56	56	BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE
57	57	1ST SESSION OF THE 5 9TH OKLAHOMA LEGISLATURE:
58	58	SECTION 1. The Secretary of State shall refe r to the people for
59	59	their approval or rejec tion, as and in the manner provided by law,
60	60	the following proposed amendments to Sections 1 and 4 of Article VI
61	61	of the Constitution of the State of Oklahoma to read as follows:
62	62	Section 1. A. The Executive author ity of the state shall be
63	63	vested in a Governor, Lieutenant Governor, Secretary of State, State
64	64	Auditor and Inspector, Attorney General, State Treasurer,
65	65	Superintendent of Public Instruction, Commissioner of Labor,

92	92	Commissioner of Insurance and other office rs provided by law and
93	93	this Constitution, e ach of whom shall keep his or her office and
94	94	public records, books and papers at the seat of government, and
95	95	shall perform such duties as may be designated in this Constitution
96	96	or prescribed by law.
97	97	B. The Secretary of State shall be appointed by the Gove rnor by
98	98	and with the consent of the Senate for a term of four (4) years to
99	99	run concurrently with the term of the Governor. Beginning with the
100	100	term of office of the Governor commencing in 2030, the
101	101	Superintendent of Public Instruction shall be appointed by the
102	102	Governor by and with the consent of the Senate and shall serve at
103	103	the pleasure of the Governor .
104	104	Section 4. A. The term of office of the Governor, Lieutenant
105	105	Governor, State Auditor and Inspector , Attorney General, State
106	106	Treasurer, and Commissioner of Labor and Superintendent of Public
107	107	Instruction shall be four (4) years from the second Monday of
108	108	January next after their election . The said officers shall be
109	109	eligible to immediately succeed themselves except a s otherwise
110	110	provided in this section.
111	111	B. 1. No person shall be eligible to serve as Governor for a
112	112	period of time in excess of eight (8) years. Such years need not be
113	113	consecutive. Any years served by a person serving as Governor for
114	114	less than a full term to fill a vacancy in such office shall n ot be
115	115	included in the eight-year limitation set forth herein.

142	142	2. Notwithstanding the provisions of this amendment, any person
143	143	serving as Governor at the time of passage of this amendment on
144	144	November 2, 2010, shall be eligible to complete the term of offic e
145	145	to which he or she was elected but shall not be eligible to serve as
146	146	Governor for a period of time in excess of eight (8) years,
147	147	excluding years served for less than a full term to fill a vacancy
148	148	in such office. The provisions of this paragraph shall ap ply
149	149	regardless of whether such years were served prior to or after
150	150	passage of this amendment November 2, 2010.
151	151	C. No person shall be eligible to serve as Lieutenant Governor,
152	152	State Auditor and Inspector , Attorney General, State Treasurer, or
153	153	Commissioner of Labor or Superintendent of Public Instruction for a
154	154	period of time in excess of eight (8) years . Such years need not be
155	155	consecutive. Any years served by a person elected or appointed to
156	156	serve less than a full term to fill a vacancy in any such office
157	157	shall not be included in the limitations set forth herein. Any
158	158	person serving in such position at the time of passage of this
159	159	amendment on November 2, 2010, shall be eligible to complete the
160	160	term for which he or she has been elected or appointed and shall be
161	161	eligible to serve an additional eight (8) years thereafter,
162	162	notwithstanding the provisions of this amendment.
163	163	D. The Legislature is hereby authorized to enact laws to
164	164	implement the provisions of subsections B and C of this section.

196	196	THE GIST OF THE PROPOSITION IS AS FOLLOWS :
197	197	This measure amends the Oklahoma Constitution. It proposes a
198	198	change in the method for selection of the Superintendent of
199	199	Public Instruction. Currently the Superintendent of Public
200	200	Instruction is elected by the voters of the state. The
201	201	amendment would change this and provide that the Superintendent
202	202	of Public Instruction would be appointed by the Governor. The
203	203	Superintendent of Public Instruction would serve at the pleasure
204	204	of the Governor. The changes propose d in this measure would
205	205	take place beginning with the term of office of the Governor
206	206	that is to start in 2030.
