5350 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5451 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1533.1, is
5552 amended to read as follows:
5653 Section 1533.1 A. It is unlawful f or any person to willfully
5754 and with fraudulent intent obtain the name , address, Social Security
5855 number, date of birth, place of business or em ployment, debit,
5956 credit or account numbers, driver license number or any other
6057 personal identifying information of another person, living or dead,
6158 with intent to use, sell or allow an y other person to use or sel l
6259 such personal identifying information to ob tain or attempt to obtain
6360 money, credit, goods, property or service in the name of the other
6461 person without the co nsent of that person.

9288 B. It is unlawful for any person to use with f raudulent intent
9389 the personal identity of another person, living or dead, or any
9490 information relating t o the personal identity of another person,
9591 living or dead, to obtain or attempt to o btain credit or anything of
9692 value.
9793 C. It is unlawful for any person with fraudulent intent to
9894 lend, sell, or otherwise offer the use of such person's own name,
9995 address, Social Security number, date of birth or any other personal
10096 identifying information or document to any other person with the
10197 intent to allow such other per son to use the personal iden tifying
10298 information or document to obtain or attempt to obtain any
10399 identifying document in the name of such other person.
104100 D. It is unlawful for any person to willfully create, modify,
105101 alter or change any personal identifying in formation of another
106102 person with fraudulent intent to obtain any money, c redit, goods,
107103 property, service or any benefit or thing of value, or to control,
108104 use, waste, hinder or encumber an other person's credit, accounts,
109105 goods, property, title, interests, b enefits or entitlements with out
110106 the consent of that person.
111107 E. Any person convicted of violating any p rovision of this
112108 section shall be guilty of identity theft. Any person who violates
113109 the provisions of subsection A, B or D of this section shall, upon
114110 conviction, be guilty of a fe lony punishable by imprisonment in the
115111 custody of the Department of Correct ions for a term of not less than

143138 one (1) year nor more than five (5) years, or a fin e not to exceed
144139 One Hundred Thousand Dollars ($100,000.00), or by bot h such fine and
145140 imprisonment. Any person who violates the provisions of subsection
146141 A, B or D of this section, and the victim is an individual who is
147142 less than eighteen (18) years of age, shall, upon conviction, be
148143 guilty of a felony punishable by imprison ment in the custody of the
149144 Department of Corrections for a term of not le ss than two (2) years
150145 nor more than ten (10) years, or a fine not to exceed One Hundred
151146 Thousand Dollars ($100,000 .00), or by both such fine and
152147 imprisonment. Any person who violates the provisions of subsectio n
153148 C of this section shall, upon conviction, b e guilty of a misdemeanor
154149 punishable by imprisonment in the county jail for a term not to
155150 exceed one (1) year, or a fine not to exceed One Hundred Thousand
156151 Dollars ($100,000.00), or b y both such fine and impriso nment.
157152 Restitution to the victim may be orde red in addition to any crimina l
158153 penalty imposed by the court. The victim of identity theft may
159154 bring a civil action for damages against any person participating in
160155 furthering the crime or attempted crime of ide ntity theft.
161156 F. In addition to the penalties provided for in subsection E of
162157 this section, the court may limit or prohibit the person from
163158 accessing the Internet and from possessing or using computers, as
164159 defined in Section 1952 of this title, or other electronic
165160 communications or data storage devic es or media. The court may
