7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 47 O.S. 2021, Section 11 -801, is
7979 amended to read as follows:
8080 Section 11-801. A. Any person driving a vehicle on a highway
8181 shall drive the same at a careful and prudent speed not greater than
8282 nor less than is reasonable and proper, having due regard to the
8383 traffic, surface and width of the highway and any other conditions
8484 then existing. No person shall drive any vehicle upon a highway at
8585 a speed greater than will permit the driver to bring it to a stop
8686 within the assured clear distance ahead.
8787 B. Except when a special hazard exists that requires lower
8888 speed for compliance with subsection A of this section, the limits

140140 specified by law or established as hereinafter authorized shall be
141141 maximum lawful speeds, and no person shall drive a vehicle on a
142142 highway at a speed in excess of the following maximum limits:
143143 1. On a highway or p art of a highway, unless otherwise
144144 established in law, a speed established by the Department of
145145 Transportation on the basis of engineering and traffic
146146 investigations used to determine the speed that is reasonable and
147147 safe under the conditions found to exis t on the highway or part of
148148 the highway;
149149 2. For a school bus, fifty -five (55) miles per hour on paved
150150 two-lane roads except on the state highway system, the interstate
151151 highway system and the turnpike system where the maximum shall be
152152 sixty-five (65) miles per hour;
153153 3. On any highway outside of a municipality in a properly
154154 marked school zone, twenty-five (25) miles per hour, provided the
155155 zone is marked with appropriate warning signs pl aced in accordance
156156 with the latest edition of the Manual on Uniform Traf fic Control
157157 Devices. The Department of Transportation may determine on the
158158 basis of an engineering and traffic investigation that a speed limit
159159 higher than twenty-five (25) miles per hour may be reasonable and
160160 safe under conditions as they exist upon a hi ghway, and post an
161161 alternative school zone speed limit. The Department shall mark such
162162 school zones, or entrances and exits onto highways by buses or
163163 students, so that the maximum spe ed provided by this section shall

215215 be established therein. Exits and ent rances to controlled-access
216216 highways which are within such school zones shall be marked in the
217217 same manner as other highways. The county commissioners shall mark
218218 such school zones alo ng the county roads so that the maximum speed
219219 provided by this section s hall be established therein. The signs
220220 may be either permanent or temporary. The Department shall give
221221 priority over all other signing projects to the foregoing duty to
222222 mark school zones. The Department shall also provide other safety
223223 devices for school zones which are needed in the opinion of the
224224 Department;
225225 4. Twenty-five (25) miles per hour or a posted alternative
226226 school zone speed limit through state schools located on the state -
227227 owned land adjoining or outside the limits of a corporate city or
228228 town where a state educational institution is established;
229229 5. Thirty-five (35) miles per hour on a highway in any state
230230 park or wildlife refuge. Provided, however, that the provisions of
231231 this paragraph shall not include the State Capitol park area, and no
232232 person shall drive any vehicle at a rate of speed in excess of
233233 fifty-five (55) miles per hour on any state or federal designated
234234 highway within such areas; and
235235 6. For any vehicle or comb ination of vehicles with solid rubber
236236 or metal tires, ten (10) miles per hour.
237237 The maximum speed limits set forth in this section may be
238238 altered as authorized in Sections 11 -802 and 11-803 of this title.

290290 C. The Commission is hereby authorized to prescribe maximum and
291291 minimum speeds for all vehicles and any combinations of veh icles
292292 using controlled-access highways. Such regulations shall become
293293 effective after signs have been posted on these highways giving
294294 notice thereof. Such regulations may apply to an entirely
295295 controlled-access highway or to selected sections thereof as m ay be
296296 designated by the Commission. A minimum speed limit of sixty-five
297297 (65) miles per hour and a maximum speed limit of seventy -five (75)
298298 miles per hour may be set in locations comprising rural segments of
299299 the interstate highway system by the Commiss ion; provided, however,
300300 that speed is determined to be safe and reasonable after a traffic
301301 or engineering study has been completed by the Department. It shall
302302 be a violation of this section to drive any vehicle at a faster rate
303303 of speed than such prescrib ed maximum or at a slower rate of speed
304304 than such prescribed minimum. However, all vehicles shall at all
305305 times conform to the limits set forth in subsection A of this
306306 section.
307307 Copies of such regulations certified as in effect on any
308308 particular date by the Secretary of the Commission shall be accepted
309309 as evidence in any court in this state. Whenever changes have been
310310 made in speed zones, copies of such regulations shall be filed with
311311 the Commissioner of Public Safety.
312312 D. The Oklahoma Turnpike Authority is hereby authorized to
313313 prescribe maximum and minimum speeds for trucks, buses and

365365 automobiles using turnpikes; provided, however, a minimum speed
366366 limit of sixty-five (65) miles per hour and a maximum speed limit of
367367 eighty (80) miles per hour may be set in loc ations comprising the
368368 turnpike system, as may be approved by the A uthority. The
369369 regulation pertaining to automobiles shall apply to all vehicles not
370370 commonly classified as either trucks or buses. Such regulations
371371 shall become effective only after approva l by the Commissioner of
372372 Public Safety, and after signs have been posted on the turnpike
373373 giving notice thereof. Such regulations may apply to an entire
374374 turnpike project or to selected sections thereof as may be
375375 designated by the Oklahoma Turnpike Authorit y. It shall be a
376376 violation of this section to drive a vehicle at a faster rate of
377377 speed than such prescribed maximum speed or at a slower rate of
378378 speed than such prescribed minimum speed. However, all vehicles
379379 shall at all times conform to the requiremen ts of subsection A of
380380 this section.
381381 Copies of such regulations, ce rtified as in effect on any
382382 particular date by the Secretary of the Oklahoma Turnpike Authority,
383383 shall be accepted in evidence in any court in this state.
384384 E. The driver of every vehicle sha ll, consistent with the
385385 requirements of subsection A of this secti on, drive at an
386386 appropriate reduced speed when approaching and crossing an
387387 intersection or railway grade crossing, when approaching and going
388388 around a curve, when approaching a hillcrest, wh en driving upon any

440440 narrow or winding roadway, and when special ha zard exists with
441441 respect to pedestrians or other traffic, or by reason of weather or
442442 highway conditions. The Oklahoma Department of Transportation and
443443 the Oklahoma Turnpike Authority may po st, by changeable message sign
444444 or other appropriate sign, a tempor ary reduced speed limit for
445445 maintenance operations or when special hazards with respect to
446446 pedestrians, other traffic, an accident, by reason of weather or
447447 when other hazardous highway condi tions exist.
448448 F. 1. No person shall drive a vehicle on a county r oad at a
449449 speed in excess of fifty -five (55) miles per hour unless posted
450450 otherwise by the board of county commissioners, as provided in
451451 subparagraphs a through c of this paragraph, as follow s:
452452 a. the board of county commissioners may determine, by
453453 resolution, a maximum speed limit which shall apply to
454454 all county roads which are not otherwise posted for
455455 speed,
456456 b. the board of county commissioners shall provide public
457457 notice of the speed limit on all nonposted roads by
458458 publication in a newspaper of general ci rculation in
459459 the county. The notice shall be published once weekly
460460 for a period of four (4) continuous weeks, and
461461 c. the board of county commissioners shall forward the
462462 resolution to the Di rector of the Department and to
463463 the Commissioner of Public Safety.

515515 2. The Department shall post speed limit information, as
516516 determined pursuant to the provisions of subparagraphs a through c
517517 of paragraph 1 of this subsection, on the county line marker whe re
518518 any state highway enters a county and at all off -ramps where
519519 interstate highways or turnpikes enter a county. The signs shall
520520 read as follows:

525525 The appropriate board of county commissioners shall reimburse
526526 the Department the full cost of the signage required herein.
527527 G. Any person convicted of a speeding violation pursuant to
528528 subsection B or F of this section shall be punished by a fine as
529529 follows:
530530 1. One to ten miles p er hour over the speed limit as provided
531531 for in Section 11-801e of this title,
532532 2. Eleven to fifteen miles per hour over the
533533 limit................................ ...................... $20.00
534534 3. Sixteen to twenty miles per hour over the

536536 4. Twenty-one to twenty-five miles per hour over

599599 conviction, by imprisonment for not more than six (6) mon ths, or by
600600 both such fine and imprisonment.
601601 SECTION 2. This act shall become effective November 1, 2024.
