

518518 2. Except as otherwise provid ed by this subsection, any other
519519 person employed by an Oklahoma school district prior to the
520520 effective date of this act who does not have an Oklahoma criminal
521521 history record check from the Oklahoma State Bureau o f Investigation
522522 as well as a national crimin al history record check, as defined in
523523 Section 150.9 of Title 74 of the Oklahoma Statutes, on file with his
524524 or her employing district as required by this section shall have
525525 until July 1, 2022, to complete the cri minal history record checks.
526526 3. Any teacher eligible to retire from the Teachers ' Retirement
527527 System of Oklahoma who does not have an Oklahoma criminal history
528528 record check from the Oklahoma State Bureau of Investigati on as well
529529 as a national criminal hist ory record check, as defined in Section
530530 150.9 of Title 74 of the Oklahoma Statutes, on file with his or her
531531 employing district as required by this section shall complete the
532532 criminal history record checks by the earlie r of the following
533533 dates:
534534 a. July 1, 2022, or
535535 b. at the next renewal of his or her Standard Teaching
536536 Certificate as required by Section 6 -154.1 of this
537537 title or State Board of Education administrative rules

590590 H. The provisions of this s ection shall not apply to technology
591591 center employees hired on a part-time or temporary basis for the
592592 instruction of adult students only.
593593 I. The provisions of this section shall not apply to law
594594 enforcement officers who are employed by an employing agency at the
595595 time of application for employ ment at a public school district.
596596 J. Nothing in this section shall be construed to impose
597597 liability on school districts, except in negligence, for employing
598598 prospective employees within the sixty -day temporary employm ent
599599 window pending the results of the national criminal history record
600600 check.
601601 SECTION 2. This act shall become effective July 1, 2024.
602602 SECTION 3. It being immediately necessary for the preservation
603603 of the public peace, hea lth or safety, an emergency is hereby
604604 declared to exist, by reason whereof thi s act shall take effect and
605605 be in full force from and after its passage and approval.
