75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY Section 5, Chapter 231, O.S.L.
77	77	2022 (74 O.S. Supp. 2023, Section 12005), is amended to read as
78	78	follows:
79	79	Section 12005. A. As used in this section only of th e Energy
80	80	Discrimination Elimination Act of 2022, "governmental entity" means
81	81	a state agency or political subdivision, board, commission, or
82	82	department of this state.
83	83	B. 1. Except for paragraph 4 of this subsection, this section
84	84	applies only to a contract that:
85	85	a. is between a governmenta l entity and a company with
86	86	ten or more full-time employees, and

138	138	b. will pay a company One Hundred Thousand Dollars
139	139	($100,000.00) or more over the t erm of the contract
140	140	that is to be paid wholly or par tly from public funds
141	141	of the governmental entit y; provided, however, the
142	142	provisions of this paragraph shall apply separately to
143	143	all companies in a multiple party contract.
144	144	2. Except as provided by paragr aph 4 of this subsection, a
145	145	governmental entity shall not enter into a contract with a company
146	146	for goods or services unless the contract contains a written
147	147	verification from the company that it:
148	148	a. does not boycott energy companies, and
149	149	b. will not boycott energy companies during the term of
150	150	the contract.
151	151	3. Except as provided by paragraph 4 of this subsection, a
152	152	governmental entity shall not enter into a contract for goods or
153	153	services with a listed financial company under Section 3 12003 of
154	154	this act title.
155	155	4. Paragraphs 2 and 3 of this subsection shall not apply to:
156	156	a. a governmental entity that determines the requirement s
157	157	of paragraphs paragraph 2 or 3 of this subsection are
158	158	inconsistent with the governmental entity's
159	159	constitutional or statutory duties related to the
160	160	issuance, incurrence, or management of debt

213	213	borrowing, or investmen t of funds, and
214	214	b. a contract for which a governmental body determines
215	215	the supplies or services to be provided are not
216	216	otherwise reasonably available from a company that is
217	217	not a listed financial comp any under Section 3 12003
218	218	of this act title.
219	219	SECTION 2. This act shall become effective November 1, 2024.
