7777 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 36 O.S. 2021, Section 6060, as
7979 amended by Section 1, Chapter 294, O.S.L. 2022 (36 O.S. Supp. 2023,
8080 Section 6060), is amended to read as follows :
8181 Section 36-6060. A. For the purposes of this section :
8282 1. "Breast magnetic resonance imagi ng" means a diagnostic tool
8383 used to produce detailed pictures of the structure of the breast;
8484 2. "Breast tomosynthesis" means a radiologic mammography
8585 procedure involving the acquisition of projection images over a
8686 stationary breast to produce cross-sectional digital three-
8787 dimensional images of the breast from which breast cancer screen ing

140140 2. 3. "Breast ultrasound" means a noninvasive, diagnostic
141141 imaging technique that uses high-frequency sound waves to pro duce
142142 detailed images of the breast;
143143 3. 4. "Diagnostic examination for breast cancer" means a
144144 medically necessary and clinically appropriate examination, as
145145 defined by current guidelines and as determined by a clinician who
146146 is evaluating the individual for breast cancer, to evaluate the
147147 abnormality in the breast that is:
148148 a. seen or suspected from a screening examination for
149149 breast cancer,
150150 b. detected by another means of examination, or
151151 c. suspected based on the medical history o r family
152152 medical history of the indi vidual.
153153 This examination may include, but is not limited to, a
154154 diagnostic mammogram, breast magnetic resonance imaging, or a breast
155155 ultrasound;
156156 4. 5. "Diagnostic mammography" means a diagnostic tool that:
157157 a. uses X-ray, and
158158 b. is designed to evaluate abnormality in a breast;
159159 5. 6. "Health benefit plan" means any plan or arrangement as
160160 defined in subsection C of Section 6060.4 of this title;
161161 6. 7. "Low-dose mammography" means:
162162 a. the X-ray examination of the breast using equ ipment
163163 specifically dedicated for suc h purpose, with an

217217 b. digital mammography, or
218218 c. breast tomosynthesis;
219219 7. "Breast tomosynthesis" means a radiologic mammography
220220 procedure involving the acquisition of projection images over a
221221 stationary breast to produce cross-sectional digital three-
222222 dimensional images of the breast from which breast cancer screen ing
223223 diagnoses may be made; and
224224 8. "Screening mammography" means a radiologic procedure
225225 provided to a woman, who has no signs or symptoms of breast cancer,
226226 for the purpose of early detection of breast cancer, including
227227 breast tomosynthesis .; and
228228 9. "Supplemental breast examinations" means a medically
229229 necessary and clinically appropriate examination of the b reast,
230230 including but not limited to, as examination using contrast -enhanced
231231 mammography, diagnostic mammography, breast magnetic resonance
232232 imaging, or breast ultrasound that is:
233233 a. used to screen for breast cancer when there is no
234234 abnormality seen or suspe cted, and
235235 b. based on personal or family medical history, or
236236 additional factors that may increase the individual 's
237237 risk of breast cancer.

289289 B. All health benefit plans shall include the coverage
290290 specified by this section for a low -dose mammography screening for
291291 the presence of occult breast cancer and a diagnostic examination
292292 for breast cancer. Such coverage shall not:
293293 1. Be subject to the policy deductib le, co-payments and co-
294294 insurance limits of the plan; or
295295 2. Require that a female undergo a mammography screening at a
296296 specified time as a conditi on of payment.
297297 C. 1. Any female thirty-five (35) through thirty-nine (39)
298298 years of age shall be entitled pur suant to the provisions of this
299299 section to coverage for a low-dose mammography screening once every
300300 five (5) years.
301301 2. Any female forty (40) ye ars of age or older shall be
302302 entitled pursuant to the provisions of this section to coverage for
303303 an annual low-dose mammography screening.
304304 D. If application of this act would result in health savings
305305 account ineligibility under Section 223 of the federal Internal
306306 Revenue Code, as amended, the pro visions of this section shall only
307307 apply to health savings accounts wi th qualified high-deductible
308308 health plans with respect to the deductible of such a plan after the
309309 enrollee has satisfied the minimum deductible. Provided, however,
310310 the provisions of thi s section shall apply to items of services that
311311 are preventive care pursuant to Section 223(c)(2)(c) of the federal

365365 SECTION 2. This act shall become effective November 1, 2024.
