89	89	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
90	90	SECTION 1. NEW LAW A new section of law to be codified
91	91	in the Oklahoma Statutes as Section 5-5.1 of Title 2, unless there
92	92	is created a duplication in numb ering, reads as follows:
93	93	This act shall be known and may be cited as the “Oklahoma Food
94	94	Freedom Act”.

146	146	SECTION 2. NEW LAW A new section of law to be codified
147	147	in the Oklahoma Statutes as Section 5-5.2 of Title 2, unless there
148	148	is created a duplication in numb ering, reads as follows:
149	149	As used in the Oklahoma Food Freedom Act:
150	150	1. “Delivery” shall mean the transfer of a product r esulting
151	151	from a transaction between a producer and an informed end consumer.
152	152	The delivery may occur by the producer ’s designated agent at a farm,
153	153	ranch, farmers market, home, office , or any location agreed to
154	154	between the producer and the informed end consumer;
155	155	2. “Home consumption” shall mean food products consumed within
156	156	a private home, or food from a private home that is only consumed by
157	157	family members, employees , or nonpaying guests;
158	158	3. “Homemade” shall mean food that is prepared or processed in
159	159	a private home kitchen, that is not licensed, inspected , or
160	160	regulated;
161	161	4. “Informed end consumer” shall mean a person who is the last
162	162	person to purchase any product, who does not resell the product , and
163	163	who has been informed that the pro duct is not licensed, regulated,
164	164	or inspected;
165	165	5. “Process” shall mean operations a producer pe rforms in the
166	166	making or treatment of the producer ’s food or drink products;
167	167	6. “Producer” shall mean any person who grows, harvests,
168	168	prepares, or processes any food or drink products on the person’s
169	169	owned or leased property; and

222	222	SECTION 3. NEW LAW A new section of law to be codified
223	223	in the Oklahoma Statutes as Section 5-5.3 of Title 2, unless there
224	224	is created a duplication in numbering, reads as follows:
225	225	A. Homemade food products produced, sold , and consumed in
226	226	compliance with the Oklahoma Food Freedom Act shall be exempt from
227	227	state licensure, permitting, inspection, packaging , and labeling
228	228	requirements, except as otherwise provided in this act .
229	229	B. Transactions under this act shall:
230	230	1. Be directly between the producer and the informed end
231	231	consumer;
232	232	2. Only be for home consumption;
233	233	3. Occur only in this state;
234	234	4. Not involve interstate commerce;
235	235	5. Not involve the s ale of meat products, except:
236	236	a. the sale of poultry products, provided:
237	237	(1) the producer slaughters no more than one thousand
238	238	(1,000) poultry of their own raising on their own
239	239	farm during any one (1) calendar year,
240	240	(2) the producer does not engage in buying or selling
241	241	poultry products other than those produced fro m
242	242	poultry of their own raising on their own farm,

295	295	(3) the poultry product is not adulterated or
296	296	misbranded,
297	297	b. the sale of live animals,
298	298	c. the sale of portions of live animals before slaughter
299	299	for future delivery,
300	300	d. the sale of domestic rabbit meat, and
301	301	e. the sale of farm-raised fish, provided the fish is
302	302	raised in compliance with Section 6 -311 et seq. of
303	303	Title 2 of the Oklahoma S tatutes; and
304	304	6. Only occur at farmers markets, farms, ranches, producers’
305	305	homes or offices, or any location the producer and the informed en d
306	306	consumer agree to.
307	307	C. Except for raw, unprocessed fruits and vegetables, food
308	308	shall not be sold or used in any commercial food establish ment
309	309	unless the food has been labeled, lic ensed, packaged, regula ted, or
310	310	inspected as required by law.
311	311	D. The provisions of the Oklahoma Food Freedom Act shall not
312	312	prohibit the sale of homemade food for home cons umption from a
313	313	retail space located at the ranch, farm, or home where the food is
314	314	produced. A retail space selling homemade food under the provisions
315	315	of the Oklahoma Food Freedom Act shall inform the end consumer that
316	316	the homemade food has not been inspected and shall display a sign
317	317	indicating that the homemade food has not been inspected. If the
318	318	retail space is in any way associated with a commercial food

370	370	establishment or offers for sale any inspected product, the retail
371	371	space selling homemade food shall comply with rules adopted by the
372	372	Oklahoma Department of Agriculture, Food, and Forestr y which shall
373	373	require:
374	374	1. That the retail space be physically separated fr om the
375	375	commercial food establishment with a separate door and separate cash
376	376	register or point of sale;
377	377	2. That each separate space shall include signs or other
378	378	markings clearly ind icating which spaces are offering inspected
379	379	items for sale and which spaces are uninspected;
380	380	3. Coolers, freezers, and warehouse or other storage areas
381	381	shall be separated to prohibit the intermingling of inspecte d and
382	382	uninspected products; and
383	383	4. Any other requirements speci fied by the Department to ensure
384	384	the sale of homemade f oods is made to an informed end consumer.
385	385	E. The producer shall inform the end consumer that any food
386	386	product or food sold at a farmers market or through ranch, farm, or
387	387	home-based sales pursuant to the provisions of the Oklahoma Food
388	388	Freedom Act is not certified, labeled, licensed, packaged,
389	389	regulated, or inspected.
390	390	F. The provisions of the Oklahoma Food Freedo m Act shall not be
391	391	construed to:
392	392	1. Impede the State Department of Healt h in any investigation
393	393	of foodborne illness;

446	446	health inspections; or
447	447	3. Preclude an agency from providing assistance, consultation ,
448	448	or inspection, at the request of the producer.
449	449	SECTION 4. NEW LAW A new section of law to be codified
450	450	in the Oklahoma Statutes as Section 5-5.4 of Title 2, unless there
451	451	is created a duplication in numb ering, reads as follows:
452	452	A. The provisions of the Oklahoma Food Freedom Act shall not be
453	453	construed to prevent the sale of prepared foods in compliance with
454	454	the Homemade Food Freedom Act .
455	455	B. The Oklahoma Department of Agriculture, Food, and Forestry
456	456	may promulgate rules to enforce the provisions of the Oklahoma Food
457	457	Freedom Act.
458	458	SECTION 5. It being immediately necessary f or the preservation
459	459	of the public peace, health or safety, an emergency is hereby
460	460	declared to exist, by reason whereof this act shall take effect and
461	461	be in full force from an d after its passage and approval.
