85	85	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKL AHOMA:
86	86	SECTION 1. NEW LAW A new section of law to be codified
87	87	in the Oklahoma Statutes as Section 5-144.1 of Title 70, unless
88	88	there is created a duplication in numb ering, reads as follows:
89	89	A. As used in this section, “offenses against students” means
90	90	crimes or attempts to commit crimes provided for in Section 843.5 of
91	91	Title 21 of the Oklahoma Statutes if th e offense involved sexual
92	92	abuse or sexual exploitation as those terms are defined in Section

145	145	if the offense included sexual abuse or sexual exploitation, 865 et
146	146	seq., 885, 888, 891, 1021, 1 021.2, 1021.3, 1040.13a, 1087, 1088,
147	147	1111.1, 1114, or 1123 of Title 21 of the Oklahom a Statutes.
148	148	B. If an individual employed by a public school district,
149	149	public charter school, or public virtual charter school in this
150	150	state:
151	151	1. Is being investigated for or has been arrested in relation
152	152	to offenses against students; or
153	153	2. Has been charged with offenses against students,
154	154	the law enforcement agency involved in the invest igation, arrest, or
155	155	charging shall notify the superintendent of the employing school
156	156	district, public charter school, or public virtual charter school
157	157	and the members of the board of education of the employing schoo l
158	158	district or the members of the governing board o f the employing
159	159	public charter school or public virtual charter school .
160	160	C. 1. Upon receiving a notification as provided for in
161	161	subsection B of this section, the board of education of the
162	162	employing school district or the governing board of the employing
163	163	public charter school or public vi rtual charter school shall suspend
164	164	the school employee without notice or hearing pending the outcome of
165	165	the law enforcement investigatio n. The suspension shall not deprive
166	166	the employee of any compensation or oth er benefits to which he or

218	218	she is otherwise entitled. The employee shall not be allowed on
219	219	school premises during the term of suspension.
220	220	2. In a case involving a crimin al charge or indictment, the
221	221	suspension may extend until the case for the employee is adjudicated
222	222	at trial. The extension shall not include any appeal process.
223	223	D. Upon receiving a notification as provided for in subsection
224	224	B of this section, the superintendent of the employing school
225	225	district, public charter school, or public virtual charter school
226	226	shall notify the parents and legal gu ardians of students enrolled in
227	227	the school district, charter school, or v irtual charter school . The
228	228	notification shall include a statement explaining that the school
229	229	employee is presumed innocent unti l and unless proven guilty.
230	230	E. The State Board of Education shall promulgate rules to
231	231	implement the provisions of this section.
232	232	SECTION 2. This act shall become effective July 1, 2023.
233	233	SECTION 3. It being immediately necessary for the pre servation
234	234	of the public peace, health , or safety, an emergency is hereby
235	235	declared to exist, by reason whereof thi s act shall take effect and
236	236	be in full force from and after its passage and approval.
