107203 2. "Public body" shall incl ude, but not be limited to, any
108204 office, department, board, bureau, commission, agency, trusteeship,
109205 authority, council, committee, trust or any entity created by a
110206 trust, county, city, village, town, township, district, school
111207 district, fair board, court, executive office, advisory group, task
112208 force, study group or any subdivision thereof, supported in whole or
113209 in part by public funds or entrusted with the expenditure of public
114210 funds or administering or operating public property, and all
115211 committees, or subcommittees thereof. Except for the records
116212 required by Section 24A.4 of this title, public body does not mean
117213 judges, justices, the Council on Judicial Complaints, the
118214 Legislature or legislators. Public body shall not include an
119215 organization that is exemp t from federal income tax under Section
120216 501(c)(3) of the Internal Revenue Code of 1986, as amended, and
121217 whose sole beneficiary is a college or university , or an affiliated
122218 entity of the college or university, that is a member of The
123219 Oklahoma State System o f Higher Education. Such organization shall

149266 Beverage Laws Enforcement Commission, and the Oklahoma State Bureau

272501 3. Any reasonably segregable portion of a record c ontaining
273502 exempt material shall be provided after deletion of the exempt
274503 portions; provided however, the Department of Public Safety shall
275504 not be required to assemble for the requesting person specific
276505 information, in any format, from driving records relating to any
277506 person whose name and date of birth or whose driver license number
278507 is not furnished by the requesting person.

280508 The Oklahoma State Bureau of Investigation shall not be required
281509 to assemble for the requesting person any criminal history records
282510 relating to persons whose names, dates of birth, and other
283511 identifying information required by the Oklahoma State Bureau of
284512 Investigation pursuant to administrative rule are not furnished by
285513 the requesting person;

287514 4. Any request for a record which contains individual records
288515 of persons, and the cost of copying, reproducing or certifying each
289516 individual record is otherwise prescribed by st ate law, the cost may
290517 be assessed for each individual record, or portion thereof requested
291518 as prescribed by state law. Oth erwise, a public body may charge a
292519 fee only for recovery of the reasonable, direct costs of record
293520 copying, or mechanical reproductio n. Notwithstanding any state or
294521 local provision to the contrary, in no instance shall the record
295522 copying fee exceed twenty -five cents ($0.25) per page for records
296523 having the dimensions of eight and one -half (8 1/2) by fourteen (14)

297551 inches or smaller, or a maximum of One Dollar ($1.00) per copied
298552 page for a certified copy. However, if the request:

300553 a. is solely for commercial purpose, or

302554 b. would clearly cause excessive disruption of the
303555 essential functions of the public body,

305556 then the public body may charg e a reasonable fee to recover the
306557 direct cost of record search and copying; however, publication in a
307558 newspaper or broadcast by news media for news purposes shall not
308559 constitute a resale or use of a record for trade or commercial
309560 purpose and charges for pr oviding copies of electronic data to the
310561 news media for a news purpose shall not exceed the direct cost of
311562 making the copy. The fee charged by the Department of Public Safety
312563 for a copy in a computerized format of a record of the Department
313564 shall not exceed the direct cost of making the copy unless the fee
314565 for the record is otherwise set by law.

316566 Any public body establishing fees under this act shall post a
317567 written schedule of the fees at its principal office and with the
318568 county clerk.

320569 In no case shall a se arch fee be charged when the release of
321570 records is in the public interest, including, but not limited to,
322571 release to the news media, scholars, authors and taxpayers seeking
323572 to determine whether those entrusted with the affairs of the
324573 government are honestl y, faithfully, and competently performing

327602 The fees shall not be used for the purpose of discouraging
328603 requests for information or as obstacles to disclosure of requested
329604 information;

331605 5. The land description tract index of a ll recorded instruments
332606 concerning real property required to be kept by the county clerk of
333607 any county shall be available f or inspection or copying in
334608 accordance with the provisions of the Oklahoma Open Records Act;
335609 provided, however, the index shall not b e copied or mechanically
336610 reproduced for the purpose of sale of the information;

338611 6. A public body must provide prompt, reasonable access to its
339612 records but may establish reasonable procedures which protect the
340613 integrity and organization of its records and to prevent excessive
341614 disruptions of its essential functions. A delay in providing access
342615 to records shall be limited solel y to the time required for
343616 preparing the requested documents and the avoidance of excessive
344617 disruptions of the public body's essentia l functions. In no event
345618 may production of a current request for records be unreasonably
346619 delayed until after completion of a prior records request that will
347620 take substantially longer than the current request. Any public body
348621 which makes the requested rec ords available on the Internet shall
349622 meet the obligation of providing prompt, reasonable access to its
350623 records as required by this paragraph; and

352624 7. A public body shall designate certain persons who are
353625 authorized to release records of the public body for inspection,

355654 available at all times to release records during the regular
356655 business hours of the public body.

358656 SECTION 3. AMENDATORY 51 O.S. 2021, Section 24A.17, is
359657 amended to read as follows:

361658 Section 24A.17 A. Any public official who willfully violates
362659 any provision of the Oklahoma O pen Records Act, upon conviction,
363660 shall be guilty of a misdemeanor, and shall be punished by a fine
364661 not exceeding Five Hundred Dollar s ($500.00) or by imprisonment in
365662 the county jail for a period not exceeding one (1) year, or by both
366663 such fine and imprisonment.

368664 B. Any person who requests and is denied access to records of a
369665 public body or public official:
370-
371666 1. May bring a civil suit fo r declarative or injunctive relief,
372667 or both, but such civil suit shall be limited to records requested
373668 and denied prior to filing of the civil suit; and
374-
375669 2. If successful, shall be entitled to reasonable attorney
376670 fees.

378671 C. Prior to bringing a civil suit un der subsection B of this
379672 section, any person seeking declaratory or injunctive relief, or
380673 both, must notify the public body or public official of his or her
381674 intent to bring a civil suit to obtain relief in writing ten (10)
382675 business days prior to filing for such relief. Such notice must
383676 also be provided to the Attorney General.

385704 D. If the public body or public official success fully defends a
386705 civil suit and the court finds that the suit was clearly frivolous,
387706 the public body or public official shall be entit led to reasonable
388707 attorney fees.

390708 D. E. A public body or public official shall not be civilly
391709 liable for damages for providing access to records as allowed under
392710 the Oklahoma Open Records Act.

394711 SECTION 4. This act shall become effective Nov ember 1, 2024.
