53	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	76		SECTION 1. AMENDATORY 74 O.S. 2021, Section 8, is
55	77		amended to read as follows:
56	78		Section 8. A. The Office of Governor, with its compensation,
57	79		shall devolve upon the Lieutenant Governor or the person who is next
58	80		in succession to the Office pursuant to the provisions of Section 15
59	81		of Article VI of the Oklahoma C onstitution if the Governor transmi ts
60	82		to the President Pro Tempore of the Senate and the Speaker of the
61	83		House of Representatives his written declaration that he is unable
62	84		to discharge the powers and duties of his Office. The Lieutenant
63	85		Governor or other successor shall hold the Office unti l the Governor
64	86		transmits to the President Pro Tempore of the Senate and the Speaker

93	139		able to perform the powers and duties of h is Office.
94	140		B. If a majority of a committee, comprised of the Sta te Auditor
95	141		and Inspector, State Treasurer, Superintendent of Public
96	142		Instruction, Chairman of the Corporation Commission and Insurance
97	143		Commissioner, transmits to the President Pro Tempore of t he Senate,
98	144		the Speaker of the House of Representatives and the Go vernor its
99	145		written declaration that the Governor is unable to discharge the
100	146		powers and duties of his Office, then the Office, with its
101	147		compensation, shall devolve upon the Lieutenant Governor or other
102	148		successor in forty-eight (48) hours unless the Governor transmits to
103	149		the President Pro Tempore of the Senate, the Speaker of the House of
104	150		Representatives and the members of the committee a written
105	151		declaration to the contrary within the same forty -eight-hour time
106	152		period.
107	153		C. If, within forty-eight (48) hours after the Governor
108	154		transmits such a declaration, a majority of the committee provided
109	155		in subsection B of this section transmits to the President Pro
110	156		Tempore of the Senate and the Speaker of the House of
111	157		Representatives a wr itten declaration that the Governor is unable to
112	158		perform the powers and duties of his Office, then the Legislature
113	159		shall convene within seventy -two (72) hours. If a resolution
114	160		declaring probable justification for a determinat ion that inability
115	161		exists is not adopted by two-thirds (2/3) of the members of each

144	214		Legislature convenes, then the Governor shall continue to hold the
145	215		Office.
146	216		If such a resolution is adopted by two-thirds (2/3) of the
147	217		members of each house of the Legislatu re within seventy-two (72)
148	218		hours after the Legislature convenes, then a copy of the resolution
149	219		shall be transmitted immediately to the Supreme Court.
150	220		D. The Supreme Court shall determine the issue of the inability
151	221		of the Governor, by preference and with p riority over all other
152	222		matters, under such rules as it shall adopt. If the Supreme Court
153	223		determines that the Governor is unable to perform the powers and
154	224		duties of his Office, then the Offic e, with its compensation, shal l
155	225		devolve upon the Lieutenant Gover nor or other successor. If the
156	226		Supreme Court determines that the Governor is able, then he shall
157	227		continue to hold the Office.
158	228		E. If the Office has devolved upon the Lieutenant Governor or
159	229		other successor pursuant to the provisions of this act, and a
160	230		majority of the committee provided in subsection B of this section
161	231		transmits to the President Pro Tempore of the Senate and the Speaker
162	232		of the House of Representatives a written declaration that the
163	233		Governor is able to perfor m the powers and duties of his Offi ce,
164	234		then the Supreme Court shall determine the issue pursuant to the
165	235		provisions of subsection D of this section.

193	287		F. When the Office has devolved upon the Lieutenant Governor or
194	288		other successor, the provisions of this act shall also apply to the
195	289		person holding the Office.
196	290		G. The Office of the Governor shall provide timely notification
197	291		to the Lieutenant Governor and the Secretary of State in the event
198	292		of planned or unplanned absence s from office. The notification
199	293		shall include details regarding the duratio n and reason for the
200	294		absence.
201	295		SECTION 2. This act shall become effective November 1, 2024.
