83	83	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
84	84	SECTION 1. NEW LAW A new section of law to be codified
85	85	in the Oklahoma Statutes as Section 26-201 of Title 70, unless there
86	86	is created a duplication in numbering, re ads as follows:
87	87	A. There is hereby cr eated the Educators' Professional
88	88	Liability Insurance Program for all employees, including full -time
89	89	and part-time personnel of pu blic schools, as defined in Section 1 -
90	90	106 of Title 70 of the Oklahoma Statutes, and char ter schools, as

144	144	B. The program shall provide liability coverage for employees
145	145	up to Two Million Dollars ($2,000,000.00) in coverage per
146	146	occurrence.
147	147	C. The program shall be ad ministered by the Office of
148	148	Management and Enterprise Services (OMES). OMES shall promulgate
149	149	rules to implement the Educators' Professional Liability Insurance
150	150	Program.
151	151	D. OMES shall be authoriz ed to contract liability insurance
152	152	from a licensed insurer, to create a self-insured risk pool, or to
153	153	use a combination of both.
154	154	E. The insurance carrier providing any portion of liability
155	155	coverage required by this section shall be selected by a competitive
156	156	process.
157	157	F. The Legislature shall provide an annual appr opriation to
158	158	cover the costs and any as sociated premiums for the program.
159	159	G. Each school district shall annually notify, in writing,
160	160	eligible employees about the coverage provided by the Educators '
161	161	Professional Liability Insurance Program.
162	162	H. OMES and the State Department of Education shall n otify, in
163	163	writing, all eligible employees about the Educators ' Professional
164	164	Liability Insurance Program. The notice shall specifically inform
165	165	employees that coverage is provi ded automatically as part of their

219	219	I. Nothing in this section shall be construed to exempt a
220	220	school district from any current obligations or duties nor amend or
221	221	alter the Governmental Tort Claims Act in Sections 151 throug h 172
222	222	of Title 51 of the Oklahoma Stat utes.
223	223	SECTION 2. This act shall become effective November 1, 2024.
