3849 An Act relating to professions and occupations;
3950 amending 59 O.S. 2021, Section 328.54 , which relates

5265 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5366 SECTION 1. AMENDATORY 59 O.S. 2021, Section 328.54, is
5467 amended to read as follows:
5568 Section 328.54 A. Any person conducting a diagnosis for the
5669 purpose of prescribing medication or treatment or any other action
5770 determined to be a dental practice as defined by the State Dental
58-Act, via the Internet or other telecommunications device on any
59-patient that is physically located in this state shall hold a valid
60-Oklahoma state dental license.
61-B. A dentist holding a valid dental license in Oklahoma may
62-consult, diagnose and treat a patient of record via synchronous or
63-asynchronous telecommunication between the patient and dentist. The

98+Act, via the Internet or other telecommunications device on any
99+patient that is physically located in this state shall hold a valid
100+Oklahoma state denta l license.
101+B. A dentist holding a valid dental license in Oklahoma may
102+consult, diagnose and treat a patient of record via synchronous or
103+asynchronous telecommunication between the patient and dentist. The
90104 dentist must record a ll activities relating to teledentistry in the
91105 patient record and must have an off ice location in Oklahoma
92106 available for follow-up treatment and maintenance of records in
93107 Oklahoma or adjacent to Oklahoma and within fifty (50) miles of an
94108 Oklahoma border of a state with an interstate dental and dental
95109 hygienist compact.
96110 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-2711, is
97111 amended to read as f ollows:
98112 Section 1-2711. A. The Legislature recognizes that there is a
99113 need to:
100114 1. Upgrade the availability of quality dental care services for
101115 the people of Oklahoma;
102116 2. Improve the balance of dental manpower distributio n in the
103117 state by geographic loc ation; and
104118 3. Increase access to dental care to those who are dependent on
105119 the state for necessary dental care ;
106120 4. Allow providers to work at the top of their license and
107121 utilize supporting roles; and
108-5. Address the need for dental faculty.
109-B. The purpose of the Oklahoma Dental Loan Repayment Act shall
110-be to:
111-1. Increase the number of dent ists serving and caring for those
112-dependent upon the state for dental care; and

149+5. Address the need for dental faculty.
150+B. The purpose of the Oklahoma Dental Loan Repayment Act shall
151+be to:
152+1. Increase the number of dent ists serving and caring for those
153+dependent upon the state for dental care; and
139154 2. Ensure that dental care and services are accessibl e
140155 throughout the state, and spec ifically, that quality dental care and
141156 services be accessible to underserved dental areas in rural and
142157 metropolitan areas of the state, and to those dependent upon the
143158 state for dental care.
144159 SECTION 3. AMENDATORY 63 O.S. 2021, Sec tion 1-2712, is
145160 amended to read as follows:
146161 Section 1-2712. A. 1. The State Department of Health shall
147162 administer the Oklahoma D ental Loan Repayment Program.
148163 2. The Program, depending upon available funding, shall provid e
149164 educational loan repayment ass istance for up to a total of twenty-
150165 five thirty full-time equivalent Oklahoma licensed dentists per year
151166 including new and continuing con tract renewable participants.
152167 3. Each award shall be for a co ntracted period and shall be
153168 distributed to the participa nt by drafts made payable to the
154169 participant for deposit to an appropriate loan agency in equal
155170 monthly disbursements, not to exc eed Fifty Thousand Dollars
156171 ($50,000.00) Sixty Thousand Dollars ($60,000.00) per year for a
157172 maximum five-year period. Prior to any disbursement, the Department
158-shall certify and properly review monthly report s submitted by the
159-participating dentist detailing performance of activities in
160-accordance with the Oklahoma Dental Loan Repayment Act.
161-4. At the conclusion of the minimum service obligation, the
162-Department shall review the performance in the Program of t he

200+shall certify and properly review monthly report s submitted by the
201+participating dentist detailing performance of activities in
202+accordance with the Oklahoma Dental Loan Repayment Act.
203+4. At the conclusion of the minimum service obligation, the
204+Department shall review the performance in the Program of t he
189205 participating dentist and determi ne whether an award may be granted
190206 for an additional period not to exceed a total participation in the
191207 Program of five (5) years pursuant to rules promulgated by the
192208 Department.
193209 B. Any dentist entering the Program each year as a nonfaculty
194210 participant shall agree to provide dental care and services to
195211 Medicaid recipients as authorized by the Oklahoma Health Ca re
196212 Authority. The Department shall be responsible for ensuring that at
197213 least thirty percent (30%) of the patient s treated by the dentist
198214 will be Medicaid recipients.
199215 1. Any general practice denti st entering the Program each year
200216 as a nonfaculty participa nt shall agree to provide dental care and
201217 services in a designated Dental Health Professional Shortage Area
202218 (DHPSA) of this state.
203219 2. Any dentist licensed to practice as a Pediatric Dentistry
204220 Specialist as defined by the State Dental Act or any dentist
205221 practicing in a Federally Qualified Health Center (FQHC), FQHC look -
206222 alike, county health department or city-county health department may
207-be exempt from the requirement to practice in a Dental Health
208-Professional Shortage Area (DHPSA).
209-C. A dentist entering the Program as a faculty participant
210-shall agree to teach at the University of Oklahoma College of
211-Dentistry. In the event there are no appropriate faculty
212-applicants, the Program may award addit ional nonfaculty dentists.

250+be exempt from the requirement to practice in a Dental Health
251+Professional Shortage Area (DHPSA).
252+C. A dentist entering the Program as a faculty participant
253+shall agree to teach at the University of Oklahoma College of
254+Dentistry. In the event there are no appropriate faculty
255+applicants, the Program may award addit ional nonfaculty dentists.
239256 D. A dentist shall be eligible t o participate in the Program if
240257 the dentist:
241258 1. Is a new dental school graduate. Preference will be given
242259 to graduates of the University of Oklahoma College of Dentistry;
243260 2. Is licensed to prac tice dentistry in Oklahoma; and
244261 3. Has demonstrated financi al need.
245262 E. The dentist shall execute a contract with the Department to
246263 provide dental services pursuant to the terms of the contract and in
247264 accordance with rules promulgated by the Department.
248265 F. If the dentist does not fulfill the service obligation, t he
249266 Department may collect from the participant the entire amount of
250267 loan payments made under the Program plus int erest.
251268 G. The Department shall present a report on the operation of
252269 the Program to the Governor, the Speaker of the House of
253270 Representatives, and the President Pro Tempore of the Senate within
254271 one (1) month of the beginning of each regular session of the
255272 Legislature including but not limited to the progress made in
256273 accomplishing the go al of the Program.
257-SECTION 4. This act shall become effective November 1, 2024.
