9191 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9292 SECTION 1. NEW LAW A new section of law not to be
9393 codified in the Oklahoma Statutes reads as follows:
9494 This act shall be known and may be cited as the "Do Your Job

147147 SECTION 2. AMENDATORY 70 O.S. 2021, Section 3 -104.3, is
148148 amended to read as follows:
149149 Section 3-104.3 A. The Legislature, recognizing its obligation
150150 to the children of this state to ensure their opportunity to receive
151151 an excellent education, and recognizin g its obligation to the
152152 taxpayers of this state to ensure that schooling is accomplis hed in
153153 an efficient manner, hereby establishes requirements for compl iance
154154 with quality standards which the public schools and school
155155 districts, within the limits of resou rces now or subsequently
156156 available, must meet.
157157 B. State accreditation shall be withd rawn from or denied to
158158 schools or school districts that do not meet t he requirements of
159159 Sections 2, 3, 6, 28, 29, 30, 44, 45, 46, 47, 48, and 49 of this
160160 act, and the State Board of Education Office of Educational Quality
161161 and Accountability shall take action as required by this act to
162162 ensure that students affected are enroll ed in schools that are able
163163 to maintain state accreditation. Nothing herein shall be construed
164164 as prohibiting the withdrawing or denial of accreditati on for
165165 failure to meet requirements as elsewhere provided by law.
166166 SECTION 3. AMENDATORY 70 O.S. 2021, Section 3 -104.4, is
167167 amended to read as follows:
168168 Section 3-104.4 A. The State Board of Education Office of
169169 Educational Quality and Accoun tability shall adopt standards for the
170170 accreditation of the public schools in this state accord ing to the

223223 effective as set forth in Section 3-104.3 et seq. of this title.
224224 The accreditation standards shall incorporate the curricular
225225 standards established pursuant to Section 11 -103.6 of this title.
226226 The accreditation standards shall equal or exceed nationally
227227 recognized accreditation standards to the extent that the standards
228228 are consistent with an academic results oriented approach to
229229 accreditation. The accreditation adopted by the State Board Office
230230 of Educational Quality and Accoun tability shall encompass
231231 accreditation for elementary schools, middle schools, junior high
232232 schools, and high schools. The accreditation standards shall be
233233 made available for public inspection at the offices of the State
234234 Department of Education.
235235 B. Standards for accreditation adopted by the State Board of
236236 Education Office of Educational Quality and Accoun tability shall
237237 include standards relating to the provision of school counselors to
238238 the public school children of this state. The State Board of
239239 Education Office of Educational Quality and Accoun tability shall
240240 require each local school district to provide information regarding
241241 the number of counselors serving each school site, the dutie s of all
242242 such counselors including all administrative duties, the number of
243243 students served by each counselor, and information regarding the
244244 number of counselors employed per elementary school, middle school,
245245 junior high school and high school.

297297 C. Except as otherwise provided, schools shall meet the
298298 accreditation standards as a condition of continued accreditation.
299299 Nothing herein shall be construed as preventing changes to the
300300 adopted standards by the State Board of Education Office of
301301 Educational Quality and Accoun tability pursuant to the
302302 Administrative Procedures Act. The accreditation standards shall
303303 provide for warnings, probation or nonaccredited status for schools
304304 that fail to meet the standards. The Department shall investigate a
305305 complaint of failure to provide educational services or failure to
306306 comply with accreditation standards within thirty (30) days of
307307 receiving the complaint. If the Department determines that a school
308308 has failed to comply with the ac creditation standards, the
309309 Department shall report the recommended wa rning, probation or
310310 nonaccredited accreditation status to the State Board of Education
311311 Office of Educational Quality and Accoun tability within ninety (90)
312312 days. If a school does not take action to comply with the
313313 accreditation standards within ninety (90) days after a report is
314314 filed by the Department, the Board Office of Educational Quality and
315315 Accountability shall withdraw accreditation for the school. The
316316 State Board Office of Educational Quality and Accountability
317317 accreditation regulations shall provide for warnings and for
318318 assistance to schools and school districts whenever there is reason
319319 to believe a school is in danger of losing its state accreditation.

371371 D. If one or more school sites fail to receive accreditation as
372372 required pursuant to this section or subsequently lose
373373 accreditation, the State Board of Education Office of Educational
374374 Quality and Accountability shall close the school and reassign the
375375 students to accredited schools within the district or shall a nnex
376376 the district to one or more other districts in which the students
377377 can be educated in accredited schools.
378378 E. Standards for accreditation adopted by the State Board of
379379 Education Office of Educational Quality and Accoun tability shall
380380 include standards relating to the provision of educationa l services
381381 provided in partial hospitalization programs, day treatment
382382 programs, day hospital programs, residential treatment programs and
383383 emergency shelter programs for persons between t he ages of three (3)
384384 and twenty-one (21) years of age. The accredita tion standards shall
385385 apply to on-site and off-site educational services provided by
386386 public school districts or state-accredited private sc hools. Each
387387 school which is providing or is requ ired to provide educational
388388 services for students placed in a program as described in this
389389 subsection shall be actively monitored by the State Department of
390390 Education. The Department shall determine on an o ngoing basis if
391391 the educational program and servi ces are in compliance with the
392392 accreditation standards.
393393 F. The State Board Office of Educational Quality and
394394 Accountability shall provide assistance to districts in considering

446446 the possibility of meeting accreditation requirements through the
447447 use of nontraditional means of instruction. The State Board Office
448448 of Educational Quality and Accoun tability shall also assist
449449 districts in forming cooperatives and making arrangements for the
450450 use of satellite instruction or other instructional technologies to
451451 the extent that use of such instructional means meets a ccreditation
452452 standards.
453453 G. 1. Accreditation shall not be withdrawn from or denied nor
454454 shall a penalty be assessed against a sch ool or school district for
455455 failing to meet the media materials and equipment standards, media
456456 program expenditure standards and media personnel standards as set
457457 forth in the accreditation standards adopted by the Board Office of
458458 Educational Quality and Accoun tability.
459459 2. The provisions of paragraph 1 of this subsection shall cease
460460 to be effective during the fiscal year which begins on the July 1
461461 immediately succeeding the legis lative session during which the
462462 measure appropriating monies to the State Board of Education for the
463463 financial support of public schools is enacted as law and such
464464 appropriation amount is at least Fifty Million Dollars
465465 ($50,000,000.00) greater than the amo unt of money appropriated to
466466 the State Board of Education for the financial support of public
467467 schools for the fiscal year ending June 30, 2019, pursuant to
468468 Chapter 146, O.S.L. 2018. Provided, the Fifty Million Dollars
469469 ($50,000,000.00) shall not include an y amount of appropriations

522522 Accreditation shall not be withdrawn fr om or denied nor shall a
523523 penalty be assessed against a school or school district for failing
524524 to meet the media personnel standa rds as set forth in accreditation
525525 standards adopted by the Board Office of Educational Quality and
526526 Accountability.
527527 H. 1. The State Board shall not assess a financial penalty
528528 against any school district which is given a deficiency in
529529 accreditation status during any fiscal year as provided for in this
530530 subsection.
531531 2. Beginning with the fiscal year which begins July 1, 2021, if
532532 the amount of money appropriated t o the State Board of Education for
533533 the financial support of public schools including funds apportioned
534534 pursuant to Section 2 of this act, is at least One Hundred Million
535535 Dollars ($100,000,000.00) greater than the amount of money
536536 appropriated to the Stat e Board of Education for the finan cial
537537 support of public schools for the fiscal year ending June 30, 2019,
538538 pursuant to Chapter 146, O.S.L. 2018, a financial penalty shall be
539539 assessed against any school districts that do not comply with the
540540 class size limitations for kindergarten as provide d for in Section
541541 18-113.2 of this title and class size limitations for grade one as
542542 provided for in subse ction A of Section 18-113.1 of this title.
543543 Provided, the One Hundred Million Dollars ($100,000,000.00) shall

597597 3. The State Department of Education shall submit a report on
598598 statewide classroom sizes to the President Pro Tempore of the
599599 Oklahoma State Senate and the Speak er of the Oklahoma House of
600600 Representatives no later than January 1, 2022.
601601 I. Except as provided for in subsection J of this section,
602602 beginning with the 2019-2020 school year, evaluations of schools to
603603 determine whether they meet the accreditation standar ds set forth in
604604 accordance with this section shall occur once every four (4) years
605605 on a schedule adopted by the State Board of Education Office of
606606 Educational Quality and Accoun tability. The Board Office of
607607 Educational Quality and Accoun tability may interrupt the evaluation
608608 schedule provided in this subsection for reasons inc luding a change
609609 in the superintendent of the school district ; determination that one
610610 or more school district b oard members have not met the continuing
611611 education requirements as defined by this title; determination that
612612 the school district falsified informa tion submitted to any publ ic
613613 city, county, state or federal official or agency; initiation of an
614614 investigation by the Board Office of Educational Quality and
615615 Accountability or a law enforcement agency; or other determination
616616 by the Board Office of Educational Quality and Accoun tability that
617617 standards for accreditation are not being met by the school

670670 Quality and Accountability shall allow for school districts
671671 receiving no deficiencies for two (2) consecutive years to be
672672 reviewed for accreditation less than annually. Provided, however,
673673 that schools shall be evaluated annually for the purposes of:
674674 1. Local, state and federal funding;
675675 2. Health and safety;
676676 3. Certification requirements for teachers, principals and
677677 superintendents;
678678 4. School board governance, including instructional and
679679 continuing education requirements for school board members; and
680680 5. Any other requirements under state or federal law.
681681 J. Beginning with the 2019-2020 school year, if a public school
682682 receives a deficiency on its ac creditation report, the public school
683683 shall be evaluated annually to determine if it meets the
684684 accreditation standard s set forth in accordance with this section.
685685 If the public school receives no deficiencies for two (2)
686686 consecutive years, the public schoo l shall be subject to the
687687 evaluation timeline established in subsection I of this section.
688688 SECTION 4. AMENDATORY 70 O.S. 2021, Section 3 -106, is
689689 amended to read as follows:
690690 Section 3-106. A. The State Superintendent of Public
691691 Instruction shall have an office at the seat of government where all
692692 books and papers pertaining to the office of the Superintendent
693693 shall be kept. The books and papers shall be kept and preserved in

745745 the office and delivered by the Superintendent of Public Instruction
746746 to a successor. The Superintendent shall file and carefully
747747 preserve in the office all official reports made to the
748748 Superintendent. The salary of the State Superintendent of Public
749749 Instruction shall be as provided for in Section 250.4 of Title 74 of
750750 the Oklahoma Statutes , subject to a review by the Commission for
751751 Educational Quality and Accountability provided in subsecti on B of
752752 this section.
753753 B. The Commission for Educational Quality and Accountability
754754 shall annually meet before the sta rt of each state fiscal year to
755755 review the performance of the State Super intendent of Public
756756 Instruction. The Commission shall have the power to vote on and
757757 decide to cut the Superintendent 's salary up to fifty percent (50%)
758758 for poor performance. The Commission shall consider, but is not
759759 limited to:
760760 1. Grant applications;
761761 2. Teacher retention; and
762762 3. Statewide student test scores.
763763 Any monies withheld from the Superintendent 's salary shall be
764764 reappropriated to the Oklahoma State Department of Education 's
765765 budget.
766766 SECTION 5. AMENDATORY 74 O.S. 2021, Section 250.4, is

819819 Section 250.4 Pursuant to provisions of the Constitution of the
820820 State of Oklahoma from a nd after the beginning date of a term of
821821 office which commences in, or after, January 2016, the following
822822 officers of the State of Oklahoma sh all be annually compensated for
823823 their services, payable monthly, as follows:
824824 1. The Governor shall receive a sala ry of One Hundred Forty -
825825 seven Thousand Dollars ($147,000.00);
826826 2. The Lieutenant Governor shall receive a salary of One
827827 Hundred Fourteen Thous and Seven Hundred Thirteen Dollars
828828 ($114,713.00);
829829 3. The Attorney General shall receive a salary of One Hundred
830830 Thirty-two Thousand Eight Hundred Twenty -five Dollars ($132,825.00);
831831 4. The State Superintendent of Public Instruction shall receive
832832 a salary of One Hundred Twenty -four Thousand Three Hun dred Seventy-
833833 three Dollars ($124,373.00 ), subject to review as provided in
834834 Section 3-106 of Title 70 of the Oklahoma S tatutes;
835835 5. Each member of the Corporation Co mmission shall receive a
836836 salary of One Hundred Fourteen Thousand Seven Hundred Thirteen
837837 Dollars ($114,713.00);
838838 6. The State Treasurer shall receive a salary of One Hundred
839839 Fourteen Thousand Seven Hundred Thirteen Dollars ($114,713.00);
840840 7. The State Auditor and Inspector shall receive a salary of
