77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 5-149.4 of Title 70, unless
80	80	there is created a duplication in numb ering, reads as follows:
81	81	A. If a school district board of education has adopted a policy
82	82	for drug testing of school employees for controlled substances that
83	83	are included in Schedule I of the Uniform Controlled Dangerou s
84	84	Substances Act, the policy sha ll include a provision requiring the
85	85	dismissal of an employee who tests positive on a single drug test.
86	86	B. The dismissal of an employee pursuant to this section shall
87	87	be exempt from the due process procedures provided by Se ction 6-
88	88	101.20 et. seq of Title 70 of the Oklahoma Statutes.

140	140	C. The provisions of subsection A of this section shall not
141	141	apply to a positive test for mari juana if the employee is a patient
142	142	licensed by the Oklahoma Medical Marijuana Authority.
143	143	SECTION 2. This act shall become ef fective July 1, 2023.
144	144	SECTION 3. It being immediately necessary for the preservation
145	145	of the public peace, health , or safety, an emergency is hereby
146	146	declared to exist, by reason whereof thi s act shall take effect and
147	147	be in full force from a nd after its passage and approval.
