4542 An Act relating to crimes and punishments; amending

5754 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5855 SECTION 1. AMENDATORY 21 O.S. 2021, Section 358, is
5956 amended to read as follows:
6057 Section 358. A. It shall be unlawful for any person, firm,
6158 corporation, association or agency to make, present, or cause to be
6259 presented to any employee or offi cer of the State of Oklahoma, or to
6360 any department or agency thereof, any false, fictitious , or
6461 fraudulent claim for payme nt of public funds upon or against the
6562 State of Oklahoma, or any department or agency thereof, knowing such
6663 claim to be false, fictitio us, or fraudulent. A violation of this

9490 subsection shall be punished as provided in subsection A of Section
9591 359 of this title.
9692 B. It shall be unlawful for any person applyin g for employment
9793 with the State of Oklahoma to make a materially false, fictitious ,
9894 or fraudulent statement or representation on an employment
9995 application, knowing such statement or representation to be
10096 materially false, fictitious, or fraudulent. A violation of this
10197 subsection shall be punished as provided in subsection B of Section
10298 359 of this title.
10399 C. It shall be unlawful for any person applying for employment
104100 with an employer other than the State of Oklahoma to make a
105101 materially false, fictitious, or fraudulent statement or
106102 representation on an employment application, knowing such statement
107103 or representation to be materially false, fictitious, or fraudulent.
108104 A violation of this subsection shall be punished as provided for in
109105 subsection C of Section 359 of this title.
110106 SECTION 2. AMENDATORY 21 O.S. 2021, Section 359, is
111107 amended to read as fo llows:
112108 Section 359. A. Any person, firm, corporation, association or
113109 agency found guilty of violating subsection A of Section 358 of this
114110 title shall be guilty of a felony punishable by a fine not exceeding
115111 Ten Thousand Dollars ($10,000.00), or by impri sonment in the custody
116112 of the Department of Corrections for a term not exceeding two (2)
117113 years, or by both such fine and imprisonment.

145140 B. Any person found guilty of violating subsection B of Section
146141 358 of this title shall be guilty of a misdemeanor punis hable by a
147142 fine not exceeding One Thousand Dollars ($1,000.00), or by
148143 imprisonment in the county jail for a term not exceeding one (1)
149144 year, or by both such fine and imprisonment.
150145 C. Any person found guilty of violating su bsection C of Section
151146 358 of this title shall pay a fine not exceeding One Thousand
152147 Dollars ($1,000.00) and shall have his or her name included on a
153148 registry administered and maintained by the Office of the Attorney
154149 General.
155150 SECTION 3. This act shall become effective November 1, 2024.
