5375 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5476 SECTION 1. AMENDATORY 74 O.S. 2021, Section 8, is
5577 amended to read as follows:
5678 Section 8. A. The Office of Governor, with its compensation,
5779 shall devolve upon the Lieutenant Governor or the person who is next
5880 in succession to the Office pursuant to the provisions of Section 15
5981 of Article VI of the Oklahoma C onstitution if the Governor transmi ts
6082 to the President Pro Tempore of the Senate and the Speaker of the
6183 House of Representatives his written declaration that he is unable
6284 to discharge the powers and duties of his Office. The Lieutenant
6385 Governor or other successor shall hold the Office unti l the Governor
6486 transmits to the President Pro Tempore of the Senate and the Speaker

94140 B. If a majority of a committee, comprised of the Sta te Auditor
95141 and Inspector, State Treasurer, Superintendent of Public
96142 Instruction, Chairman of the Corporation Commission and Insurance
97143 Commissioner, transmits to the President Pro Tempore of t he Senate,
98144 the Speaker of the House of Representatives and the Go vernor its
99145 written declaration that the Governor is unable to discharge the
100146 powers and duties of his Office, then the Office, with its
101147 compensation, shall devolve upon the Lieutenant Governor or other
102148 successor in forty-eight (48) hours unless the Governor transmits to
103149 the President Pro Tempore of the Senate, the Speaker of the House of
104150 Representatives and the members of the committee a written
105151 declaration to the contrary within the same forty -eight-hour time
106152 period.
107153 C. If, within forty-eight (48) hours after the Governor
108154 transmits such a declaration, a majority of the committee provided
109155 in subsection B of this section transmits to the President Pro
110156 Tempore of the Senate and the Speaker of the House of
111157 Representatives a wr itten declaration that the Governor is unable to
112158 perform the powers and duties of his Office, then the Legislature
113159 shall convene within seventy -two (72) hours. If a resolution
114160 declaring probable justification for a determinat ion that inability
115161 exists is not adopted by two-thirds (2/3) of the members of each

143213 house of the Legislature within seventy -two (72) hours after the
144214 Legislature convenes, then the Governor shall continue to hold the
145215 Office.
146216 If such a resolution is adopted by two-thirds (2/3) of the
147217 members of each house of the Legislatu re within seventy-two (72)
148218 hours after the Legislature convenes, then a copy of the resolution
149219 shall be transmitted immediately to the Supreme Court.
150220 D. The Supreme Court shall determine the issue of the inability
151221 of the Governor, by preference and with p riority over all other
152222 matters, under such rules as it shall adopt. If the Supreme Court
153223 determines that the Governor is unable to perform the powers and
154224 duties of his Office, then the Offic e, with its compensation, shal l
155225 devolve upon the Lieutenant Gover nor or other successor. If the
156226 Supreme Court determines that the Governor is able, then he shall
157227 continue to hold the Office.
158228 E. If the Office has devolved upon the Lieutenant Governor or
159229 other successor pursuant to the provisions of this act, and a
160230 majority of the committee provided in subsection B of this section
161231 transmits to the President Pro Tempore of the Senate and the Speaker
162232 of the House of Representatives a written declaration that the
163233 Governor is able to perfor m the powers and duties of his Offi ce,
164234 then the Supreme Court shall determine the issue pursuant to the
165235 provisions of subsection D of this section.

193287 F. When the Office has devolved upon the Lieutenant Governor or
194288 other successor, the provisions of this act shall also apply to the
195289 person holding the Office.
196290 G. The Office of the Governor shall provide timely notification
197291 to the Lieutenant Governor and the Secretary of State in the event
198292 of planned or unplanned absence s from office. The notification
199293 shall include details regarding the duratio n and reason for the
200294 absence.
201295 SECTION 2. This act shall become effective November 1, 2024.
