7575 BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new secti on of law to be codified
7777 in the Oklahoma Statutes as Section 365 of Title 40, unless there is
7878 created a duplication in numbering, r eads as follows:
7979 A. There is hereby created until May 31, 2025, the Rethinking
8080 Paying Subminimal Wage to P ersons with Disabilities Task Force.
8181 B. The Task Force shall study and develop a plan to phase out
8282 the practice of paying workers with disabilities subminimum wages
8383 under 14(c) certificate programs in Oklahoma. The Task Force sh all
8484 study, review, and make recommendations on the following, with a
8585 focus on transitioning workers with disabilities currently being
8686 paid subminimum wages under 14(c) certificates to competitive,
8787 integrated employment at or above minimum wage , and when

139139 appropriate, alternative meaningful day progra ms for those not able
140140 or wanting to move to competitive, integrated employment :
141141 1. Identify potential obstacles and negative impacts of phasing
142142 out subminimum wages and 14(c) use in Oklahoma; and
143143 2. Develop a plan for phasing out subminimum wages and 14(c)
144144 use in Oklahoma that:
145145 a. reduces potential negative impacts and maximizes the
146146 potential for successful transition to competitive,
147147 integrated employment,
148148 b. includes alternative meaningful day programs for those
149149 individuals who do not wish to transition to
150150 competitive, integrated employment or for those for
151151 whom it is not appropriate, and
152152 c. establishes an appro priate timeline for phasing out
153153 subminimum wages.
154154 C. The Task Force shall consist of twenty (20) members as
155155 follows:
156156 1. The Director of the Department of Human Services
157157 Developmental Disabilities S ervices Division or his or her designee;
158158 2. The Director of the Oklahoma Department of Reh abilitation
159159 Services or his or her designee;
160160 3. The Secretary of Commerce and Workforce Development ;

221221 9. A representative of Oklahoma Community-Based Providers,
222222 appointed by the Governor;
223223 10. A director of a sheltered workshop program with an active
224224 14(c) certificate, appointed by the Governor ;
225225 11. A director of a program who previously held a 14 (c)
226226 certificate and successfully transitioned to community integrated
227227 employment, appointed by the Speaker of the House of
228228 Representatives;
229229 12. A representative of the federally funde d protection and
230230 advocacy system for Oklahoma known as the Oklahoma Disability Law
231231 Center, appointed by the President Pro Tempore of the Senate ;
232232 13. A self-advocate who is currently enrolled or was previously
233233 employed at subminimum wage , appointed by the Board of the Oklahoma
234234 Developmental Disabilitie s Council;

286286 14. A self-advocate who has successfully transitioned from
287287 subminimum wage to competitive, integrated employment, appointed by
288288 the Board of the Oklahoma Developmental Disabilities Council.
289289 15. A parent or family member of a person with a disability who
290290 is currently enrolled or was previously employed at subminimum wage ,
291291 appointed by the Speaker of the House of Repres entatives;
292292 16. A parent or family member of a person with a disability who
293293 has successfully transitioned from subminimum wage to competitive,
294294 integrated employment , appointed by the President Pro Tempore of the
295295 Senate;
296296 17. A private employer who employs individuals with
297297 disabilities, appointed by the Governor;
298298 18. A representative of the Oklaho ma state chapter of the
299299 Association of People Supporting Employment First, appointed by the
300300 Governor;
301301 19. The Director for Learning and Leadership/University Center
302302 for Excellence in Developmental Disabilities; and
303303 20. A director of an agency specializing in employment services
304304 for the blind, appointed by the Speaker of the House of
305305 Representatives.
306306 D. The member of the House of Repres entatives and the member of
307307 the Senate shall serve as co-chairs of the Task Force. Appoint ments
308308 to the Task Force shall be made within thirty (30) days after the
309309 effective date of this act. Meetings of t he Task Force shall be

361361 held at the call of either c o-chair of the Task Force. Members
362362 shall serve at the pleasure of their appointing authori ties. A
363363 majority of the members of the Task Force sh all constitute a quorum
364364 to transact business, but no vacancy s hall impair the right of the
365365 remaining members to exercise all of the powers of the Task Force.
366366 Except as otherwise provided, a vacancy on t he Task Force shall be
367367 filled by the original appoint ing authority. If the original
368368 appointing authority fails to make an appointment within thirty (30)
369369 days after the effective date of this act, a majority of the members
370370 of the Task Force who have been a ppointed may fill the vacancy to
371371 the open position. Staff support for the Task Force shall be
372372 provided by the staff of the Oklahoma House of Representatives and
373373 the Oklahoma State Senate. The Oklahoma Departme nt of Career and
374374 Technology Education, Oklah oma State Regents for Higher Education,
375375 Office of Disability Concerns, Oklahoma Department of Rehabilitation
376376 Services, Oklahoma Health Care Authority, Department of H uman
377377 Services, and the State Use Committee of the Office of Management
378378 and Enterprise Services shall provide support and information as
379379 requested by the Task Force.
380380 E. Members of the Task Force shall receive no compensation for
381381 serving on the Task Force, but may receive travel reimbursement,
382382 contingent on the availability of private funds for this purpose.
383383 F. The Task Force may seek the assistance of the Legislative
384384 Service Bureau or the State Board of Education to contract with an

436436 independent consultant as necessary to fulfill the duties specified
437437 in this section, contingent on the availabili ty of funds.
438438 G. The Task Force shall submit a final report by January 1,
439439 2025, to the Governor, the President Pro Tempore of the Senate, and
440440 the Speaker of the House of Representatives.
441441 SECTION 2. This act shall become effective November 1, 2024.
