26	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

28	56		SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -553.1, is
29	57		amended to read as follows:

31	58		Section 1-553.1 A. All health care facilities that perform
32	59		mammography examinations shall include in the summary of the
33	60		mammography report, required by federal law to be provided to a
34	61		patient, information that identifies the patient 's individual breast
35	62		density classification based on the Breast Imaging Reporting and
36	63		Data System establishe d by the American College of Radiology as
37	64		dense or not dense. If the patient elects to receive the summary of
38	65		the mammography report by electronic mail and provides an electronic

40	94		facility determines that a patient has heterogeneously or extremely
41	95		dense breast tissue, the summary of the mammography report shall
42	96		include the following n otice:

44	97		"Your mammogram indicates that you have dense breast tissue.
45	98		Dense breast tissue is common and is fo und in more than fifty

47	100		tissue may make it more difficult to detect breast cancer and may be
48	101		associated with an increased risk of breast cancer. This
49	102		information is being provided to raise your awareness and to
50	103		encourage you and your health care provider to discuss this and
51	104		other breast cancer risk factors. Together, you and your heal th
52	105		care provider can decide if additional screening options may be
53	106		right for you. A report of your results was sent to your health
54	107		care provider."

56	108		"Breast tissue can be either dense or not dense. Dense tissue
57	109		makes it harder to find breast cancer on a ma mmogram and also raises
58	110		the risk of developing breast cancer. Your breast tissue is dense.
59	111		In some people with dense tissue, other imaging tests in addition to
60	112		a mammogram may help find cancers. Talk to your health care
61	113		provider about breast density, ri sks for breast cancer, and your
62	114		individual situation. "

64	115		B. Patients who receive diagnostic or screening mamm ograms may
65	116		be directed to informative material about breast density. This

69	147		care providers can be further informed by material from the American
70	148		Cancer Society or Mammography Saves Lives organizations.

72	149		C. Nothing in this section shall be deemed to create a duty of
73	150		care or other legal obligation beyond the du ty to provide notice as
74	151		set forth in subsection A of this section. Nothing in this section
75	152		shall be deemed to require a notice that is inconsistent with the
76	153		provisions of the federal Mammography Quality Standards Act or any
77	154		regulations promulgated pursuant thereto.

79	155		SECTION 2. This act shall become effective November 1, 2024.
