7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 70 O.S. 2021, Section 24 -158, as
8181 amended by Section 2, Chapter 281, O.S.L. 2022 (70 O.S. Supp. 2023,
8282 Section 24-158), is amended to read as follows:
8383 Section 24-158. A. The "Oklahoma Prevention Needs Assessment
8484 Survey" means the biennial mental health prevention survey o f public
8585 school students in grades six, eight, ten , and twelve managed by the
8686 Department of Mental Health and Substance Abuse Services.
8787 B. Beginning in the 2022 -2023 school year, and biennial ly
8888 thereafter, public schools shall may administer the Oklahoma
8989 Prevention Needs Assessment Survey, or an alternative survey as

141141 provided in subsection D of this section, for the purpose of
142142 providing direction to schools, school di stricts, and communities to
143143 effectively improve the lives of students regarding a variety of
144144 issues with a focus on alcohol, tobacco, other drug use, mental
145145 health, academic failure, and violence.
146146 C. The Department of Mental Health and Substance Abuse Ser vices
147147 shall maintain the Oklahoma Prevention Needs Assessment Survey and
148148 shall provide technic al assistance for schools in survey
149149 administration, reporting, planning , and development of school
150150 mental health prevention and intervention strategies informed b y the
151151 survey results.
152152 D. If a school or school district chooses to administer an
153153 alternative survey or assessment tool to fulfill the purpose
154154 described in subsection B of this section, it may apply for a waiver
155155 through the Department of Mental Health and Substance Abuse
156156 Services.
157157 E. The school district superintendent or his or her designee
158158 shall provide prior written notification to the parents or legal
159159 guardians of students to be administered who have the option to
160160 participate in the Oklahoma Prevention Needs Assessment Survey or an
161161 alternative survey or assessment tool adopted pu rsuant to subsection
162162 D of this section. The notification shall include a copy of the
163163 survey or assessment tool and information to parents and legal
164164 guardians that they may opt allow their student out of to

216216 participate in the survey or assessment tool by providing written
217217 notice permission to the school district.
218218 F. Prior to the biennial administration of the Oklahoma
219219 Prevention Needs Assessment Survey, the Department of Mental H ealth
220220 and Substance Abuse Services shall submit the survey to the
221221 President Pro Tempore of the Oklahoma State Senate, the Speaker of
222222 the Oklahoma House of Representative s, the chairs of the committees
223223 with responsibility over common ed ucation in both houses of the
224224 Legislature, and the chairs of the committees with responsibility
225225 over public health in both houses of the Legisla ture.
226226 G. The provisions of this section shall be subject to the
227227 availability of federal funding . If federal funding is insufficient
228228 to provide the Oklahoma P revention Needs Assessment Survey to public
229229 schools on a biennial basis, administration of the s urvey shall not
230230 be required.
231231 H. The Board of Mental Health and Substance Abuse Services and
232232 the State Board of Education may promulgate rules as necessary to
233233 carry out the provisions of this section.
234234 SECTION 2. This act shall become effective November 1, 2024.
