8181 BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new sec tion of law to be codified
8383 in the Oklahoma Statutes as Section 81.2 of Title 74, unless there
8484 is created a duplication in numberi ng, reads as follows:
8585 A. This act shall be known and may be cited as the "Pretrial
8686 Data Collection Act".
8787 B. As used in this act:
8888 1. "Annual felony caseload" means the yearly caseload of felony
8989 cases for each full-time district attorney and assistant district

143143 criminal division. Annual felony caseload does not include the
144144 appellate caseload of a public defender, assistant public defender ,
145145 or indigent defense contracting attorney. Cases reported pursuant
146146 to this paragraph shall be associated with a case n umber and each
147147 case number shall only be reported onc e regardless of the number of
148148 attorney assignments that occur during the course of litigation ;
149149 2. "Annual misdemeanor caseload" means the yearly caseload of
150150 misdemeanor cases for each full -time district attorney and assistant
151151 district attorney or public def ender and assistant public defender,
152152 or indigent defense contracting attorney for cases assign ed to the
153153 criminal division. Annual misdemeanor caseload does not include the
154154 appellate caseload of a publi c defender, assistant public defender,
155155 or indigent defense contracting att orney. Cases reported pursuant
156156 to this paragraph shall be associated with a case number and each
157157 case number shall only be reported once regardless of the number of
158158 attorney assignments that occur during t he course of litigation;
159159 3. "Attorney assignment date" means the day, month, and year a
160160 court-appointed attorney is assigned to the case or, if priv ately
161161 retained, the day, month, and year an attorney files a notice of
162162 appearance with the clerk of the court;
163163 4. "Attorney withdrawal date" means the day, month , and year
164164 the court removes cour t-appointed counsel from a case or, if

218218 5. "Average cost for jail stay" means the average daily cost to
219219 house an inmate including, but not limited to, average medi cal care
220220 costs, daily stay fee, extra food, and transportation ;
221221 6. "Bail" means a monetary amount for or condition of pretrial
222222 release from custody. The purpose of the bail is to ensure the
223223 return of the accused at subsequent procee dings;
224224 7. "Case number" means the identification number assigned by
225225 the clerk of the court to a criminal case;
226226 8. "Case status" means whether a case is open, inactive ,
227227 closed, or reopened d ue to a violation of probation or community
228228 supervision;
229229 9. "Charge description" means the statement of the conduct that
230230 is alleged to have been viola ted, the associated statutory section
231231 establishing such conduct as criminal, and t he misdemeanor or felon y
232232 classification that is provided for in the statutory section alleged
233233 to have been violated;
234234 10. "Charge modifier" means an aggravating circumstance of an
235235 alleged crime that enhances or reclassifies a charge to a more
236236 serious misdemeanor or felony offense ;
237237 11. "Cited offense" means the alleged offense for which an
238238 arrest occurred, includ ing the state or municipal code under which
239239 the offense is allege d;

291291 12. "Criminal charge against" means information related to the
292292 formal charges filed against a defenda nt, including charge
293293 description, as defined in this section, code section, jurisdictio n,
294294 and charge modifier, as defined in this section, if applicabl e;
295295 13. "Date of arrest" means the day, month, and year the arrest
296296 occurred;
297297 14. "Date of entrance" means the day, month, and year of
298298 entrance into a county jail or detention fa cility;
299299 15. "Demographic information" means identifying information
300300 including name, age, race and ethnicity, gender, ZIP Code of primary
301301 residence, and homeles sness status;
302302 16. "Disposition" means a final judgment, adjudication
303303 withheld, dismissal, or nolle prosequi for the case;
304304 17. "Domestic abuse flag" means an indication that a charge
305305 involves domestic abuse, as such term is defined in subsection C of
306306 Section 644 of Title 21 of the Oklahoma Statutes ;
307307 18. "Gang affiliation flag" means an indication that a
308308 defendant is involved in or associated w ith a criminal street gang,
309309 as such term is defined in subsection F of Section 856 of Title 21
310310 of the Oklahoma Statutes;
311311 19. "Habitual offender flag" means an indication that the
312312 defendant is a repeat offender pursuan t to the provisions of Section
313313 51.1 of Title 21 of the Oklahoma Statutes;

365365 20. "Inventory search" means a search performed in accordance
366366 with law enforcement department policy on a person or a vehicle
367367 incident to lawful arrest ;
368368 21. "Mental health disorder" means any mental illness, as
369369 defined in paragraph 3 of Section 1-103 of Title 43A of the Oklahoma
370370 Statutes, that was diagnosed by a licensed mental health
371371 professional, as defined in paragraph 11 of Section 1 -103 of Title
372372 43A of the Oklahoma Statutes;
373373 22. "Offense location" means the county in which the offense is
374374 alleged to have occurred;
375375 23. "Operational capacity" means the maximum number of inmates
376376 a county jail or detention facilit y can hold;
377377 24. "Pretrial release violation flag" means an indication that
378378 the defendant has violated the terms of his or her pretrial rel ease;
379379 25. "Release date" means the day, month, and year a defendant
380380 is released from a county jail or deten tion facility; and
381381 26. "Term of sentence" means the sentence type and length
382382 imposed by the court including, but not limited to, the total
383383 duration of imprisonment in a county jail or detention facility and
384384 conditions of probatio n or community control sup ervision.
385385 C. Beginning January 1, 202 5, an entity required to collect
386386 data in accordance with the provisions of this act shall collect the
387387 specified data required of the entity on a monthly basis. Each

440440 and Enterprise Services on a monthly basis.
441441 1. Municipal police departments and county sheriff offices
442442 shall collect for each individual arrested the following
443443 information:
444444 a. arrest location,
445445 b. date of arrest,
446446 c. race and ethnicity of detainee,
447447 d. age of detainee,
448448 e. gender of detainee,
449449 f. ZIP Code of detainee,
450450 g. cited offense, and
451451 h. inventory performed.
452452 2. County jail and county detention facilities shall collect
453453 for each confined person the following informat ion:
454454 a. date of entrance,
455455 b. name,
456456 c. date of birth,
457457 d. gender,
458458 e. race and ethnicity,
459459 f. mental health disorder, if any ,
460460 g. last-known ZIP Code,
461461 h. homelessness status,

519519 3. Each county jail and county de tention facility shall collect
520520 the following information:
521521 a. average costs for jail stay per day for a confined
522522 person,
523523 b. average medical care costs for a confined person,
524524 c. daily stay fee and rate for a confined person ,
525525 d. bill for medical costs for all confined persons ,
526526 e. bill for extra food for all confined persons,
527527 f. bill for transportati on for all confined persons ,
528528 g. operational capacity of the county jail and county
529529 detention facility,
530530 h. for each confined person, counting only one time , and
531531 with accompanying demographic information:
532532 (1) the number of sentenced confined people,
533533 (2) the number of unsentenced confined people with a
534534 hold and what kind of hold each unsentenced
535535 person has including, but not limited to, tribal

595595 (1) the number of unsentenced confined peop le whose
596596 most serious charged offense is a felony, and
597597 (2) the number of unsentenced confined people whose
598598 most serious charged offense is a misde meanor,
599599 j. number of confined people held solely for a municipal
600600 offense with accompanying demographic informa tion,
601601 k. average daily population of the jail facility with
602602 accompanying demographic information,
603603 l. average or median length of stay with accompa nying
604604 demographic information:
605605 (1) number of people who were released within the
606606 prior twelve (12) months whose most serious
607607 offense was a felony, and
608608 (2) number of people who were released within the
609609 prior twelve (12) months whose most serious
610610 offense was a misdemeanor,

666666 4. District court clerks shall collect the following

670670 c. county of alleged offense,
671671 d. date that the criminal prosecution of a defendant is
672672 formally initiated through the filing, with the clerk
673673 of the court, of an informat ion by the district
674674 attorney,
675675 e. arraignment date,
676676 f. attorney assignment date ,
677677 g. attorney withdrawal date , if applicable,
678678 h. case status,
679679 i. disposition date and kind of disposition,
680680 j. ZIP Code of primary residence of the defendant,
681681 k. primary language spoken by the defendant,
682682 l. indigency finding,
683683 m. charge description,
684684 n. statute charged under,
685685 o. sentence enhancement charged, if any ,

886886 5. From each office of the district attorney in the twenty-
887887 seven (27) prosecutorial districts of Oklahoma, the following
888888 information shall be collected:
889889 a. number of full-time prosecutors,
890890 b. number of part-time prosecutors,
891891 c. race, ethnicity, and gender of prosecutors,
892892 d. annual felony caseload,
893893 e. annual misdemeanor caseload,
894894 f. number of cases in which an information was not filed,
895895 g. number of cases declined , and
896896 h. for individual cases:
897897 (1) whether the defendant received an offer to
898898 participate in a diversion program,
899899 (2) name of diversion program, if offered,
900900 (3) whether the defendant accepted or declined the
901901 diversion program,
902902 (4) diversion program outcome ,
903903 (5) pretrial release recommendation of the
904904 prosecutor,
905905 (6) bail amount recommendation of the prosecutor by
906906 misdemeanor and felony charge types, and
907907 (7) plea offers by the prosecutor, if any, and
908908 modifications.

960960 6. From the Office of the Tulsa County Public Defender , the
961961 Office of the Oklahoma County Public Defender, and each contractor
962962 of the Oklahoma Indigent Defense System :
963963 a. number of full-time public defenders,
964964 b. number of part-time public defenders,
965965 c. number of contract attorneys representing indigent
966966 defendants for the office,
967967 d. annual felony caseload , and
968968 e. annual misdemeanor ca seload.
969969 D. The Office of Management and Enterprise Services shall
970970 publish datasets in its possession in a modern, open, electronic
971971 format that is machine -readable and readily accessible by the public
972972 on the website of the Office. The published data shall be
973973 searchable, at a minimum, by each data element, county, circuit, a nd
974974 unique identifier. Agencies that employ five hundred (500) or more
975975 employees shall submit data to the Office by July 1, 2025. Agencies
976976 that employ more than one hundred (100) but less than five hundred
977977 (500) employees shall submit data to the Office by December 31,
978978 2025. Agencies with more than zero (0) and less than one hundred
979979 (100) employees shall submit data to the Office by July 1, 2026.
980980 E. Upon a determination by the Office of Management and
981981 Enterprise Services of noncompliance, any member of any board of
982982 county commissioners may bring an action in a district court having
983983 jurisdiction over the county from which the county commissioner
