45	42		An Act relating to crimes and punishments; amending
46	43		21 O.S. 2021, Sections 358 and 359, which relate to
47	44		fraudulent claims against the sta te; expanding scope
48	45		of certain unlawful acts; making certain acts
49	46		unlawful; providing penalties; providing for a
50	47		registry to be maintained by the Office of the
51	48		Attorney General and available for public inspection;

57	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
58	55		SECTION 1. AMENDATORY 21 O.S. 2021, Section 358, is
59	56		amended to read as follows:
60	57		Section 358. A. It shall be unlawful for any person, firm,
61	58		corporation, association or agency to make, present, or cause to be
62	59		presented to any employee or offi cer of the State of Oklahoma, or to
63	60		any department or agency thereof, any false, fictitious , or
64	61		fraudulent claim for payme nt of public funds upon or against the
65	62		State of Oklahoma, or any department or agency thereof, knowing such
66	63		claim to be false, fictitio us, or fraudulent. A violation of this

94	90		subsection shall be punished as provided in subsection A of Section
95	91		359 of this title.
96	92		B. It shall be unlawful for any person applyin g for employment
97	93		with the State of Oklahoma to make a materially false, fictitious ,
98	94		or fraudulent statement or representation on an employment
99	95		application, knowing such statement or representation to be
100	96		materially false, fictitious, or fraudulent. A violation of this
101	97		subsection shall be punished as provided in subsection B of Section
102	98		359 of this title.
103	99		C. It shall be unlawful for any person applying for employment
104	100		with an employer other than the State of Oklahoma to make a
105	101		materially false, fictitious, or fraudulent statement or
106	102		representation on an employment application, knowing such statement
107	103		or representation to be materially false, fictitious, or fraudulent.
108	104		A violation of this subsection shall be punished as provided for in
109	105		subsection C of Section 359 of this title.
110	106		SECTION 2. AMENDATORY 21 O.S. 2021, Section 359, is
111	107		amended to read as fo llows:
112	108		Section 359. A. Any person, firm, corporation, association or
113	109		agency found guilty of violating subsection A of Section 358 of this
114	110		title shall be guilty of a felony punishable by a fine not exceeding
115	111		Ten Thousand Dollars ($10,000.00), or by impri sonment in the custody
116	112		of the Department of Corrections for a term not exceeding two (2)
117	113		years, or by both such fine and imprisonment.

145	140		B. Any person found guilty of violating subsection B of Section
146	141		358 of this title shall be guilty of a misdemeanor punis hable by a
147	142		fine not exceeding One Thousand Dollars ($1,000.00), or by
148	143		imprisonment in the county jail for a term not exceeding one (1)
149	144		year, or by both such fine and imprisonment.
150	145		C. Any person found guilty of violating su bsection C of Section
151	146		358 of this title shall pay a fine not exceeding One Thousand
152	147		Dollars ($1,000.00) and shall have his or her name included on a
153	148		registry administered and maintained by the Office of the Attorney
154	149		General.
155	150		SECTION 3. This act shall become effective November 1, 2024.
