6479 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE
6580 2ND SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
6681 SECTION 1. The Secretary of State shall refer to the people for
6782 their approval or rejection, as and in the manner provided by law,

98-Section 3. A. The Legislature sh all, by law, prescribe a set
99-of licenses for the sale of alcoholic beverages to cons umers for
100-off-premise consumption, which shall include , but not be limited to:
101-1. A Retail Spirits License, which shall be required in order
102-to sell the following:
103-a. refrigerated and non-refrigerated spirits in their
104-original sealed package, and/or
105-b. refrigerated and non-refrigerated wine and beer in
106-their original sealed package.
107-A holder of a Retail Spirits License shall be permitted to sell
108-at retail any item that may be purchased at a grocery store or
109-convenience store, as defined by law, so long as the sale of items
110-other than alcoholic beverages do not comprise more than twenty
111-percent (20%) of the holder's monthly sales;
112-2. A Retail Wine License, which shall be req uired in order to
113-sell refrigerated or non -refrigerated wine in the original sealed
114-package. Retail Wine Licenses may be owned without limitation on
115-number by retail locations; and
116-3. A Retail Beer License, which shall be required in order to
117-sell refrigerated or non-refrigerated beer in the original sealed
118-package. Retail Beer License s may be owned without limitation on
119-number by retail locations.
120-B. As used in this section, the term "retail location" shall
121-include, but not be limited to:

150-1. Supermarkets, grocery stores, convenience stores, drug
151-stores, warehouse, clubs and supercenters as defined by law; and/or
152-2. Retail outlets which were authorized to legally sell low
153-point beer as of the effective date of this section.
154-C. The Legislature shall, b y law, prescribe a set of licenses
155-for the sale of alcoholic beverages to consumers for on-premise
156-consumption, which may include the sale of spirits, wine and/or
157-beer, provided that such sales of alcoholic beverages by the
158-individual drink have been autho rized by the voters in the specific
159-county where the alcoholic beverages are sold, e ither prior to or
160-after the enactment of this Article.
161-SECTION 2. The Ballot Title for the proposed resolution shall

165144 THE GIST OF THE PROP OSITION IS AS FOLLOWS:
166-This measure amends Section 3 of Article 28A of the Oklahoma
167-Constitution. It eliminates the prohibition against the sale of
168-refrigerated spirits by retail spirits licensees.
