73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
74	74	SECTION 1. NEW LAW A new section of law to be codified
75	75	in the Oklahoma Statutes as Section 13001 of Title 74, unless there
76	76	is created a duplication in numbering, reads as follows:
77	77	A. There is hereby created the Oklahoma C ommission on Race and
78	78	Equality. The Commission shall consist of thirteen (13) members.
79	79	The members shall be appointed as follows : three members shall be
80	80	appointed by the Governor, three members shall be appointed by the
81	81	President Pro Tempore of the Sena te, three members shall be
82	82	appointed by the Speaker of the House of Repres entatives, and four
83	83	members shall be app ointed by the Oklahoma Legislative Black Caucus .
84	84	All members shall be appointed by the app ropriate appointing
85	85	authority for a term of three (3) years commencing with the date
86	86	that the previous appointee ’s term expired. Each member shall serve

139	139	consecutive terms and shall be inac tive for a period of one (1) year
140	140	prior to serving the maximum three-term limit. In making such
141	141	appointments, consideration shall be give n to making the membership
142	142	broadly representative of the geographic areas of the state and the
143	143	several racial and et hnic groups residing in the state. Each member
144	144	shall hold office until the successor of the member is appointed and
145	145	has qualified. A member of the Commission may be removed by the
146	146	appropriate appointing authority for cause. A member appointed to
147	147	fill a vacancy occurring before the expiration of a term of a member
148	148	separated from the Commission for any cause shall b e appointed for
149	149	the remainder of the term of the member whose offic e has been so
150	150	vacated. Members of the Commission shall receive no salary but
151	151	shall be entitled to travel reimbursement as provid ed by the State
152	152	Travel Reimbursement Act from funds available to the appropriate
153	153	appointing authority.
154	154	B. The Office of Manage ment and Enterprise Services shall
155	155	provide staff support to the Oklahoma Commi ssion on Race and
156	156	Equality and make arrangements fo r suitable meeting space for the
157	157	Commission as needed.
158	158	C. The initial chair sha ll be appointed by the Oklahoma
159	159	Legislative Black Caucus , with the approval of the Governor,
160	160	President Pro Tempore of the Sen ate, and Speaker of the House of
161	161	Representatives. After the initial chair’s first term ends, t he

213	213	President Pro Tempore of the Senate shall name the chair of the
214	214	Oklahoma Commission on Race and Equal ity, and the Speaker of the
215	215	House of Representatives shall name the vice chair. Any other
216	216	officers deemed necessary shall be elected from among the members at
217	217	the first meeting of the Commission. Thereafter, at the fi rst
218	218	meeting of each fiscal year, the Commission shall elect a chair, a
219	219	vice chair and such other officers deemed necessary to conduct the
220	220	business of the Commission from among its members. The Commission
221	221	shall meet at least once every three (3) months and at such other
222	222	times as called by the chair or by a majority of the Commission.
223	223	D. The Oklahoma Commission on Race and Equality shal l have the
224	224	power and the duty to:
225	225	1. Advise on equality issues relating to racial discrimination
226	226	and bias, state agencies and employees, communities, organizations,
227	227	and businesses of this state which desire the services of the
228	228	Commission;
229	229	2. Monitor legislation to determine whether legislation is
230	230	discriminatory toward one race or ethni city or whether the race or
231	231	ethnicity of an individual would have an effect o n the enforcement
232	232	of the legislation;
233	233	3. Act as a resource and a clearinghouse for research on issues
234	234	related to racial discrimination and bias;
235	235	4. Act as a resource in any state appointments to commissions
236	236	and boards for diversity ;

289	289	appropriate to support the goals and duties of the Commission; and
290	290	6. Report to the Governor, the Presiden t Pro Tempore of the
291	291	Senate, and the Speaker of the House of Representatives of its
292	292	activities. The report may include recommendations concerning
293	293	needed legislation or regulatory changes relating to racial
294	294	discrimination and bias.
295	295	SECTION 2. NEW LAW A new section of law to be codified
296	296	in the Oklahoma Statutes as Section 13002 of Title 74, unless there
297	297	is created a duplication in numbering, reads as follows:
298	298	There is hereby created in the State Treasury a revolving fund
299	299	for the Office of Management and Enterprise Services designated the
300	300	“Oklahoma Commission on Race and Equality Revolving Fund”. The fund
301	301	shall be a continuing fund, not subject to fiscal year limitations,
302	302	and shall consist of all gifts and donations contributed to sup port
303	303	the work of the Oklahoma Commission on Race and Equality. All
304	304	monies accrued to the credit of the fund are hereby appropriated and
305	305	may be budgeted and expended by the Director of the Office of
306	306	Management and Enterprise Services on behalf of the Okla homa
307	307	Commission on Race and Equality for the purposes prescribed by the
308	308	Legislature in creating the Commission. Expenditures from the fund
309	309	shall be made upon warrants issued by the State Treasurer against
310	310	claims filed as prescribed by law with the Direct or of the Office of
311	311	Management and Enterprise Services for approval and paym ent.
