7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1021, is
8181 amended to read as follows:
8282 Section 1021. A. Every person who willfully and knowingly
8383 either:
8484 1. Lewdly exposes his or her person or genitals in any public
8585 place, or in any plac e where there are present other persons to be
8686 offended or annoyed thereby ; provided, however, for purposes of this
8787 section, a person alleged to have committed an act o f public
8888 urination shall be prosecuted pursuant to Section 22 of this title
8989 unless such act was accompanied with another act that violates

141141 paragraphs 2 through 4 of this subsection and shall not be subject
142142 to registration under the Sex Offenders Registrati on Act;
143143 2. Procures, counsels, or assists any person to expose such
144144 person, or to make a ny other exhibition of such person to public
145145 view or to the view of any number of persons, for the purpose of
146146 sexual stimulation of the viewer;
147147 3. Writes, composes, s tereotypes, prints, photographs, designs,
148148 generates by artificial intelligence (AI), copies, draws, engraves,
149149 paints, molds, cuts, o r otherwise prepares, publishes, sells,
150150 distributes, keeps for sale, knowingly downloads on a computer, or
151151 exhibits any obscene material or child pornography; or
152152 4. Makes, prepares, cuts, sells, gives, loans, distributes,
153153 keeps for sale, or exhibits any d isc record, metal, plastic, or wax,
154154 wire or tape recording, or any type of obscene material or child
155155 pornography,
156156 shall be guilty, upon conviction, of a felony and shall be punished
157157 by the imposition of a fine of not less than Five Hundred Dollars
158158 ($500.00) nor more than Twenty Thousand Dollars ($20,000.00) or by
159159 imprisonment for not less than thirty (30) days nor more than ten
160160 (10) years, or by both such fine and imprisonment.
161161 B. Every person who:
162162 1. Willfully solicits or aids a minor child to perform; o r

214214 2. Shows, exhibits, loans, or distributes to a minor child any
215215 obscene material or child pornography for the purpose of i nducing
216216 said minor to participate in,
217217 any act specified in paragraphs 1, 2, 3 or 4 of subsection A of this
218218 section shall be guilty o f a felony, upon conviction, and shall be
219219 punished by imprisonment in the custody of the Department of
220220 Corrections for not l ess than ten (10) years nor more than thirty
221221 (30) years, except when the minor child is under twelve (12) years
222222 of age at the time t he offense is committed, and in such case the
223223 person shall, upon conviction, be punished by imprisonment in the
224224 custody of the Department of Corrections for not less than twenty -
225225 five (25) years.
226226 C. Persons convicted under this section shall not be eligibl e
227227 for a deferred sentence.
228228 D. Except for persons sentenced to life or life without parole,
229229 any person sentenced to imprison ment for two (2) years or more for a
230230 violation of this section shall be required to serve a term of post -
231231 imprisonment supervision pu rsuant to subparagraph f of paragraph 1
232232 of subsection A of Section 991a of Title 22 of the Oklahoma Statutes
233233 under conditions determined by the Department of Corrections. The
234234 jury shall be advised that the mandatory post -imprisonment
235235 supervision shall be in addition to the actual imprisonment.
236236 E. For purposes of this section , "downloading on a computer ":

288288 1. "Downloading on a computer" means electronically
289289 transferring an electronic file from one computer or electronic
290290 media to another computer or electronic media ; and
291291 2. "Generates by artificial intelligence (AI)" means AI-
292292 generating technology that can produce various types of content
293293 including text, images, videos, audio clips or synthetic data.
294294 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1024.1, is
295295 amended to read as follows:
296296 Section 1024.1 A. As used in Sections 1021, 1021.1 through
297297 1021.4, Sections 1022 through 1024 and 1023, and Sections 1040.8
298298 through 1040.24 of this title, "child pornography" means and
299299 includes any visual depiction or individual image stored or
300300 contained in any format on any medium including, but not limited to,
301301 film, motion picture, videotape, photograph, negative, undeveloped
302302 film, slide, photographic product, reprodu ction of a photographic
303303 product, artificial intelligence (AI)-generated image, play or
304304 performance wherein a minor under the age of eighteen (18) years is
305305 engaged in any act with a person, other than his or her spouse, of
306306 sexual intercourse which is normal or perverted, in any act of anal
307307 sodomy, in any act of sexual activity with an animal, in any act of
308308 sadomasochistic abuse includi ng, but not limited to, flag ellation or
309309 torture, or the condition of being fettered, bound or otherwise
310310 physically restrained in the context of sexual conduct , in any act
311311 of fellatio or cunnilingus, in any act of excretion in the context

363363 of sexual conduct, in any lewd exhibition of t he uncovered genitals
364364 in the context of masturbation or other sexual conduct, or where the
365365 lewd exhibition of the uncovered genita ls, buttocks or, if such
366366 minor is a female, the breast, has the purpose of sexual stimulation
367367 of the viewer, or wherein a pers on under the age of eighteen (18)
368368 years observes such acts or exhibitions. Each visual depiction or
369369 individual image shall consti tute a separate item and multiple
370370 copies of the same identical material shall each be counted as a
371371 separate item.
372372 B. As used in Sections 1021 through 1024.4 and Sections 1040.8
373373 through 1040.24 of this title:
374374 1. "Obscene material" means and includes any r epresentation,
375375 performance, depiction or description of sexual conduct, whether in
376376 any form or on any medium including still p hotographs, undeveloped
377377 photographs, motion picture s, undeveloped film, videotape, AI-
378378 generated image, optical, magnetic or solid -state storage, CD or
379379 DVD, or a purely photographic product or a reproduction of such
380380 product in any book, pamphlet, ma gazine, or other publication or
381381 electronic or photo-optical format, if said items contain the
382382 following elements:
383383 a. depictions or descrip tions of sexual conduct which are
384384 patently offensive as found by the average person
385385 applying contemporary community st andards,

437437 b. taken as a whole, have as the dominant theme an appeal
438438 to prurient interest in sex as found by the average
439439 person applying contemporary community standards, and
440440 c. a reasonable person would find the material or
441441 performance taken as a whole lack s serious literary,
442442 artistic, educational, political, or scientific
443443 purposes or value.
444444 The standard for obscenity applied in this section shall not apply
445445 to child pornography;
446446 2. "Performance" means and includes any display, live or
447447 recorded, in any form or medium;
448448 3. "Sexual conduct" means and includes any of the following:
449449 a. acts of sexual intercourse including any intercourse
450450 which is normal or perverted, actual or simulated,
451451 b. acts of deviate sexual conduct, including oral and
452452 anal sodomy,
453453 c. acts of masturbation,
454454 d. acts of sadomasochistic abuse including but not
455455 limited to:
456456 (1) flagellation or torture by or upon any person who
457457 is nude or clad in undergarments or in a costume
458458 which is of a revealing nature, or

510510 (2) the condition of being fettered, bo und, or
511511 otherwise physically restrained on the part of
512512 one who is nude or so clothed,
513513 e. acts of excretion in a sexual context, or
514514 f. acts of exhibiting human genitals or pubic areas; and
515515 4. "Explicit child pornography " means material which a law
516516 enforcement officer can immediately identify upon first viewing
517517 without hesitation as child pornography ; and
518518 5. "Artificial intelligence (AI)-generated image" means an image
519519 created through the use of AI programs.
520520 The types of sexual conduct described in paragraph 3 of th is
521521 subsection are intended to include situations when, if appropriate
522522 to the type of conduct, the con duct is performed alone or be tween
523523 members of the same or opposite sex or between humans and animals in
524524 an act of apparent sexual stimulation or gratificat ion.
525525 SECTION 3. AMENDATORY 21 O.S. 2021, Section 1040.75, is
526526 amended to read as follows:
527527 Section 1040.75 As used in Sections 1040.75 through 1040.77 of
528528 this title:
529529 1. "Minor" means any unmarried person under the age of eighteen
530530 (18) years;
531531 2. "Harmful to minors" means:
532532 a. that quality of any description, exhibition,
533533 presentation or representation, in whatever form, of

585585 nudity, sexual conduct, sexual excitement, or
586586 sadomasochistic abuse when the material or
587587 performance, taken as a whole, has the following
588588 characteristics:
589589 (1) the average person eighteen (18) years of age or
590590 older applying contemporary community standards
591591 would find that the material or performance has a
592592 predominant tendency to appeal to a prurient
593593 interest in sex to minors, and
594594 (2) the average person eighteen (18) yea rs of age or
595595 older applying contemporary community standards
596596 would find that the material or performance
597597 depicts or describes nudity, sexual conduct,
598598 sexual excitement or sadomasochistic abuse in a
599599 manner that is patently offensive to prevailing
600600 standards in the adult community with respect to
601601 what is suitable for minors, and
602602 (3) the material or performance lacks serious
603603 literary, scientific, medical, artistic, or
604604 political value for minors , or
605605 b. any description, exhibition, presentation or
606606 representation, in whatever form, of inappropriate
607607 violence;

659659 3. "Inappropriate violence " means any description or
660660 representation, in an interactive video game or computer software,
661661 of violence which, taken as a whole , has the following
662662 characteristics:
663663 a. the average person eighteen (18) years of age or older
664664 applying contemporary community standards would find
665665 that the interactive video game or computer software
666666 is patently offensive to prevailing standards in the
667667 adult community with respect to what is suitable for
668668 minors, and
669669 b. the interactive video game or computer software lacks
670670 serious literary, scientific, medical, artistic, or
671671 political value for minors based on, but not limited
672672 to, the following criteria:
673673 (1) is glamorized or gratuitous,
674674 (2) is graphic violence used to shock or stimulate,
675675 (3) is graphic violence that is not contextually
676676 relevant to the material,
677677 (4) is so pervasive that it serves as the thread
678678 holding the plot of the material together,
679679 (5) trivializes the serious nature of realistic
680680 violence,
681681 (6) does not demonstrate the consequences or effects
682682 of realistic violence,

734734 (7) uses brutal weapons designed to inflict the
735735 maximum amount of pain and damage,
736736 (8) endorses or glorifies torture or excessive
737737 weaponry, or
738738 (9) depicts lead characters who resort t o violence
739739 freely;
740740 4. "Nudity" means the:
741741 a. showing of the human male or female genitals, pubic
742742 area, or buttocks with less than a full opaque
743743 covering,
744744 b. showing of the female breast with less than a full
745745 opaque covering of any portion of the female b reast
746746 below the top of the nipple, or
747747 c. depiction of covered male genitals in a discernibly
748748 turgid state;
749749 5. "Sexual conduct" means acts of masturbation, homosexuality,
750750 sexual intercourse, or physical contact with a person's clothed or
751751 unclothed genitals, pubic area, buttocks, or, if such person be a
752752 female, breast;
753753 6. "Sexual excitement" means the condition of human male or
754754 female genitals when in a state of sexual stimulation or arousal;
755755 7. "Sadomasochistic abuse" means flagellation or torture by or
756756 upon a person clothed or naked or the condition of being fettered,

809809 clothed or naked;
810810 8. "Material" means any book, magazine, newspaper, pamp hlet,
811811 poster, print, picture, figure, image, artificial intelligence (AI)-
812812 generated image, description, motion picture film, record, recording
813813 tape, CD-ROM disk, Magnetic Disk Memory, Magnetic Tape Memory, video
814814 tape, computer software or video game;
815815 9. "CD-ROM" means a compact disk with read only memory wh ich
816816 has the capacity to store audio, video and written materials and may
817817 be used by computer to play or display materials harmful to minors;
818818 10. "Magnetic Disk Memory " means a memory system that stores
819819 and retrieves binary data on record-like metal or plastic disks
820820 coated with a magnetic material, including but not limited to floppy
821821 diskettes;
822822 11. "Magnetic Tape Memory " means a memory system that stores
823823 and retrieves binary data on magnetic recording ta pe;
824824 12. "Performance" means any motion picture, film , video tape,
825825 played record, phonograph or tape, preview, trailer, play, show,
826826 skit, dance, or other exhibition performed or presented to or before
827827 an audience of one or more, with or without considerati on;
828828 13. "Knowingly" means having general knowledge o f, or reason to
829829 know, or a belief or ground for belief which warrants further
830830 inspection or inquiry of both:

882882 a. the character and content of any material or
883883 performance which is reasonably susceptible of
884884 examination by the defendant, and
885885 b. the age of the minor. However, an honest mistake,
886886 shall constitute an excuse from liability pursuant to
887887 this act if the defendant made a reasonable bona fide
888888 attempt to ascertain the true age of such minor;
889889 14. "Person" means any individual, partnership, association,
890890 corporation, or other legal entity of any kind; and
891891 15. "A reasonable bona fide attempt " means an attempt to
892892 ascertain the true age of the minor by requiring production of a
893893 driver license, marriage lice nse, birth certificate or other
894894 governmental or educa tional identification card or paper and not
895895 relying solely on the oral allegations or apparent a ge of the minor;
896896 and
897897 16. "Artificial intelligence (AI)-generated image" means an
898898 image created through the use of AI programs.
899899 SECTION 4. This act shall become effective November 1, 2024.
