3837 An Act relating to law enforcement investigations;
3938 amending 47 O.S. 2021, Sect ion 2-108, which relates
4039 to powers and duties of the commissioner; modifying
4140 powers; directing certain notification; amending 74

4847 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:
4948 SECTION 1. AMENDATORY 47 O.S. 2021, Section 2 -108, is
5049 amended to read as follows:
5150 Section 2-108. A. The Commissioner is hereby vested with the
5251 power and is charged with the duty of observing, administering, and
5352 enforcing the provisions of this title and of all laws regulating
5453 the operation of vehicles o r the use of the highways, the
5554 enforcement and administration of which are now or hereafter vested
5655 in the Department. The Commissioner may appoint any employee of the
5756 Department to serve as the personal representative of the
5857 Commissioner for the purpose o f fulfilling any such duty or
5958 combination of duties.
6059 B. The Commissioner is hereby authorized to adop t and enforce
6160 such rules as may be necessary to carry out the provisions of the

8888 Highway Safety Code and any other laws the enforcement and
8989 administration of which are vested in the Department.
9090 C. The Commissioner may adopt an official seal for the use of
9191 the Department.
9292 D. The Commissioner may adopt an authorized facsimile si gnature
9393 of the Commissioner, and may appoint any employee of the Department
9494 to serve as the personal representative of the Commissioner for the
9595 purpose of affixing the authorized facs imile signature of the
9696 Commissioner to administrative letters, notices, a nd orders to
9797 enforce the provisions of the law. Provided, however, it shall be
9898 unlawful and shall constitute the crime of forgery to affix or
9999 endorse the facsimile signature of the C ommissioner, as herein
100100 provided, to any instrument, voucher, check, claim , or draft for the
101101 payment of money due and owing to the State of Oklahoma. In l ieu of
102102 the signature of the Commissioner or the authorized facsimile
103103 signature of the Commissioner, th e Commissioner may direct and
104104 authorize any employee of the Department to affix the signature of
105105 the employee to administrative letters, notices, and orde rs to
106106 enforce the provisions of the law.
107107 E. The Commissioner has the authority to enter into interage ncy
108108 transfers with the Oklahoma State Bureau of Investigation, the
109109 Oklahoma Bureau of Narcotics and Dangerous Drugs and the Oklahoma
110110 Alcoholic Beverages L aws Enforcement Commission as provided for in
111111 Section 1 of this act.

138139 F. The Commissioner has the auth ority to investigate and
139140 cooperate with munic ipal or county law enforcement agencies when a
140141 manhunt or missing child sit uation happens in the state. Municipal
141142 or county law enforcement shall be required to n otify the
142143 Commissioner, or his or her designee, within the first six (6) hours
143144 of opening the local investigation .
144145 SECTION 2. AMENDATORY 74 O.S. 2021, Section 150.2, is
145146 amended to read as follows:
146147 Section 150.2. The Oklahoma State Bureau of Investigation shall
147148 have the power and duty to:
148149 1. Maintain a nationally accredited scientific laboratory to
149150 assist all law enforcement agencies in the discove ry and detection
150151 of criminal activity;
151152 2. Maintain fingerprint and other identification files
152153 including criminal history r ecords, juvenile identification files,
153154 and DNA profiles;
154155 3. Establish, coordinate and maintain the automated fingerprint
155156 identification system (AFIS) and the deoxyribo nucleic acid (DNA)
156157 laboratory;
157158 4. Operate teletype, mobile and fixed radio or other
158159 communications systems;
159160 5. Conduct schools and training programs for the agents, pea ce
160161 officers, and technicians of this state charged with the enforcement
161162 of law and order and the investigation and detection of crime;

188190 6. Assist the Director of the Oklahoma State Bureau of
189191 Narcotics and Dangerous Drugs Control, the Chief Medical Examiner ,
190192 and all law enforcement officers and district att orneys when such
191193 assistance is requested, in accordance with the policy determined by
192194 the Oklahoma State Bureau of Investig ation Commission established in
193195 Section 150.3 of this title;
194196 7. Investigate and d etect criminal activity when directed to do
195197 so by the Governor;
196198 8. Investigate, detec t, institute and maintain actions
197199 involving vehicle theft pursuant to Section 150.7a of this title or
198200 oil, gas or oil field equipment theft pursuant to Sections 152.2
199201 through 152.9 of this title;
200202 9. Investigate any crimi nal threat made to the physical saf ety
201203 of elected or appointed officials of this state or any political
202204 subdivision of the state and forward the results of that
203205 investigation to the Department of Public Sa fety, and provide
204206 security to foreign elected or ap pointed officials while they are in
205207 this state on official business;
206208 10. Investigate and detect violations of the Oklahoma Computer
207209 Crimes Act;
208210 11. Investigate and enforce all laws relating to any crime
209211 listed in Section 571 of Title 57 of the Oklahoma S tatutes that
210212 occurs on the turnpike s;

237240 12. Investigate and detect criminal activity involving files,
238241 records, assets, prope rties, buildings or employees of the Oklahoma
239242 State Bureau of Investigation. Noth ing in this paragraph shall
240243 limit or prevent any cr iminal investigation of the matter by the
241244 sheriff of the county or any law enforcement agency of competent
242245 jurisdiction; and
243246 13. Contract with municipal or county law enforcement agencies
244247 to conduct administrative reviews of law enforcement use -of-force
245248 investigations for compliance with c urrent investigative procedures,
246249 standards and law. All funds received as a result of t he contract
247250 will be deposited in the OSBI Revolving Fund. Any review of use -of-
248251 force investigation shall be done by a certified poli ce officer; and
249252 14. Investigate and cooperate with munic ipal or county law
250253 enforcement agencies when a manhunt or missing child situation
251254 happens in the state. Municipal or county law enforcement shall be
252255 required to notify the Bureau within the first six (6) hours of
253256 opening the local investigation .
254257 SECTION 3. It being immediately necessary for the preservation
255258 of the public peace, health or safety, an emergency is hereby
256259 declared to exist, by reason whereof this act shall take effect and
257260 be in full force from and after its passage an d approval.
