17569 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
17670 SECTION 1. AMENDATORY 2 O.S. 2021, Section 10 -9.7, as
17771 amended by Section 1, Chapter 239, O.S.L. 2022 (2 O.S. Supp. 2023,

205100 Section 10-9.7 A. All poultry feeding operations shall utilize
206101 Best Management Practices and shall meet the conditions and
207102 requirements established by subsection B of this section and by
208103 rules promulgated by the State Board of Agriculture pursuant to the
209104 Oklahoma Registered Poultry Feeding Operations Act. Compliance with
210105 a Nutrient Management Plan developed under subsection B of this
211106 section shall be deemed compliant with the Best Management Practices
212107 prescribed in this subsection, as well as the requirements of
213108 subsection C of this section.
214109 B. The criteria for Best Management Practices shall be
215110 promulgated by rules by the Board and shall include, but not be
216111 limited to, the following when developing Nutrient Management Plans :
217112 1. There shall be no Each Nutrient Management Plan shall
218113 contain measures designed to prevent the discharge of poultry waste
219114 to waters of the state;
220115 2. Stored poultry waste shall be isolated from outside surface
221116 drainage by covers, ditches, dikes, berms, terraces , or other such
222117 structures;
223118 3. No Each Nutrient Management Plan shall contain measures
224119 designed to prevent waters of the state shall come from coming into
225120 direct contact with the poultry confined on the poultry feeding
226121 operation; and
227122 4. Poultry Provisions designed to ensure that poultry waste
228123 handling, treatment, management, and removal shall:

255151 a. not create an environmental or a public health hazard,
256152 b. not result in the contamination of waters of the
257153 state, and
258154 c. conform to such other handling, treatment , and
259155 management and removal requirements deemed necessary
260156 by the Oklahoma Department of Agricult ure, Food, and
261157 Forestry to implement the Oklahoma Registered Poultry
262158 Feeding Operations Act and rules promulgated pursuant
263159 thereto.
264160 The rules promulgated by the Board pursuant to this section
265161 shall provide for exceptions to the storage requirements for pou ltry
266162 waste in emergency situations. Such exceptions shall include , but
267163 not be limited to, allowing a contract poultry grower to take such
268164 actions as are necessary to meet requirements imposed on a grower by
269165 an integrator. In such situations , growers shall be required to
270166 take all actions feasible to prevent pollution from stored poultry
271167 waste.
272168 C. Every poultry feeding operation shall have a Nutrient
273169 Management Plan which shall in clude at a minimum:
274170 1. A description of poultry waste handling procedures an d
275171 availability of equipment and type of equipment to be used;
276172 2. The calculations and assumptions used for determining land -
277173 application rates if land application is applicable;

304201 3. All nutrient analysis data for soil and poultry waste
305202 testing;
306203 4. Legal description and latitude and longitude of lands to be
307204 used by an operation for land application;
308205 5. Land-application rates of poultry waste shall be based on
309206 the available nitroge n and phosphorous content of the poultry waste
310207 and shall provide controls for runoff and erosion as appropriate for
311208 site conditions;
312209 6. The procedures documented in the Nutrient Management Plan
313210 shall ensure that the handling and utilization of poultry waste
314211 complies with the following requirements:
315212 a. adequate poultry waste storag e shall be provided
316213 consistent with rules promulgated by the Oklahoma
317214 Department of Agriculture, Food, and Forestry pursuant
318215 to subsection B of this section,
319216 b. poultry waste shall not be applied to land when the
320217 ground is saturated or during rainfall even ts.
321218 Poultry waste shall not be applied to land when the
322219 ground is frozen except in conformance with the
323220 Nutrient Management Plan,
324221 c. poultry waste shall only be applied to suitable land
325222 at appropriate times and rates. Discharge or runoff
326223 of waste from the application site is prohibited
327224 evidence that the Nutrient Management Plan requires

354252 revisions. Timing and rate of applications shall be
355253 based on assimilation capacity of the soi l profile,
356254 assuming usual nutrient losses, expected
357255 precipitation, and soil c onditions, and
358256 d. poultry waste application shall be prohibited on land
359257 subject to excessive erosion;
360258 7. Records shall be maintained of all poultry wastes applied on
361259 land owned or controlled by the operator, and sold or given to other
362260 persons:
363261 a. if the poultry waste is sold or given to other persons
364262 for land application or other use, the poultry feeding
365263 operation shall maintain a log of : date of removal
366264 from the poultry feeding o peration;, name of recipient
367265 the poultry waste is sold or given to ;, and amount in
368266 wet tons, dry tons or cubic yards of poultry waste
369267 removed from the poultry feeding operation, and
370268 b. the poultry feeding operation shall make available to
371269 the recipient any nutrient sample analysis of the
372270 poultry waste from that year;
373271 8. Any analysis required by the provisions of the Oklahoma
374272 Registered Poultry Feeding Operations Act or rules promulgated
375273 thereto shall be performed by a qualified environmental testing
376274 laboratory certified by the Department of Environmental Quality and

403302 approved by the Oklahoma Department of Agriculture, Food, and
404303 Forestry; and
405304 9. Such other information deemed necessary by the Oklahoma
406305 Department of Agriculture, Food, and Forestry to administer the
407306 provisions of the Oklahoma Registered Poultry Feeding Operations Act
408307 and rules promulgated pursuant thereto.
409308 D. 1. The Nutrient Management Plan for new or expanding
410309 poultry feeding operations submitted after July 1, 1998, shall be
411310 prepared by the operator or designee of the operator.
412311 2. After the plan is submitted to the O klahoma Department of
413312 Agriculture, Food, and Forestry for review and approval if the
414313 Department determines that a submitted plan needs or requires any
415314 corrections or modifications, the Department shall return the
416315 Nutrient Management Plan to the operator fo r corrections.
417316 3. For a renewal, if the Department determines the Nutrient
418317 Management Plan needs or requires corrections or modifications, the
419318 Department shall make appropriate c orrections, approve the plan , and
420319 notify the poultry feeding operation of the modifications.
421320 E. 1. Except as otherwise provided in this subsection, a
422321 Nutrient Management Plan for every poultry feeding operation shall
423322 be renewed and an updated plan shall be submitted to the Oklahoma
424323 Department of Agriculture, Food, and Forestry ev ery six (6) years
425324 from the date the initial or previous plan was submitted.

452352 2. The operator shall have the option to submit the renewed or
453353 updated plan through the Department's w ebsite or a printable online
454354 form designed by the Department.
455355 3. A current operator may submit a one -page amendment to the
456356 most recently submitted plan in lieu of a renewal plan through the
457357 Department's website, if applicable. Poultry feeding operations
458358 submitting an amendment pursuant to this subsection shall still be
459359 subject to the soil and poultry waste testing requirements under
460360 subsections F and G of this section. The amendment shall contain
461361 the following statements:
462362 a. no changes in the Department' s promulgated standards
463363 for land application of poultry waste have occurred
464364 since the most recently submitted Nutrient Management
465365 Plan,
466366 b. there has been no change to the number of poultry
467367 housed since the most recently submitted Nutrient
468368 Management Plan,
469369 c. there has been no expansion in the poultry feeding
470370 operation since the mos t recently submitted Nutrient
471371 Management Plan, and
472372 d. the entirety of the poultry waste is:
473373 (1) removed off-site as provided in the poultry
474374 feeding operation's annual report, as r equired by
475375 subsection J of this section, and will continue

503404 years, or
504405 (2) land-applied and will continue to be land -applied
505406 for the next six (6) years.
506407 F. Every poultry feeding operation located in a non -nutrient-
507408 limited watershed and non -nutrient-vulnerable groundwaters shall
508409 perform soil testing on each land -application area and poultry waste
509410 testing at least once every three (3) years to determine:
510411 1. Soil pH and plant -available nutrients including, at a
511412 minimum, nitrogen, phosphorous , and potassium;
512413 2. Poultry waste nutrient concentr ations and moisture; and
513414 3. Application rate based upon the Department's standards for
514415 land application for poultry waste as promulgated by rules.
515416 G. Every poultry feeding operation located in a nutrient -
516417 limited watershed and nutrient -vulnerable groundwater shall perform
517418 an annual soil test on each land -application area prior to the first
518419 application of the calendar year. Poultry waste testing shall be
519420 performed annually prior t o the first application of the calendar
520421 year. Soil and poultry waste testing shall be performed to
521422 determine:
522423 1. Soil pH and plant -available nutrients including at least
523424 nitrogen, phosphorous , and potassium;
524425 2. Poultry waste nutrient concentrations and moisture; and

551453 3. Application rate based upon the Department's standards for
552454 land application of poultry waste as promulgated by rules.
553455 H. 1. Soil and poultry waste analysis data shall be retained
554456 by the poultry feeding operation for a minimum of six (6) years.
555457 2. All soil and poultry waste analysis data shall be dated
556458 prior to land application.
557459 I. 1. Poultry feeding operations shall develop a plan for the
558460 disposal of carcasses associated with normal mortality.
559461 2. In the event there is an outbreak of a major disease or
560462 other emergency resulting in deaths significantly higher t han normal
561463 mortality rates, the Oklahoma Department of Agriculture, Food, and
562464 Forestry may approve, in writing, an alternate method of disposal of
563465 carcasses or the storage of poul try waste during the emergency
564466 period.
565467 J. Every poultry feeding operation sh all file by September 1 of
566468 each year an annual report with the Department regarding all poultry
567469 waste removed from or land -applied by the facility for the period
568470 from July 1 of the previous year through June 30 of that year. The
569471 report shall contain the f ollowing information:
570472 1. The date and amount of poultry waste removed from or land -
571473 applied at the facility;
572474 2. The type of poultry waste removed or land -applied, whether a
573475 cake out, full clean out, in -house windrow or compost, poultry waste
574476 stack shed, or other type;

601504 3. The county and, if applicable, the name of the Nutrient
602505 Limited Watershed where the poultry waste was produced; and
603506 4. The location where the poultry waste is removed to:
604507 a. if land-applied on-site, provide the following:
605508 (1) the date of the land application,
606509 (2) the total amount of poultry waste land -applied in
607510 wet tons, dry tons, or cubic yards,
608511 (3) the name, mailing address, and telephone number
609512 of the poultry waste applicator, and
610513 (4) the number of acres under the control of the
611514 poultry feeding operation for land application of
612515 poultry waste, or
613516 b. if removed off-site, provide the following:
614517 (1) the date of the removal off -site,
615518 (2) the amount of poultry waste removed in wet tons,
616519 dry tons, or cubic yards,
617520 (3) the name, mailing address , and telephone number
618521 of the person the poultry waste is sold or
619522 transferred to,
620523 (4) the name, mailing address, telephone number, and
621524 poultry waste applicator license number of t he
622525 poultry waste applicator, if known, and
623526 (5) the name, mailing address, and telephone number
624527 of the hauler of the poultry waste.

651555 SECTION 2. AMENDATORY 2 O.S. 2021, Section 10 -9.11, is
652556 amended to read as follows:
653557 Section 10-9.11 A. 1. Any person violating the provisions of
654558 the Oklahoma Registered Poult ry Feeding Operations Act shall, upon
655559 conviction, be guilty of a misdemeanor and may be punished by a fine
656560 not to exceed Two Hundred Dollars ($200.00).
657561 2. The Attorney General or the district attorney of the
658562 appropriate district court of Oklahoma may brin g an action in a
659563 court of competent criminal jurisdiction for the prosecution of a
660564 violation by any person of a provision of the Oklahoma Registered
661565 Poultry Feeding Operations Act or any rule promulgated thereunder.
662566 B. 1. In addition to the criminal pena lties specified by this
663567 section, the Oklahoma Department of Agriculture, Food, and Forestry
664568 may:
665569 a. assess an administrative penalty of not more than Two
666570 Hundred Dollars ($200.00) per day of noncompliance, or
667571 b. bring an action for injunctive relief grante d by a
668572 district court.
669573 2. A district court may grant injunctive relief to prevent a
670574 violation of, or to compel compliance with, any of the provisions of
671575 the Oklahoma Registered Poultry Feeding Operations Act or any rule
672576 promulgated thereunder or order, re gistrations, and certificates
673577 issued pursuant to the Oklahoma Registered Poultry Feeding
674578 Operations Act.

701606 3. Nothing in this section shall preclude the Department from
702607 seeking penalties in district court in the maximum amount allowed by
703608 law. The assessment of penalties in an administrative enforcement
704609 proceeding shall not prevent the subsequent assessment by a court of
705610 the maximum criminal penalties for violations of the Oklahoma
706611 Registered Poultry Feeding Operations Act.
707612 4. Any person assessed an adminis trative penalty may be
708613 required to pay, in addition to such penalty amount and interest
709614 thereon, attorney fees and costs associated with the collection of
710615 such penalties.
711616 C. 1. Any action for injunctive relief to redress or restrain
712617 a violation by any pe rson of the Oklahoma Registered Poultry Feeding
713618 Operations Act, or for any rule promulgated thereunder, or order
714619 issued pursuant thereto, or recovery of any administrative penalty
715620 assessed pursuant to the Oklahoma Registered Poultry Feeding
716621 Operations Act may be brought by:
717622 a. the district attorney of the appropriate district
718623 court of the State of Oklahoma,
719624 b. the Attorney General on behalf of the State of
720625 Oklahoma, or
721626 c. the Department on behalf of the State of Oklahoma.
722627 2. The court shall have jurisdicti on to determine the action,
723628 and to grant the necessary or appropriate relief, including , but not

750656 limited to, mandatory or prohibitive injunctive relief , interim
751657 equitable relief, and punitive damages .
752658 3. It shall be the duty of the Attorney General and di strict
753659 attorney if requested by the Commissioner of Agriculture to bring
754660 such actions.
755661 D. Except as otherwise provided by law, administrative and
756662 civil penalties shall be paid in to the State Department of
757663 Agriculture Regulation Revolving Fund.
758664 E. For the purposes of the Oklahoma Registered Poultry Feeding
759665 Operations Act, each day upon which a violation is committed or is
760666 permitted to continue shall be deemed a separate offense.
761667 F. Any contract poultry grower determined after notice and
762668 opportunity for a hearing by the Department as flagrantly
763669 disregarding Best Management Practices shall result in the
764670 Department notifying the integrator in writing.
765671 G. The Department shall notify all integrators of any
766672 violations assessed against an operator who is under a contract
767673 growing arrangement with that integrator and, upon the written
768674 request of the integrator, notify that integrator of all violations
769675 assessed against an operator with whom the integrator contemplates
770676 entering into a contract.
771677 H. In addition to oth er penalties as may be imposed by law, any

800707 inaccurate any monitoring device or method required to be maintained
801708 by any rule promulgated by the Board, shall, upon conviction, be
802709 guilty of a misdemeanor and may be subject to a fine of not more
803710 than Five Thousand Dollars ($5,000.00) for each such violation.
804711 I. Land application of poultry litter in compliance with a
805712 current Nutrient Management Plan shall not be the basis for criminal
806713 or civil liability in Oklahoma, whether relating to that single
807714 plan, or aggregated with the application of poultry waste pursu ant
808715 to other Nutrient Management Plans, nor shall an administrative
809716 violation be the basis for a criminal or civil action, nor shall any
810717 alleged violation be the basis for any private right of action, nor
811718 any action other than enforcement of the terms of the Nutrient
812719 Management Plan and other sections of this title by the Oklahoma
813720 Department of Agriculture, Food, and Forestry. A current plan means
814721 a plan approved by the Oklahoma Department of Agriculture, Food, and
815722 Forestry and not yet revoked or rescinded by the state or suspended
816723 by a more recent plan.
817724 1. This provision shall ap ply both directly and vicariously to
818725 the integrator with whom a contract poultry grower contracts, as
819726 well as to any poultry grower, operator, contractor of, or employee
820727 for a certified poultry waste applicator or a poultry waste owner's
821728 agent, so long as the land application is performed pursuant to and
822729 in compliance with the current Nutrient Management Plan.

849757 2. Compliance with a current Nutrient Management Plan, as
850758 determined by the Oklahoma Department of Agriculture, Food, and
851759 Forestry, shall create a p resumption that no violation of this
852760 section has occurred and shall insulate the poultry grower,
853761 integrator, and waste applicator from any private right of action
854762 and shall constitute "express authority" for purposes of this title
855763 and Section 4 of Title 50 of the Oklahoma Statutes.
856764 3. Nothing in this subsection shall restrict the Oklahoma
857765 Department of Agriculture, Food, and Forestry's exclusive authority
858766 from enforcing the terms of Nutrient Management Plans or their
859767 authority to enforce the Oklahoma Regis tered Poultry Feeding
860768 Operations Act and the Oklahoma Certified Poultry Waste Applicators
861769 Act.
862770 SECTION 3. It being immediately necessary for the preservation
863771 of the public peace, health or safety, an emergency is hereby
864772 declared to exist, by reason whereof this act shall take effect and
865773 be in full force from and after its passage and approval.
