77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 47 O.S. 2021, Section 11 -801, is
79	79	amended to read as follows:
80	80	Section 11-801. A. Any person driving a vehicle on a highway
81	81	shall drive the same at a careful and prudent speed not greater than
82	82	nor less than is reasonable and proper, having due regard to the
83	83	traffic, surface and width of the highway and any other conditions
84	84	then existing. No person shall drive any vehicle upon a highway at
85	85	a speed greater than will permit the driver to bring it to a stop
86	86	within the assured clear distance ahead.
87	87	B. Except when a special hazard exists that requires lower
88	88	speed for compliance with subsection A of this section, the limits

140	140	specified by law or established as hereinafter authorized shall be
141	141	maximum lawful speeds, and no person shall drive a vehicle on a
142	142	highway at a speed in excess of the following maximum limits:
143	143	1. On a highway or p art of a highway, unless otherwise
144	144	established in law, a speed established by the Department of
145	145	Transportation on the basis of engineering and traffic
146	146	investigations used to determine the speed that is reasonable and
147	147	safe under the conditions found to exis t on the highway or part of
148	148	the highway;
149	149	2. For a school bus, fifty -five (55) miles per hour on paved
150	150	two-lane roads except on the state highway system, the interstate
151	151	highway system and the turnpike system where the maximum shall be
152	152	sixty-five (65) miles per hour;
153	153	3. On any highway outside of a municipality in a properly
154	154	marked school zone, twenty-five (25) miles per hour, provided the
155	155	zone is marked with appropriate warning signs pl aced in accordance
156	156	with the latest edition of the Manual on Uniform Traf fic Control
157	157	Devices. The Department of Transportation may determine on the
158	158	basis of an engineering and traffic investigation that a speed limit
159	159	higher than twenty-five (25) miles per hour may be reasonable and
160	160	safe under conditions as they exist upon a hi ghway, and post an
161	161	alternative school zone speed limit. The Department shall mark such
162	162	school zones, or entrances and exits onto highways by buses or
163	163	students, so that the maximum spe ed provided by this section shall

215	215	be established therein. Exits and ent rances to controlled-access
216	216	highways which are within such school zones shall be marked in the
217	217	same manner as other highways. The county commissioners shall mark
218	218	such school zones alo ng the county roads so that the maximum speed
219	219	provided by this section s hall be established therein. The signs
220	220	may be either permanent or temporary. The Department shall give
221	221	priority over all other signing projects to the foregoing duty to
222	222	mark school zones. The Department shall also provide other safety
223	223	devices for school zones which are needed in the opinion of the
224	224	Department;
225	225	4. Twenty-five (25) miles per hour or a posted alternative
226	226	school zone speed limit through state schools located on the state -
227	227	owned land adjoining or outside the limits of a corporate city or
228	228	town where a state educational institution is established;
229	229	5. Thirty-five (35) miles per hour on a highway in any state
230	230	park or wildlife refuge. Provided, however, that the provisions of
231	231	this paragraph shall not include the State Capitol park area, and no
232	232	person shall drive any vehicle at a rate of speed in excess of
233	233	fifty-five (55) miles per hour on any state or federal designated
234	234	highway within such areas; and
235	235	6. For any vehicle or comb ination of vehicles with solid rubber
236	236	or metal tires, ten (10) miles per hour.
237	237	The maximum speed limits set forth in this section may be
238	238	altered as authorized in Sections 11 -802 and 11-803 of this title.

290	290	C. The Commission is hereby authorized to prescribe maximum and
291	291	minimum speeds for all vehicles and any combinations of veh icles
292	292	using controlled-access highways. Such regulations shall become
293	293	effective after signs have been posted on these highways giving
294	294	notice thereof. Such regulations may apply to an entirely
295	295	controlled-access highway or to selected sections thereof as m ay be
296	296	designated by the Commission. A minimum speed limit of sixty-five
297	297	(65) miles per hour and a maximum speed limit of seventy -five (75)
298	298	miles per hour may be set in locations comprising rural segments of
299	299	the interstate highway system by the Commiss ion; provided, however,
300	300	that speed is determined to be safe and reasonable after a traffic
301	301	or engineering study has been completed by the Department. It shall
302	302	be a violation of this section to drive any vehicle at a faster rate
303	303	of speed than such prescrib ed maximum or at a slower rate of speed
304	304	than such prescribed minimum. However, all vehicles shall at all
305	305	times conform to the limits set forth in subsection A of this
306	306	section.
307	307	Copies of such regulations certified as in effect on any
308	308	particular date by the Secretary of the Commission shall be accepted
309	309	as evidence in any court in this state. Whenever changes have been
310	310	made in speed zones, copies of such regulations shall be filed with
311	311	the Commissioner of Public Safety.
312	312	D. The Oklahoma Turnpike Authority is hereby authorized to
313	313	prescribe maximum and minimum speeds for trucks, buses and

365	365	automobiles using turnpikes; provided, however, a minimum speed
366	366	limit of sixty-five (65) miles per hour and a maximum speed limit of
367	367	eighty (80) miles per hour may be set in loc ations comprising the
368	368	turnpike system, as may be approved by the A uthority. The
369	369	regulation pertaining to automobiles shall apply to all vehicles not
370	370	commonly classified as either trucks or buses. Such regulations
371	371	shall become effective only after approva l by the Commissioner of
372	372	Public Safety, and after signs have been posted on the turnpike
373	373	giving notice thereof. Such regulations may apply to an entire
374	374	turnpike project or to selected sections thereof as may be
375	375	designated by the Oklahoma Turnpike Authorit y. It shall be a
376	376	violation of this section to drive a vehicle at a faster rate of
377	377	speed than such prescribed maximum speed or at a slower rate of
378	378	speed than such prescribed minimum speed. However, all vehicles
379	379	shall at all times conform to the requiremen ts of subsection A of
380	380	this section.
381	381	Copies of such regulations, ce rtified as in effect on any
382	382	particular date by the Secretary of the Oklahoma Turnpike Authority,
383	383	shall be accepted in evidence in any court in this state.
384	384	E. The driver of every vehicle sha ll, consistent with the
385	385	requirements of subsection A of this secti on, drive at an
386	386	appropriate reduced speed when approaching and crossing an
387	387	intersection or railway grade crossing, when approaching and going
388	388	around a curve, when approaching a hillcrest, wh en driving upon any

440	440	narrow or winding roadway, and when special ha zard exists with
441	441	respect to pedestrians or other traffic, or by reason of weather or
442	442	highway conditions. The Oklahoma Department of Transportation and
443	443	the Oklahoma Turnpike Authority may po st, by changeable message sign
444	444	or other appropriate sign, a tempor ary reduced speed limit for
445	445	maintenance operations or when special hazards with respect to
446	446	pedestrians, other traffic, an accident, by reason of weather or
447	447	when other hazardous highway condi tions exist.
448	448	F. 1. No person shall drive a vehicle on a county r oad at a
449	449	speed in excess of fifty -five (55) miles per hour unless posted
450	450	otherwise by the board of county commissioners, as provided in
451	451	subparagraphs a through c of this paragraph, as follow s:
452	452	a. the board of county commissioners may determine, by
453	453	resolution, a maximum speed limit which shall apply to
454	454	all county roads which are not otherwise posted for
455	455	speed,
456	456	b. the board of county commissioners shall provide public
457	457	notice of the speed limit on all nonposted roads by
458	458	publication in a newspaper of general ci rculation in
459	459	the county. The notice shall be published once weekly
460	460	for a period of four (4) continuous weeks, and
461	461	c. the board of county commissioners shall forward the
462	462	resolution to the Di rector of the Department and to
463	463	the Commissioner of Public Safety.

516	516	determined pursuant to the provisions of subparagraphs a through c
517	517	of paragraph 1 of this subsection, on the county line marker whe re
518	518	any state highway enters a county and at all off -ramps where
519	519	interstate highways or turnpikes enter a county. The signs shall
520	520	read as follows:

525	525	The appropriate board of county commissioners shall reimburse
526	526	the Department the full cost of the signage required herein.
527	527	G. Any person convicted of a speeding violation pursuant to
528	528	subsection B or F of this section shall be punished by a fine as
529	529	follows:
530	530	1. One to ten miles p er hour over the speed limit as provided
531	531	for in Section 11-801e of this title,
532	532	2. Eleven to fifteen miles per hour over the
533	533	limit................................ ...................... $20.00
534	534	3. Sixteen to twenty miles per hour over the
535	535	limit................................ ...................... $35.00
536	536	4. Twenty-one to twenty-five miles per hour over
