51	73		approving grant amounts; stipulating a dditional
52	74		reimbursable services; extending time period of
53	75		certain services; including the State Department of
54	76		Mental Health and Substance Abuse S ervices; amending
55	77		63 O.S. 2021, Section 1 -740.18, which relates to
56	78		grant compliance and monitoring; conforming language;
57	79		providing an effective date ; and declaring an

65	87		BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:
66	88		SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -740.16, is
67	89		amended to read as follows:
68	90		Section 1-740.16 As used in the Choosing Childbirth Act:
69	91		1. "Abortion" means the use or prescription of any instrument,
70	92		medicine, drug or any other substance or device to intentionally:

98	144		a. kill the unborn child of a woman known to be pregnant,
99	145		or
100	146		b. terminate the pregnancy of a woman known to be
101	147		pregnant, with an intention other than:
102	148		(1) after viability of the unborn child, to produce a
103	149		live birth and preserve the life and health of
104	150		the child born alive , or
105	151		(2) to remove a dead unborn child;
106	152		2. "Unborn child" means an individual organism of the species
107	153		Homo sapiens from fertilization until birth; and
108	154		3. "Grant-supervising entity" means a private entity which
109	155		approves all grants made under the Choosing Childbirth Act that are
110	156		not directly made to private organizations by the State Department
111	157		of Health for reimbursement of services provided under the Choosing
112	158		Childbirth Act and which:
113	159		a. is organized as a not-for-profit corporation in
114	160		Oklahoma this state and as a 501(c)3 entity under the
115	161		federal Internal Revenue Code, and
116	162		b. does not encourage or counsel any woman to have an
117	163		abortion not necessary to prevent her death, to
118	164		provide her such an abortion or to r efer her for such
119	165		an abortion, and does not accept funds or services
120	166		knowingly from any entity which performs abortions or
121	167		receives money for abortions.

149	219		SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -740.17, is
150	220		amended to read as follo ws:
151	221		Section 1-740.17 A. The State Department of Health and the
152	222		Oklahoma Department of Mental Health and Substance Abuse Services
153	223		shall make grants, as directed in subsection B of this section, from
154	224		funds appropriated by the Legislature specifically for this purpose,
155	225		to a grant-supervising entity for the purpose of reimbursing for the
156	226		Choosing Childbirth Act.
157	227		B. The purpose of the grants shall be to reimburse private
158	228		organizations in Oklahoma this state for the reasonable expenses of
159	229		programs providing the following services listed in subsection C of
160	230		this section. The Depar tments shall make grants either:
161	231		1. Directly to the private organizations;
162	232		2. To one or more grant -supervising entities, who shall
163	233		reimburse the private organizations; or
164	234		3. Both directly to the private organizations and to one or
165	235		more grant-supervising entities, who shall reimburse the private
166	236		organizations.
167	237		C. Reimbursable services provided under the Choosing Childbirth
168	238		Act shall include:
169	239		1. Providing information on, referral to and assistance in
170	240		securing the services of relevant existing programs or agencies that
171	241		assist women in Oklahoma this state to carry their children to term,
172	242		and/or providing services that assist women to carry their children

200	294		to term including, but not limited to, agencies and programs that
201	295		will provide:
202	296		a. medical attention for the pregnant woman for the
203	297		duration of her pregnancy including, but not limited
204	298		to, obstetric ultrasounds,
205	299		b. mental health and substance abuse services,
206	300		c. nutritional support services,
207	301		d. housing assistance,
208	302		e. transportation assistance,
209	303		f. adoption services,
210	304		g. education and employment assistance , and
211	305		h. parenting education and support services;
212	306		2. Providing women in Oklahoma this state, in person and
213	307		through community outreach, informa tion and/or services that
214	308		encourage and assist them to carry their children to term; and
215	309		3. Providing services including, but not limited to, healthcar e
216	310		services to mothers and infants up to three (3) years postpartum for
217	311		the purpose of reducing the rates of maternal mortality and infant
218	312		mortality in this state by three percent (3%) within five (5) years
219	313		of the effective date of this act not later than July 1, 2026;
220	314		provided, however, no funds shall be provided to an organization
221	315		that provides, or whose affiliates provide, abortion services.
222	316		B. D. To be eligible for a service grant, an organization
223	317		shall:

251	369		1. Be registered with the Oklahoma Secretary of State as a not-
252	370		for-profit corporation located in Oklahoma or be a certified
253	371		treatment provider by the Oklahoma Department of Mental Health and
254	372		Substance Abuse Services.;
255	373		2. Have the grant amount approved by a:
256	374		a. the grant-supervising entity, if the grant was
257	375		provided to the private organization by a grant -
258	376		supervising entity, or
259	377		b. if the grant was provided directly, by the State
260	378		Department of Health or the Oklahoma Depart ment of
261	379		Mental Health and Substance Abuse Services ;
262	380		3. For services described in p aragraphs 1 and 2 of subsection A
263	381		C of this section, provide each pregnant woman counseled with
264	382		accurate information on the developmental characteristics of unborn
265	383		children including offering the printed information described in
266	384		Section 1-738.3 of Title 63 of the Oklahoma Statutes;
267	385		4. Assure that the grant 's sole purposes are to assist and
268	386		encourage women to carry their children to term and to maximize
269	387		their potentials there after as provided in paragraphs 1 and 2 of
270	388		subsection C of this section or to reduce the rates of maternal
271	389		mortality and infant mortality in this state as provided in
272	390		paragraph 3 of subsection A C of this section; and
273	391		5. Assure that none of the funds prov ided pursuant to the
274	392		Choosing Childbirth Act, nor any other funds or services provi ded by

302	444		the organization, are used to encourage or counsel a woman to have
303	445		an abortion not necessary to prevent her death, to provide her such
304	446		an abortion or to refer her for such an abortion.
305	447		SECTION 3. AMENDATORY 63 O.S. 2021, Section 1 -740.18, is
306	448		amended to read as follows:
307	449		Section 1-740.18 The State Department of Health shall make
308	450		grants to a grant-supervising entity under the Choosing Childbirth
309	451		Act from funds appropriated by the Legislature specifically for this
310	452		purpose. The State Department of He alth shall annually monitor and
311	453		review the any grant-supervising entity participating in the
312	454		Choosing Childbirth act and any private organization dire ctly
313	455		receiving a service grant from the Department to assure ensure that
314	456		the grant-supervising entity or private organization carefully
315	457		adheres to the purposes and requirements of the Cho osing Childbirth
316	458		Act, and it. The Department shall cease funding a g rant-supervising
317	459		entity or private organization that fails to do so adhere to such
318	460		purposes and requirements if the Department proves specific findings
319	461		of noncompliance, subject to judicia l review.
320	462		SECTION 4. This act shall become effectiv e July 1, 2024.
321	463		SECTION 5. It being immediately necessary for the preservation
322	464		of the public peace, health or safety, an emergency is hereby
323	465		declared to exist, by reason whereof thi s act shall take effect and
