2655 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

2856 SECTION 1. AMENDATORY 31 O.S. 2021, Section 1, is
2957 amended to read as follows:

3158 Section 1. A. Except as otherwise provided in this title and
3259 notwithstanding subsection B of this section, the following property
3360 shall be reserved to every person residing in the state, exempt from
3461 attachment or execution and every other species of forced sale for
3562 the payment of debts, except as herein provided:

3763 1. The home of such person, pro vided that such home is the

4092 2. A manufactured home, provided that such manufactured home is

53102 person or a dependent of such person, not to exceed Ten Thousand
54103 Dollars ($10,000.00) in aggregate value;

56104 6. All books, portraits and pictures that are held primarily
57105 for the personal, family or household use of such person or a
58106 dependent of such person;

60107 7. The person's interest, not to exceed Four Thousand Dollars
61108 ($4,000.00) in aggregate value, in wearing apparel that is held

103193 18. Seventy-five percent (75%) of all current wages or earnings
104194 for personal or professional services earned during the last ninety
105195 (90) days, except as provided in Title 12 of the Oklahoma Statutes
106196 in garnishment proceedings for collection of child support;

108197 19. Such person's right to receive alimony, support, separate
109198 maintenance or child support payments to the extent reasonably
110199 necessary for the support of such person and any depen dent of such
111200 person;

113201 20. Subject to the Uniform Fraudule nt Transfer Act, Section 112
114202 et seq. of Title 24 of the Oklahoma Statutes, any interest in a
115203 retirement plan or arrangement qualified for tax exemption or
116204 deferment purposes under present or future Acts of Congress
117205 including any distributions from said pla n or arrangement; provided,
118206 any transfer or rollover contribution between retirement plans or
119207 arrangements which avoids current federal income taxation shall not
120208 be deemed a transfer which is fraudul ent as to a creditor under the
121209 Uniform Fraudulent Transfe r Act. "Retirement plan or arrangement
122210 qualified for tax exemption purposes " shall include without
123211 limitation, trusts, custodial accounts, insurance, annuity contracts
124212 and other properties and rights constituting a part thereof. By way
125213 of example and not by limitation, retirement plans or arrangements
126214 qualified for tax exemption or deferment purposes permitted under
127215 present Acts of Congress include defined contribution plans and
128216 defined benefit plan s as defined under the Internal Revenue Code

129244 ("IRC"), individual retirement accounts, individual retirement
130245 annuities, simplified employee pension plans, Keogh plans, IRC
131246 Section 403(a) annuity plans, IRC Section 403(b) annuities, Roth
132247 individual retirement accounts created pursuant to IRC Section 408A,
133248 educational individual retirement accounts created pursuant to IRC
134249 Section 530 and eligible state deferred compensation plans governed
135250 under IRC Section 457. This provision shall be in addition to and
136-not a limitation of any o ther provision of the Oklahoma Statutes ENR. H. B. NO. 4150 Page 4
251+not a limitation of any other provision of the Oklahoma Statut es
137252 which grants an exemption from attachment or execution and every
138253 other species of forced sale for the payment of debts. This
139254 provision shall be effective for retirement plans and arrangements
140255 in existence on, or created after April 16, 1987;

142256 21. Such person's interest in a claim for personal bodily
143257 injury, death or workers ' compensation claim, for a net amount not
144258 in excess of Fifty Thousand Dollars ($50,000.00), but not including
145259 any claim for exemplary or punitive damages;

147260 22. Funds in an individual development account established
148261 pursuant to the provisions of Section 251 et seq. of Title 56 of the
149262 Oklahoma Statutes;

151263 23. Any amount received pursuant to the federal earned income
152264 tax credit; and

154265 24. Any interest in an Oklahoma College Savings Plan ac count
155266 established pursuant to the provisions of Section 3970.1 et seq. of
156267 Title 70 of the Oklahoma Statutes.

158295 B. No natural person residing in this state may exempt from the
159296 property of the estate in any bankruptcy proceeding the property
160297 specified in subsection (d) of Section 522 of the Bankruptcy Reform
161298 Act of 1978, Public Law 95 -598, 11 U.S.C.A. 101 et seq., except as
162299 may otherwise be expressly permitted under this title or other
163300 statutes of this state.
