77	77	BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 36 O.S. 2021, Section 6060, as
79	79	amended by Section 1, Chapter 294, O.S.L. 2022 (36 O.S. Supp. 2023,
80	80	Section 6060), is amended to read as follows :
81	81	Section 36-6060. A. For the purposes of this section :
82	82	1. "Breast magnetic resonance imagi ng" means a diagnostic tool
83	83	used to produce detailed pictures of the structure of the breast;
84	84	2. "Breast tomosynthesis" means a radiologic mammography
85	85	procedure involving the acquisition of projection images over a
86	86	stationary breast to produce cross-sectional digital three-
87	87	dimensional images of the breast from which breast cancer screen ing
88	88	diagnoses may be made;

140	140	2. 3. "Breast ultrasound" means a noninvasive, diagnostic
141	141	imaging technique that uses high-frequency sound waves to pro duce
142	142	detailed images of the breast;
143	143	3. 4. "Diagnostic examination for breast cancer" means a
144	144	medically necessary and clinically appropriate examination, as
145	145	defined by current guidelines and as determined by a clinician who
146	146	is evaluating the individual for breast cancer, to evaluate the
147	147	abnormality in the breast that is:
148	148	a. seen or suspected from a screening examination for
149	149	breast cancer,
150	150	b. detected by another means of examination, or
151	151	c. suspected based on the medical history o r family
152	152	medical history of the indi vidual.
153	153	This examination may include, but is not limited to, a
154	154	diagnostic mammogram, breast magnetic resonance imaging, or a breast
155	155	ultrasound;
156	156	4. 5. "Diagnostic mammography" means a diagnostic tool that:
157	157	a. uses X-ray, and
158	158	b. is designed to evaluate abnormality in a breast;
159	159	5. 6. "Health benefit plan" means any plan or arrangement as
160	160	defined in subsection C of Section 6060.4 of this title;
161	161	6. 7. "Low-dose mammography" means:
162	162	a. the X-ray examination of the breast using equ ipment
163	163	specifically dedicated for suc h purpose, with an

219	219	7. "Breast tomosynthesis" means a radiologic mammography
220	220	procedure involving the acquisition of projection images over a
221	221	stationary breast to produce cross-sectional digital three-
222	222	dimensional images of the breast from which breast cancer screen ing
223	223	diagnoses may be made; and
224	224	8. "Screening mammography" means a radiologic procedure
225	225	provided to a woman, who has no signs or symptoms of breast cancer,
226	226	for the purpose of early detection of breast cancer, including
227	227	breast tomosynthesis .; and
228	228	9. "Supplemental breast examinations" means a medically
229	229	necessary and clinically appropriate examination of the b reast,
230	230	including but not limited to, as examination using contrast -enhanced
231	231	mammography, diagnostic mammography, breast magnetic resonance
232	232	imaging, or breast ultrasound that is:
233	233	a. used to screen for breast cancer when there is no
234	234	abnormality seen or suspe cted, and
235	235	b. based on personal or family medical history, or
236	236	additional factors that may increase the individual 's
237	237	risk of breast cancer.

289	289	B. All health benefit plans shall include the coverage
290	290	specified by this section for a low -dose mammography screening for
291	291	the presence of occult breast cancer and a diagnostic examination
292	292	for breast cancer. Such coverage shall not:
293	293	1. Be subject to the policy deductib le, co-payments and co-
294	294	insurance limits of the plan; or
295	295	2. Require that a female undergo a mammography screening at a
296	296	specified time as a conditi on of payment.
297	297	C. 1. Any female thirty-five (35) through thirty-nine (39)
298	298	years of age shall be entitled pur suant to the provisions of this
299	299	section to coverage for a low-dose mammography screening once every
300	300	five (5) years.
301	301	2. Any female forty (40) ye ars of age or older shall be
302	302	entitled pursuant to the provisions of this section to coverage for
303	303	an annual low-dose mammography screening.
304	304	D. If application of this act would result in health savings
305	305	account ineligibility under Section 223 of the federal Internal
306	306	Revenue Code, as amended, the pro visions of this section shall only
307	307	apply to health savings accounts wi th qualified high-deductible
308	308	health plans with respect to the deductible of such a plan after the
309	309	enrollee has satisfied the minimum deductible. Provided, however,
310	310	the provisions of thi s section shall apply to items of services that
311	311	are preventive care pursuant to Section 223(c)(2)(c) of the federal
