49 | 48 | | SECTION 1. AMENDATORY 47 O.S. 2021, Section 2 -108, is |
---|
50 | 49 | | amended to read as follows: |

51 | 50 | | Section 2-108. A. The Commissioner is hereby vested with the |
---|
52 | 51 | | power and is charged with the duty of observing, administering, and |
---|
53 | 52 | | enforcing the provisions of this title and of all laws regulating |
---|
54 | 53 | | the operation of vehicles o r the use of the highways, the |
---|
55 | 54 | | enforcement and administration of which are now or hereafter vested |
---|
56 | 55 | | in the Department. The Commissioner may appoint any employee of the |
---|
57 | 56 | | Department to serve as the personal representative of the |
---|
58 | 57 | | Commissioner for the purpose o f fulfilling any such duty or |
---|

101 | 101 | | payment of money due and owing to the State of Oklahoma. In l ieu of |

102 | 102 | | the signature of the Commissioner or the authorized facsimile |
---|
103 | 103 | | signature of the Commissioner, th e Commissioner may direct and |
---|
104 | 104 | | authorize any employee of the Department to affix the signature of |
---|
105 | 105 | | the employee to administrative letters, notices, and orde rs to |
---|

107 | 107 | | E. The Commissioner has the authority to enter into interage ncy |

108 | 108 | | transfers with the Oklahoma State Bureau of Investigation, the |

109 | 109 | | Oklahoma Bureau of Narcotics and Dangerous Drugs and the Oklahoma |

140 | 141 | | manhunt or missing child sit uation happens in the state. Municipal |

144 | 145 | | SECTION 2. AMENDATORY 74 O.S. 2021, Section 150.2, is |

146 | 147 | | Section 150.2. The Oklahoma State Bureau of Investigation shall |

148 | 149 | | 1. Maintain a nationally accredited scientific laboratory to |

149 | 150 | | assist all law enforcement agencies in the discove ry and detection |
---|
150 | 151 | | of criminal activity; |

152 | 153 | | including criminal history r ecords, juvenile identification files, |

153 | 154 | | and DNA profiles; |

154 | 155 | | 3. Establish, coordinate and maintain the automated fingerprint |

155 | 156 | | identification system (AFIS) and the deoxyribo nucleic acid (DNA) |
---|
156 | 157 | | laboratory; |

157 | 158 | | 4. Operate teletype, mobile and fixed radio or other |
---|
158 | 159 | | communications systems; |

159 | 160 | | 5. Conduct schools and training programs for the agents, pea ce |
---|
160 | 161 | | officers, and technicians of this state charged with the enforcement |

161 | 162 | | of law and order and the investigation and detection of crime; |

197 | 199 | | involving vehicle theft pursuant to Section 150.7a of this title or |
---|
198 | 200 | | oil, gas or oil field equipment theft pursuant to Sections 152.2 |
---|
199 | 201 | | through 152.9 of this title; |
---|
200 | 202 | | 9. Investigate any crimi nal threat made to the physical saf ety |
---|
201 | 203 | | of elected or appointed officials of this state or any political |
---|
202 | 204 | | subdivision of the state and forward the results of that |
---|
203 | 205 | | investigation to the Department of Public Sa fety, and provide |
---|
204 | 206 | | security to foreign elected or ap pointed officials while they are in |

205 | 207 | | this state on official business; |

206 | 208 | | 10. Investigate and detect violations of the Oklahoma Computer |

209 | 211 | | listed in Section 571 of Title 57 of the Oklahoma S tatutes that |

---|
238 | 241 | | records, assets, prope rties, buildings or employees of the Oklahoma |
---|
239 | 242 | | State Bureau of Investigation. Noth ing in this paragraph shall |
---|
240 | 243 | | limit or prevent any cr iminal investigation of the matter by the |
---|
241 | 244 | | sheriff of the county or any law enforcement agency of competent |
---|
242 | 245 | | jurisdiction; and |
---|
243 | 246 | | 13. Contract with municipal or county law enforcement agencies |
---|
244 | 247 | | to conduct administrative reviews of law enforcement use -of-force |
---|
245 | 248 | | investigations for compliance with c urrent investigative procedures, |
---|
246 | 249 | | standards and law. All funds received as a result of t he contract |
---|
247 | 250 | | will be deposited in the OSBI Revolving Fund. Any review of use -of- |
---|
248 | 251 | | force investigation shall be done by a certified poli ce officer; and |
---|
249 | 252 | | 14. Investigate and cooperate with munic ipal or county law |
---|
250 | 253 | | enforcement agencies when a manhunt or missing child situation |
---|
251 | 254 | | happens in the state. Municipal or county law enforcement shall be |
---|
252 | 255 | | required to notify the Bureau within the first six (6) hours of |
---|
253 | 256 | | opening the local investigation . |
---|
254 | 257 | | SECTION 3. It being immediately necessary for the preservation |
---|
255 | 258 | | of the public peace, health or safety, an emergency is hereby |
---|
256 | 259 | | declared to exist, by reason whereof this act shall take effect and |
---|
257 | 260 | | be in full force from and after its passage an d approval. |
---|
