38	49		An Act relating to professions and occupations;
39	50		amending 59 O.S. 2021, Section 328.54 , which relates
40	51		to dental practice; modifying tele dentistry
41	52		requirements; amending 63 O.S. 2021, Section s 1-2711
42	53		and 1-2712, which relate to the Oklahoma Dental Loan
43	54		Repayment Act; adding legislative findings;
44	55		increasing certain repayment program allowances;
45	56		modifying program requirements; and providing an

52	65		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	66		SECTION 1. AMENDATORY 59 O.S. 2021, Section 328.54, is
54	67		amended to read as follows:
55	68		Section 328.54 A. Any person conducting a diagnosis for the
56	69		purpose of prescribing medication or treatment or any other action
57	70		determined to be a dental practice as defined by the State Dental
58		-	Act, via the Internet or other telecommunications device on any
59		-	patient that is physically located in this state shall hold a valid
60		-	Oklahoma state dental license.
61		-	B. A dentist holding a valid dental license in Oklahoma may
62		-	consult, diagnose and treat a patient of record via synchronous or
63		-	asynchronous telecommunication between the patient and dentist. The

	98	+	Act, via the Internet or other telecommunications device on any
	99	+	patient that is physically located in this state shall hold a valid
	100	+	Oklahoma state denta l license.
	101	+	B. A dentist holding a valid dental license in Oklahoma may
	102	+	consult, diagnose and treat a patient of record via synchronous or
	103	+	asynchronous telecommunication between the patient and dentist. The
90	104		dentist must record a ll activities relating to teledentistry in the
91	105		patient record and must have an off ice location in Oklahoma
92	106		available for follow-up treatment and maintenance of records in
93	107		Oklahoma or adjacent to Oklahoma and within fifty (50) miles of an
94	108		Oklahoma border of a state with an interstate dental and dental
95	109		hygienist compact.
96	110		SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-2711, is
97	111		amended to read as f ollows:
98	112		Section 1-2711. A. The Legislature recognizes that there is a
99	113		need to:
100	114		1. Upgrade the availability of quality dental care services for
101	115		the people of Oklahoma;
102	116		2. Improve the balance of dental manpower distributio n in the
103	117		state by geographic loc ation; and
104	118		3. Increase access to dental care to those who are dependent on
105	119		the state for necessary dental care ;
106	120		4. Allow providers to work at the top of their license and
107	121		utilize supporting roles; and
108		-	5. Address the need for dental faculty.
109		-	B. The purpose of the Oklahoma Dental Loan Repayment Act shall
110		-	be to:
111		-	1. Increase the number of dent ists serving and caring for those
112		-	dependent upon the state for dental care; and

	149	+	5. Address the need for dental faculty.
	150	+	B. The purpose of the Oklahoma Dental Loan Repayment Act shall
	151	+	be to:
	152	+	1. Increase the number of dent ists serving and caring for those
	153	+	dependent upon the state for dental care; and
139	154		2. Ensure that dental care and services are accessibl e
140	155		throughout the state, and spec ifically, that quality dental care and
141	156		services be accessible to underserved dental areas in rural and
142	157		metropolitan areas of the state, and to those dependent upon the
143	158		state for dental care.
144	159		SECTION 3. AMENDATORY 63 O.S. 2021, Sec tion 1-2712, is
145	160		amended to read as follows:
146	161		Section 1-2712. A. 1. The State Department of Health shall
147	162		administer the Oklahoma D ental Loan Repayment Program.
148	163		2. The Program, depending upon available funding, shall provid e
149	164		educational loan repayment ass istance for up to a total of twenty-
150	165		five thirty full-time equivalent Oklahoma licensed dentists per year
151	166		including new and continuing con tract renewable participants.
152	167		3. Each award shall be for a co ntracted period and shall be
153	168		distributed to the participa nt by drafts made payable to the
154	169		participant for deposit to an appropriate loan agency in equal
155	170		monthly disbursements, not to exc eed Fifty Thousand Dollars
156	171		($50,000.00) Sixty Thousand Dollars ($60,000.00) per year for a
157	172		maximum five-year period. Prior to any disbursement, the Department
158		-	shall certify and properly review monthly report s submitted by the
159		-	participating dentist detailing performance of activities in
160		-	accordance with the Oklahoma Dental Loan Repayment Act.
161		-	4. At the conclusion of the minimum service obligation, the
162		-	Department shall review the performance in the Program of t he

	200	+	shall certify and properly review monthly report s submitted by the
	201	+	participating dentist detailing performance of activities in
	202	+	accordance with the Oklahoma Dental Loan Repayment Act.
	203	+	4. At the conclusion of the minimum service obligation, the
	204	+	Department shall review the performance in the Program of t he
189	205		participating dentist and determi ne whether an award may be granted
190	206		for an additional period not to exceed a total participation in the
191	207		Program of five (5) years pursuant to rules promulgated by the
192	208		Department.
193	209		B. Any dentist entering the Program each year as a nonfaculty
194	210		participant shall agree to provide dental care and services to
195	211		Medicaid recipients as authorized by the Oklahoma Health Ca re
196	212		Authority. The Department shall be responsible for ensuring that at
197	213		least thirty percent (30%) of the patient s treated by the dentist
198	214		will be Medicaid recipients.
199	215		1. Any general practice denti st entering the Program each year
200	216		as a nonfaculty participa nt shall agree to provide dental care and
201	217		services in a designated Dental Health Professional Shortage Area
202	218		(DHPSA) of this state.
203	219		2. Any dentist licensed to practice as a Pediatric Dentistry
204	220		Specialist as defined by the State Dental Act or any dentist
205	221		practicing in a Federally Qualified Health Center (FQHC), FQHC look -
206	222		alike, county health department or city-county health department may
207		-	be exempt from the requirement to practice in a Dental Health
208		-	Professional Shortage Area (DHPSA).
209		-	C. A dentist entering the Program as a faculty participant
210		-	shall agree to teach at the University of Oklahoma College of
211		-	Dentistry. In the event there are no appropriate faculty
212		-	applicants, the Program may award addit ional nonfaculty dentists.

	252	+	C. A dentist entering the Program as a faculty participant
	253	+	shall agree to teach at the University of Oklahoma College of
	254	+	Dentistry. In the event there are no appropriate faculty
	255	+	applicants, the Program may award addit ional nonfaculty dentists.
239	256		D. A dentist shall be eligible t o participate in the Program if
240	257		the dentist:
241	258		1. Is a new dental school graduate. Preference will be given
242	259		to graduates of the University of Oklahoma College of Dentistry;
243	260		2. Is licensed to prac tice dentistry in Oklahoma; and
244	261		3. Has demonstrated financi al need.
245	262		E. The dentist shall execute a contract with the Department to
246	263		provide dental services pursuant to the terms of the contract and in
247	264		accordance with rules promulgated by the Department.
248	265		F. If the dentist does not fulfill the service obligation, t he
249	266		Department may collect from the participant the entire amount of
250	267		loan payments made under the Program plus int erest.
251	268		G. The Department shall present a report on the operation of
252	269		the Program to the Governor, the Speaker of the House of
253	270		Representatives, and the President Pro Tempore of the Senate within
254	271		one (1) month of the beginning of each regular session of the
255	272		Legislature including but not limited to the progress made in
256	273		accomplishing the go al of the Program.
257		-	SECTION 4. This act shall become effective November 1, 2024.
