7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. NEW LAW A new section of law to be codified
7575 in the Oklahoma Statutes as Section 13001 of Title 74, unless there
7676 is created a duplication in numbering, reads as follows:
7777 A. There is hereby created the Oklahoma C ommission on Race and
7878 Equality. The Commission shall consist of thirteen (13) members.
7979 The members shall be appointed as follows : three members shall be
8080 appointed by the Governor, three members shall be appointed by the
8181 President Pro Tempore of the Sena te, three members shall be
8282 appointed by the Speaker of the House of Repres entatives, and four
8383 members shall be app ointed by the Oklahoma Legislative Black Caucus .
8484 All members shall be appointed by the app ropriate appointing
8585 authority for a term of three (3) years commencing with the date
8686 that the previous appointee ’s term expired. Each member shall serve

138138 no more than three (3) terms. The member shall only serve two (2)
139139 consecutive terms and shall be inac tive for a period of one (1) year
140140 prior to serving the maximum three-term limit. In making such
141141 appointments, consideration shall be give n to making the membership
142142 broadly representative of the geographic areas of the state and the
143143 several racial and et hnic groups residing in the state. Each member
144144 shall hold office until the successor of the member is appointed and
145145 has qualified. A member of the Commission may be removed by the
146146 appropriate appointing authority for cause. A member appointed to
147147 fill a vacancy occurring before the expiration of a term of a member
148148 separated from the Commission for any cause shall b e appointed for
149149 the remainder of the term of the member whose offic e has been so
150150 vacated. Members of the Commission shall receive no salary but
151151 shall be entitled to travel reimbursement as provid ed by the State
152152 Travel Reimbursement Act from funds available to the appropriate
153153 appointing authority.
154154 B. The Office of Manage ment and Enterprise Services shall
155155 provide staff support to the Oklahoma Commi ssion on Race and
156156 Equality and make arrangements fo r suitable meeting space for the
157157 Commission as needed.
158158 C. The initial chair sha ll be appointed by the Oklahoma
159159 Legislative Black Caucus , with the approval of the Governor,
160160 President Pro Tempore of the Sen ate, and Speaker of the House of
161161 Representatives. After the initial chair’s first term ends, t he

213213 President Pro Tempore of the Senate shall name the chair of the
214214 Oklahoma Commission on Race and Equal ity, and the Speaker of the
215215 House of Representatives shall name the vice chair. Any other
216216 officers deemed necessary shall be elected from among the members at
217217 the first meeting of the Commission. Thereafter, at the fi rst
218218 meeting of each fiscal year, the Commission shall elect a chair, a
219219 vice chair and such other officers deemed necessary to conduct the
220220 business of the Commission from among its members. The Commission
221221 shall meet at least once every three (3) months and at such other
222222 times as called by the chair or by a majority of the Commission.
223223 D. The Oklahoma Commission on Race and Equality shal l have the
224224 power and the duty to:
225225 1. Advise on equality issues relating to racial discrimination
226226 and bias, state agencies and employees, communities, organizations,
227227 and businesses of this state which desire the services of the
228228 Commission;
229229 2. Monitor legislation to determine whether legislation is
230230 discriminatory toward one race or ethni city or whether the race or
231231 ethnicity of an individual would have an effect o n the enforcement
232232 of the legislation;
233233 3. Act as a resource and a clearinghouse for research on issues
234234 related to racial discrimination and bias;
235235 4. Act as a resource in any state appointments to commissions
236236 and boards for diversity ;

288288 5. Conduct meetings and se minars within the state as
289289 appropriate to support the goals and duties of the Commission; and
290290 6. Report to the Governor, the Presiden t Pro Tempore of the
291291 Senate, and the Speaker of the House of Representatives of its
292292 activities. The report may include recommendations concerning
293293 needed legislation or regulatory changes relating to racial
294294 discrimination and bias.
295295 SECTION 2. NEW LAW A new section of law to be codified
296296 in the Oklahoma Statutes as Section 13002 of Title 74, unless there
297297 is created a duplication in numbering, reads as follows:
298298 There is hereby created in the State Treasury a revolving fund
299299 for the Office of Management and Enterprise Services designated the
300300 “Oklahoma Commission on Race and Equality Revolving Fund”. The fund
301301 shall be a continuing fund, not subject to fiscal year limitations,
302302 and shall consist of all gifts and donations contributed to sup port
303303 the work of the Oklahoma Commission on Race and Equality. All
304304 monies accrued to the credit of the fund are hereby appropriated and
305305 may be budgeted and expended by the Director of the Office of
306306 Management and Enterprise Services on behalf of the Okla homa
307307 Commission on Race and Equality for the purposes prescribed by the
308308 Legislature in creating the Commission. Expenditures from the fund
309309 shall be made upon warrants issued by the State Treasurer against
310310 claims filed as prescribed by law with the Direct or of the Office of
311311 Management and Enterprise Services for approval and paym ent.
