8181 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -105.3, as
8383 last amended by Section 6, Chapter 47, 1st Extraordinary Session,
8484 O.S.L. 2023 (47 O.S. Supp. 2023, Section 6 -105.3), is amended to
8585 read as follows:
8686 Section 6-105.3 A. In addition to the li censes to operate
8787 motor vehicles, the Departm ent of Public Safety may issue cards to
8888 Oklahoma residents for purposes of identification only. The
8989 identification cards shall be issued, renewed, replaced, canceled
9090 and denied in the same manner as driver lice nses in this state. A

142142 licensee whose record reflects a notation of the person's proof of
143143 legal presence, verified by the U.S. Department of Homeland
144144 Security, or proof of U.S. citizenship, may obtain a REAL ID
145145 Compliant Identification Card or a Noncomplia nt Identification Card
146146 from a motor license a gent or the Department of Public Safety,
147147 regardless of the status of the license held by the licensee.
148148 Provided, the licensee must comply with all REAL ID documentation
149149 requirements to obtain a REAL ID Complian t Identification Card. A
150150 person shall not apply for or possess more than one state-issued or
151151 territory-issued REAL ID Compliant Identification Card pursuant to
152152 the provisions of Section 6-101 of this title.
153153 The application for an identification card by an y person under
154154 the age of eighteen (18) years shall be signed and verified by a
155155 custodial legal parent or legal guardian, either in person before a
156156 person authorized to administer oaths or electronically if
157157 completing an online application, or a notarized affidavit signed by
158158 a custodial legal parent or legal guardian submitted before a person
159159 authorized to administer oaths by the person under the age of
160160 eighteen (18) years with the application. Except as otherwise
161161 provided in this section, the identificati on cards shall be valid
162162 for a period of eithe r four (4) years from the month of issuance or
163163 eight (8) years from the month of issuance; however, the
164164 identification cards issued to persons sixty-five (65) years of age
165165 or older shall be valid indefinitely fr om the month of issuance.

217217 B. 1. The Department of Corrections shall coordinate with the
218218 Department of Public Safety to provide REAL ID Noncompliant
219219 Identification Cards to all inmates who do not have a current state -
220220 issued identification card or driver l icense upon their release from
221221 custody. The identification cards shall be issued, replaced,
222222 canceled and denied in the same manner as driver licenses in this
223223 state.
224224 2. The Department of Public Safety shall allow the use of a
225225 certified copy of a birth cer tificate coupled with a Department of
226226 Corrections-issued consolidated record card to serve as a valid form
227227 of photo identification documentation to obtain a REA L ID
228228 Noncompliant Identification Card.
229229 3. REAL ID Noncompliant Identification Cards issued wit h a
230230 consolidated record card from the Departme nt of Corrections for
231231 inmates shall be valid for a period of four (4) years from the month
232232 of issuance for an allow able fee to be determined by the Department
233233 of Public Safety and are nonrenewable and nontransf erable.
234234 4. The fee charged for the issuance o r replacement of a REAL ID
235235 Noncompliant Identification Card pursuant to this subsection shall
236236 be deposited in the D epartment of Public Safety Revolving Fund.
237237 Provided, however, REAL ID Noncompliant Identifica tion Cards issued
238238 to individuals required to re gister pursuant to the Sex Offenders
239239 Registration Act shall only be valid for a period of one (1) year.

291291 No person sixty-five (65) years of age or older shall be charged a
292292 fee for a REAL ID Noncompliant Identi fication Card.
293293 5. The Department of Public Saf ety is authorized to promulgate
294294 rules and procedures to implement the provisions of this subsection.
295295 C. No person shall hold more than one state-issued or
296296 territory-issued REAL ID Compliant Driver License o r REAL ID
297297 Compliant Identification Card, as defin ed in subsection G of Section
298298 6-101 of this title. The Department shall not issue a REAL ID
299299 Compliant Identificati on Card to any applicant who has been
300300 previously issued a REAL ID Compliant Driver License o r REAL ID
301301 Compliant Identification Card unless su ch license or identification
302302 card has been surrendered to the Department by the applicant. The
303303 Department may promulgate rules related to the issuance of
304304 replacement REAL ID Compliant Identification Cards i n the event of
305305 loss or theft.
306306 D. The fee charged for the issuance or renewal of a REAL ID
307307 Compliant Identification Card shall be Twenty -five Dollars ($25.00)
308308 for a 4-year card and Fifty Dollars ($50.00) for an 8 -year card.
309309 The fee charged for the issuan ce or renewal of a REAL ID
310310 Noncompliant Identifica tion Card pursuant to this sect ion shall be
311311 Twenty-five Dollars ($25.00) for a 4 -year card and Fifty Dollars
312312 ($50.00) for an 8-year card; however, no person sixty -five (65)
313313 years of age or older, or a one hundred percent (100%) disabled
314314 veteran described in subsection P of Section 6-101 of this title,

366366 shall be charged a fee for an identification card. Of each fee
367367 charged pursuant to the provisions of this subsection:
368368 1. Seven Dollars ($7.00) of a 4 -year card and Fourteen Dollars
369369 ($14.00) of an 8-year card shall be apportioned as provided in
370370 Section 1104 of this title;
371371 2. Three Dollars ($3.00) of a 4 -year card and Six Do llars
372372 ($6.00) of an 8-year card shall be credited to the Department of
373373 Public Safety Computer Imaging System Revolving Fund to be used
374374 solely for the purpose of the adminis tration and maintenance of the
375375 computerized imaging system of the Department;
376376 3. Ten Dollars ($10.00) of a 4-year card and Twenty Dollars
377377 ($20.00) of an 8-year card shall be deposited in the Department of
378378 Public Safety Revolving Fund;
379379 4. Three Dollars ($ 3.00) of a 4-year card and Six Dollars
380380 ($6.00) of an 8-year card shall be deposited to the State Public
381381 Safety Fund created in Section 2 -147 of this title; and
382382 5. Two Dollars ($2.00) for a 4-year card and Four Dollars
383383 ($4.00) for an 8-year card of the fee authorized by this subsection
384384 related to the issuance or renewal of an identificati on card by a
385385 motor license agent that does process approv ed applications or
386386 renewals for REAL ID Compliant and REAL ID Non-Compliant
387387 Noncompliant Driver Licenses or Identification Card s shall be
388388 retained by the licensed operator through June 30, 202 3. Beginning

441441 operator pursuant to su bsection E of Section 1141.1 of this title .
442442 E. The fee charged for repl acement of a REAL ID Compliant
443443 Identification Card, or REAL ID Non-Compliant Noncompliant
444444 Identification Card, shall be Twenty-five Dollars ($25.00); however,
445445 no person sixty-five (65) years of age or older and no homeless
446446 person who submits proof of temporary residence through a social
447447 worker or the coordinator of an emergency shelter for the homeless
448448 where the person is temporarily residing shall be charged a fee for
449449 an identification card replacement. For the purposes of this
450450 section, "homeless person" means a person without domicile who is
451451 unable to secure permanent and stable housing as determined by a
452452 social worker or the coordinator of an emergency shelter for the
453453 homeless. Of each fee charged pursuant to the p rovisions of this
454454 subsection:
455455 1. Seven Dollars ($7.00) shall be apportioned as provided in
456456 Section 1104 of this title;
457457 2. Three Dollars ($3.0 0) shall be credited to the Department of
458458 Public Safety Computer Imaging System Revolving Fund to be used
459459 solely for the purpose of the administration and maint enance of the
460460 computerized imaging system of the Department;
461461 3. Ten Dollars ($10.00) shall be deposited in the Department of
462462 Public Safety Revolving Fund;

514514 4. Three Dollars ($3.00) shall be deposited to the S tate Public
515515 Safety Fund created in Section 2 -147 of this title; and
516516 5. Two Dollars ($2.00) of the fee authorized by this subsection
517517 related to the replacement of an identification card by a motor
518518 license agent that does process approved applications or re newals
519519 for REAL ID Compliant or REAL ID Non-Compliant Noncompliant Driver
520520 Licenses or Identification Cards shall be retained by the licensed
521521 operator through June 30, 2023. Beginning July 1, 2023, these
522522 monies shall be retained by the licensed operator pursuant to
523523 subsection E of Section 1141.1 of this title.
524524 F. The Oklahoma Tax Commission is her eby authorized to
525525 reimburse, from fund s available to that agency, each motor license
526526 agent issuing an identification card to a person sixty-five (65)
527527 years of age or older, an amount not to exceed One D ollar ($1.00)
528528 for each card or driver license so issue d through June 30, 2023 .
529529 The Tax Commission shall develop procedures for claims for
530530 reimbursement.
531531 G. Notwithstanding any other provision of law, when a person
532532 makes application for a new identificati on card, or makes
533533 application to renew an identificati on card, and the person has been
534534 convicted of, or received a deferred judgment for, any offense
535535 required to register pursuant to the Sex Offenders Registration Act,
536536 the identification card shall be vali d for a period of one (1) year
537537 from the month of issua nce, but may be renewed yearly during the

590590 Registry. The cost for such identification card shall be the same
591591 as for other identification ca rds and renewals.
592592 H. Nothing in this section requires or authorizes the
593593 Department of Public Safety to issue a REAL ID Noncompliant
594594 Identification Card without the docum entation required by the
595595 provisions of paragraph 9 of subse ction A of Section 6 -103 of this
596596 title.
597597 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -325, is
598598 amended to read as follows:
599599 Section 1-325. The State Board of Health shall prescribe the
600600 fees to be paid for certified copies of certif icates or records, or
601601 for a search of the files or records when no copy is ma de.
602602 The collection of such fees may be accomplished by ac ceptance of
603603 cash, money orders, credit cards, organization or personal checks;
604604 in the event money orders or checks are pro ved to be noncollectible,
605605 neither the Board of Health, the Commissioner of He alth, nor any of
606606 the employees of the State Department of Health will be held
607607 responsible and personally liable; it is further required that no
608608 additional certified copies of reco rds may be delivered t o persons
609609 on whom noncollectible drafts remain outstanding.
610610 A search and a verification of birth facts shall be furnished
611611 free of charge to any person volunteering for enlistment into a
612612 branch of the Armed Forces of the United States, upon written

664664 request therefor by an officer of the Armed Forces representing the
665665 interests of such person who shall be volunteering f or service.
666666 A certified copy of a birth certificate shall be furnished,
667667 without fee, upon request by a homeless person, prov ided that the
668668 person submits a request through a social worker or the coordinator
669669 of the emergency shelter for the homeless where the person is
670670 temporarily residing. The request shall be submitted on the
671671 emergency shelter's letterhead and shall includ e the shelter's
672672 employer identification number and an attestation by the coordinator
673673 that the person requesting the certificate is curre ntly homeless and
674674 residing at the shelter , or the request shall be submitted o n the
675675 social worker's agency or professiona l practice letterhead and shall
676676 include the agency's or the professional practice 's employer
677677 identification number and an attestation b y the social worker that
678678 the person requesting the certificate is currently ho meless. A
679679 certified copy of a birth certif icate furnished pursua nt to this
680680 paragraph shall be submitted to the social worker or coordinator who
681681 submitted the request. No more t han one certified copy of a birth
682682 certificate furnished to a homeless person p ursuant to this
683683 paragraph shall be provided without fee. For the purposes of this
684684 section, "homeless person" means a person without domicile who is
685685 unable to secure permanent an d stable housing as determined by a
686686 social worker or the coordinator of an eme rgency shelter for the
687687 homeless.
