79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 70 O.S. 2021, Section 24 -158, as
81	81	amended by Section 2, Chapter 281, O.S.L. 2022 (70 O.S. Supp. 2023,
82	82	Section 24-158), is amended to read as follows:
83	83	Section 24-158. A. The "Oklahoma Prevention Needs Assessment
84	84	Survey" means the biennial mental health prevention survey o f public
85	85	school students in grades six, eight, ten , and twelve managed by the
86	86	Department of Mental Health and Substance Abuse Services.
87	87	B. Beginning in the 2022 -2023 school year, and biennial ly
88	88	thereafter, public schools shall may administer the Oklahoma
89	89	Prevention Needs Assessment Survey, or an alternative survey as

142	142	providing direction to schools, school di stricts, and communities to
143	143	effectively improve the lives of students regarding a variety of
144	144	issues with a focus on alcohol, tobacco, other drug use, mental
145	145	health, academic failure, and violence.
146	146	C. The Department of Mental Health and Substance Abuse Ser vices
147	147	shall maintain the Oklahoma Prevention Needs Assessment Survey and
148	148	shall provide technic al assistance for schools in survey
149	149	administration, reporting, planning , and development of school
150	150	mental health prevention and intervention strategies informed b y the
151	151	survey results.
152	152	D. If a school or school district chooses to administer an
153	153	alternative survey or assessment tool to fulfill the purpose
154	154	described in subsection B of this section, it may apply for a waiver
155	155	through the Department of Mental Health and Substance Abuse
156	156	Services.
157	157	E. The school district superintendent or his or her designee
158	158	shall provide prior written notification to the parents or legal
159	159	guardians of students to be administered who have the option to
160	160	participate in the Oklahoma Prevention Needs Assessment Survey or an
161	161	alternative survey or assessment tool adopted pu rsuant to subsection
162	162	D of this section. The notification shall include a copy of the
163	163	survey or assessment tool and information to parents and legal
164	164	guardians that they may opt allow their student out of to

216	216	participate in the survey or assessment tool by providing written
217	217	notice permission to the school district.
218	218	F. Prior to the biennial administration of the Oklahoma
219	219	Prevention Needs Assessment Survey, the Department of Mental H ealth
220	220	and Substance Abuse Services shall submit the survey to the
221	221	President Pro Tempore of the Oklahoma State Senate, the Speaker of
222	222	the Oklahoma House of Representative s, the chairs of the committees
223	223	with responsibility over common ed ucation in both houses of the
224	224	Legislature, and the chairs of the committees with responsibility
225	225	over public health in both houses of the Legisla ture.
226	226	G. The provisions of this section shall be subject to the
227	227	availability of federal funding . If federal funding is insufficient
228	228	to provide the Oklahoma P revention Needs Assessment Survey to public
229	229	schools on a biennial basis, administration of the s urvey shall not
230	230	be required.
231	231	H. The Board of Mental Health and Substance Abuse Services and
232	232	the State Board of Education may promulgate rules as necessary to
233	233	carry out the provisions of this section.
234	234	SECTION 2. This act shall become effective November 1, 2024.
