65	65	An Act relating to student transfers; amending 70
66	66	O.S. 2021, Section 8-101.1, which relates to the
67	67	Education Open Transfer Act; updating statutory
68	68	citations; adding new section to Act applicability;
69	69	authorizing students who attend a certain school to
70	70	transfer to another school within the resident
71	71	district; requiring district to accept transfer
72	72	regardless of capacity; prohibiting transfer in
73	73	certain instances; providing for codification;
74	74	providing an effective date; and declaring an
75	75	emergency.

81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY 70 O.S. 2021, Section 8 -101.1, is
83	83	amended to read as follows:
84	84	Section 8-101.1 Sections 20 8-101.2 through 29 8-113, 9-101,
85	85	13-101, 13-103, and 18-110 of this act title and Section 2 of this
86	86	act shall be known and may be cited as the "Education Open Transfer
87	87	Act".
88	88	SECTION 2. NEW LAW A new section of law to be codified
89	89	in the Oklahoma Statutes as Section 8-114 of Title 70, unless there
90	90	is created a duplication in numbering, reads as foll ows:

142	142	A. Any student who attends a school that is identified in the
143	143	bottom five percent (5%) of schools in the state, may transfer to
144	144	another school within his or her resident school district that
145	145	offers the grade the student is en titled to pursue, regardless of
146	146	the posted transfer capacity of the school .
147	147	B. A student forfeits his or her right to a transfer pursuant
148	148	to this section if the student:
149	149	1. Is found guilty of the acts and reasons outlined in Section
150	150	24-101.3 of Title 70 of the Oklahoma Statutes that are described as
151	151	bases for denial of a transfer under paragraph 1 of su bsection B of
152	152	Section 8-101.2 of Title 70 of the Oklah oma Statutes; or
153	153	2. Has a history of absences as define d in paragraph 2 of
154	154	subsection B of Section 8 -101.2 of Title 70 of the Oklahoma
155	155	Statutes.
156	156	SECTION 3. This act shall become effect ive July 1, 2024.
157	157	SECTION 4. It being immediately necessary for the preservation
158	158	of the public peace, health or safety, an emergency is hereby
159	159	declared to exist, b y reason whereof thi s act shall take effect and
160	160	be in full force from and af ter its passage and approval.
