75	75	BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new secti on of law to be codified
77	77	in the Oklahoma Statutes as Section 365 of Title 40, unless there is
78	78	created a duplication in numbering, r eads as follows:
79	79	A. There is hereby created until May 31, 2025, the Rethinking
80	80	Paying Subminimal Wage to P ersons with Disabilities Task Force.
81	81	B. The Task Force shall study and develop a plan to phase out
82	82	the practice of paying workers with disabilities subminimum wages
83	83	under 14(c) certificate programs in Oklahoma. The Task Force sh all
84	84	study, review, and make recommendations on the following, with a
85	85	focus on transitioning workers with disabilities currently being
86	86	paid subminimum wages under 14(c) certificates to competitive,
87	87	integrated employment at or above minimum wage , and when

140	140	or wanting to move to competitive, integrated employment :
141	141	1. Identify potential obstacles and negative impacts of phasing
142	142	out subminimum wages and 14(c) use in Oklahoma; and
143	143	2. Develop a plan for phasing out subminimum wages and 14(c)
144	144	use in Oklahoma that:
145	145	a. reduces potential negative impacts and maximizes the
146	146	potential for successful transition to competitive,
147	147	integrated employment,
148	148	b. includes alternative meaningful day programs for those
149	149	individuals who do not wish to transition to
150	150	competitive, integrated employment or for those for
151	151	whom it is not appropriate, and
152	152	c. establishes an appro priate timeline for phasing out
153	153	subminimum wages.
154	154	C. The Task Force shall consist of twenty (20) members as
155	155	follows:
156	156	1. The Director of the Department of Human Services
157	157	Developmental Disabilities S ervices Division or his or her designee;
158	158	2. The Director of the Oklahoma Department of Reh abilitation
159	159	Services or his or her designee;
160	160	3. The Secretary of Commerce and Workforce Development ;
161	161	4. The State Purchasing Director;

223	223	10. A director of a sheltered workshop program with an active
224	224	14(c) certificate, appointed by the Governor ;
225	225	11. A director of a program who previously held a 14 (c)
226	226	certificate and successfully transitioned to community integrated
227	227	employment, appointed by the Speaker of the House of
228	228	Representatives;
229	229	12. A representative of the federally funde d protection and
230	230	advocacy system for Oklahoma known as the Oklahoma Disability Law
231	231	Center, appointed by the President Pro Tempore of the Senate ;
232	232	13. A self-advocate who is currently enrolled or was previously
233	233	employed at subminimum wage , appointed by the Board of the Oklahoma
234	234	Developmental Disabilitie s Council;

288	288	the Board of the Oklahoma Developmental Disabilities Council.
289	289	15. A parent or family member of a person with a disability who
290	290	is currently enrolled or was previously employed at subminimum wage ,
291	291	appointed by the Speaker of the House of Repres entatives;
292	292	16. A parent or family member of a person with a disability who
293	293	has successfully transitioned from subminimum wage to competitive,
294	294	integrated employment , appointed by the President Pro Tempore of the
295	295	Senate;
296	296	17. A private employer who employs individuals with
297	297	disabilities, appointed by the Governor;
298	298	18. A representative of the Oklaho ma state chapter of the
299	299	Association of People Supporting Employment First, appointed by the
300	300	Governor;
301	301	19. The Director for Learning and Leadership/University Center
302	302	for Excellence in Developmental Disabilities; and
303	303	20. A director of an agency specializing in employment services
304	304	for the blind, appointed by the Speaker of the House of
305	305	Representatives.
306	306	D. The member of the House of Repres entatives and the member of
307	307	the Senate shall serve as co-chairs of the Task Force. Appoint ments
308	308	to the Task Force shall be made within thirty (30) days after the
309	309	effective date of this act. Meetings of t he Task Force shall be

361	361	held at the call of either c o-chair of the Task Force. Members
362	362	shall serve at the pleasure of their appointing authori ties. A
363	363	majority of the members of the Task Force sh all constitute a quorum
364	364	to transact business, but no vacancy s hall impair the right of the
365	365	remaining members to exercise all of the powers of the Task Force.
366	366	Except as otherwise provided, a vacancy on t he Task Force shall be
367	367	filled by the original appoint ing authority. If the original
368	368	appointing authority fails to make an appointment within thirty (30)
369	369	days after the effective date of this act, a majority of the members
370	370	of the Task Force who have been a ppointed may fill the vacancy to
371	371	the open position. Staff support for the Task Force shall be
372	372	provided by the staff of the Oklahoma House of Representatives and
373	373	the Oklahoma State Senate. The Oklahoma Departme nt of Career and
374	374	Technology Education, Oklah oma State Regents for Higher Education,
375	375	Office of Disability Concerns, Oklahoma Department of Rehabilitation
376	376	Services, Oklahoma Health Care Authority, Department of H uman
377	377	Services, and the State Use Committee of the Office of Management
378	378	and Enterprise Services shall provide support and information as
379	379	requested by the Task Force.
380	380	E. Members of the Task Force shall receive no compensation for
381	381	serving on the Task Force, but may receive travel reimbursement,
382	382	contingent on the availability of private funds for this purpose.
383	383	F. The Task Force may seek the assistance of the Legislative
384	384	Service Bureau or the State Board of Education to contract with an

437	437	in this section, contingent on the availabili ty of funds.
438	438	G. The Task Force shall submit a final report by January 1,
439	439	2025, to the Governor, the President Pro Tempore of the Senate, and
440	440	the Speaker of the House of Representatives.
441	441	SECTION 2. This act shall become effective November 1, 2024.
