7777 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 56 O.S. 2021, Se ction 1017.2, is
7979 amended to read as follows:
8080 Section 1017.2 The Legislature finds that:
8181 1. Oklahoma has a successful home - and community-based services
8282 program known as the ADvantage Waiver Program for the frail, elderly
8383 and adults with physical disabili ties age twenty-one (21) and over
8484 who do not have an intellectual disability nor a cognitive
8585 impairment. The ADvantage Waiver Program provides the following
8686 services: case management, trans itional case management, personal
8787 care, advanced supportive/resto rative, skilled nursing - home health
8888 setting, RN assessment evaluation, occupational therapy, physical

142142 health, home-delivered meals, NF not less than thirty (30) and up to
143143 sixty (60) days of nursing facility extended respite, in-home
144144 respite, in-home extended respite, environmental modifications,
145145 hospice, consumer-directed personal care assistant servi ces and
146146 supports, assisted living, and specialized medical equipment and
147147 supplies;
148148 2. Many Oklahomans who could safely stay at home with cost-
149149 effective home- and community-based services go into nursing
150150 facilities the day assistance is needed because their eligibility
151151 for nursing facility supports is "presumed" by the nursing facility,
152152 while eligibility for home and community s upports can take weeks or
153153 months. If their circumstances are such that they need immediate or
154154 urgent care, they lose their choice to live and receive their
155155 services at home. Once they are in a nursing facility, they may
156156 lose their home or the supports th ey need to stay at home; and
157157 3. The cost of serving Oklahomans who are in nursing facilities
158158 when they could be living and receivi ng services at home is
159159 significantly higher than the cost of serving them with home - and
160160 community-based services.
161161 SECTION 2. This act shall become effective November 1, 2024.
