28	58		SECTION 1. AMENDATORY 51 O.S. 2021, Section 24A. 3, as
29	59		last amended by Section 11, Chapter 271, O.S.L. 2023 (51 O.S. Supp.
30	60		2023, Section 24A.3), is amended to read as follows:

32	61		Section 24A.3 As used in the Oklahoma Open Records Act:

34	62		1. "Record" means all documents including, but not limited to,
35	63		any book, paper, photograph, microfilm, data files created by or
36	64		used with computer software, computer tape, disk, record, sound
37	65		recording, film recording, video record or other material regardless
38	66		of physical form or characteristic, created by, received by, under

107	203		2. "Public body" shall incl ude, but not be limited to, any
108	204		office, department, board, bureau, commission, agency, trusteeship,
109	205		authority, council, committee, trust or any entity created by a
110	206		trust, county, city, village, town, township, district, school
111	207		district, fair board, court, executive office, advisory group, task
112	208		force, study group or any subdivision thereof, supported in whole or
113	209		in part by public funds or entrusted with the expenditure of public
114	210		funds or administering or operating public property, and all
115	211		committees, or subcommittees thereof. Except for the records
116	212		required by Section 24A.4 of this title, public body does not mean
117	213		judges, justices, the Council on Judicial Complaints, the
118	214		Legislature or legislators. Public body shall not include an
119	215		organization that is exemp t from federal income tax under Section
120	216		501(c)(3) of the Internal Revenue Code of 1986, as amended, and
121	217		whose sole beneficiary is a college or university , or an affiliated
122	218		entity of the college or university, that is a member of The
123	219		Oklahoma State System o f Higher Education. Such organization shall

125	248		The following persons shall not be eligible to serve as a voting
126	249		member of the governing board of the organization:

128	250		a. a member, officer, or empl oyee of the Oklahoma State

131	252		b. a member of the board of regents or other governing
132	253		board of the college or university that is the sole
133	254		beneficiary of the organization, or

145	262		enforcing state or local criminal laws and initiating criminal
146	263		prosecutions including, but not limited to, police departments,
147	264		county sheriffs, the Department of Public Safety, the Oklahoma State
148	265		Bureau of Narcotics and Dangerous Drugs Control, the Alcoholic
149	266		Beverage Laws Enforcement Commission, and the Oklahoma State Bureau
150	267		of Investigation.

272	501		3. Any reasonably segregable portion of a record c ontaining
273	502		exempt material shall be provided after deletion of the exempt
274	503		portions; provided however, the Department of Public Safety shall
275	504		not be required to assemble for the requesting person specific
276	505		information, in any format, from driving records relating to any
277	506		person whose name and date of birth or whose driver license number
278	507		is not furnished by the requesting person.

280	508		The Oklahoma State Bureau of Investigation shall not be required
281	509		to assemble for the requesting person any criminal history records
282	510		relating to persons whose names, dates of birth, and other
283	511		identifying information required by the Oklahoma State Bureau of
284	512		Investigation pursuant to administrative rule are not furnished by
285	513		the requesting person;

287	514		4. Any request for a record which contains individual records
288	515		of persons, and the cost of copying, reproducing or certifying each
289	516		individual record is otherwise prescribed by st ate law, the cost may
290	517		be assessed for each individual record, or portion thereof requested
291	518		as prescribed by state law. Oth erwise, a public body may charge a
292	519		fee only for recovery of the reasonable, direct costs of record
293	520		copying, or mechanical reproductio n. Notwithstanding any state or
294	521		local provision to the contrary, in no instance shall the record
295	522		copying fee exceed twenty -five cents ($0.25) per page for records
296	523		having the dimensions of eight and one -half (8 1/2) by fourteen (14)

305	556		then the public body may charg e a reasonable fee to recover the
306	557		direct cost of record search and copying; however, publication in a
307	558		newspaper or broadcast by news media for news purposes shall not
308	559		constitute a resale or use of a record for trade or commercial
309	560		purpose and charges for pr oviding copies of electronic data to the
310	561		news media for a news purpose shall not exceed the direct cost of
311	562		making the copy. The fee charged by the Department of Public Safety
312	563		for a copy in a computerized format of a record of the Department
313	564		shall not exceed the direct cost of making the copy unless the fee
314	565		for the record is otherwise set by law.

316	566		Any public body establishing fees under this act shall post a
317	567		written schedule of the fees at its principal office and with the
318	568		county clerk.

320	569		In no case shall a se arch fee be charged when the release of
321	570		records is in the public interest, including, but not limited to,
322	571		release to the news media, scholars, authors and taxpayers seeking
323	572		to determine whether those entrusted with the affairs of the
324	573		government are honestl y, faithfully, and competently performing
325	574		their duties as public servants.

327	602		The fees shall not be used for the purpose of discouraging
328	603		requests for information or as obstacles to disclosure of requested

331	605		5. The land description tract index of a ll recorded instruments
332	606		concerning real property required to be kept by the county clerk of
333	607		any county shall be available f or inspection or copying in
334	608		accordance with the provisions of the Oklahoma Open Records Act;
335	609		provided, however, the index shall not b e copied or mechanically
336	610		reproduced for the purpose of sale of the information;
337		-
338	611		6. A public body must provide prompt, reasonable access to its
339	612		records but may establish reasonable procedures which protect the
340	613		integrity and organization of its records and to prevent excessive
341	614		disruptions of its essential functions. A delay in providing access
342	615		to records shall be limited solel y to the time required for
343	616		preparing the requested documents and the avoidance of excessive
344	617		disruptions of the public body's essentia l functions. In no event
345	618		may production of a current request for records be unreasonably
346	619		delayed until after completion of a prior records request that will
347	620		take substantially longer than the current request. Any public body
348	621		which makes the requested rec ords available on the Internet shall
349	622		meet the obligation of providing prompt, reasonable access to its
350	623		records as required by this paragraph; and

352	624		7. A public body shall designate certain persons who are
353	625		authorized to release records of the public body for inspection,

358	656		SECTION 3. AMENDATORY 51 O.S. 2021, Section 24A.17, is
359	657		amended to read as follows:

361	658		Section 24A.17 A. Any public official who willfully violates
362	659		any provision of the Oklahoma O pen Records Act, upon conviction,
363	660		shall be guilty of a misdemeanor, and shall be punished by a fine
364	661		not exceeding Five Hundred Dollar s ($500.00) or by imprisonment in
365	662		the county jail for a period not exceeding one (1) year, or by both
366	663		such fine and imprisonment.

368	664		B. Any person who requests and is denied access to records of a
369	665		public body or public official:
370		-
371	666		1. May bring a civil suit fo r declarative or injunctive relief,
372	667		or both, but such civil suit shall be limited to records requested
373	668		and denied prior to filing of the civil suit; and
374		-
375	669		2. If successful, shall be entitled to reasonable attorney
376	670		fees.

378	671		C. Prior to bringing a civil suit un der subsection B of this
