6565 An Act relating to guardianship; defining terms;

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 3-131 of Title 30, unless there
8080 is created a duplication in numbering, reads as fol lows:
8181 A. As used in this act:
8282 1. “Gravely disabled” means a condition in which a person,
8383 because of a mental disorder, is unable to provide for his or her
8484 basic personal needs for food, clothing, or shelter; and
8585 2. “Inpatient mental health treatment” means a treatment
8686 service offered or provided for a continuous period of more than
8787 twenty-four (24) hours in residence after admission to a mental

139139 health or substance abuse treatment facility for the purpose of
140140 observation, evaluation, or treatment.
141141 B. A guardian who has obtained an order by a court for
142142 inpatient mental health treatment for the ward may apply for an
143143 order requiring either municipal or county officials to retrieve and
144144 deliver the gravely disabled ward to an inpatient treatment facility
145145 when one of the following criteria is met:
146146 1. The ward is unable to utilize the means available to provide
147147 for his or her basic personal needs regarding food, clothing, or
148148 shelter. Considerations that shall be made when making this
149149 evaluation include but are not limited to:
150150 a. whether lab examinations reveal signs of malnutrition
151151 or dehydration,
152152 b. whether there is observed, do cumented behavior showing
153153 an inability to consume adequate amounts of food or
154154 water due to a mental illness,
155155 c. whether there is a history of public nudity or an
156156 inadvertent exhibiti onism which has been observed and
157157 documented and is due to a men tal illness,
158158 d. the existence of physical evidence of exposure to the
159159 environment due to mental illness symptoms which
160160 prevent the ward from wearing adequate clothing,

212212 e. whether there is observed behavior and symptoms of a
213213 mental illness which prevents the ward from utilizing
214214 or obtaining adequate shelter ,
215215 f. the existence of a repeated and recent history of
216216 failure to maintain adequate shelter in the community
217217 due to behaviors and symptoms of a mental illness, or
218218 g. evidence of a failure to maintain a shelter in a
219219 manner that is safe to live in, due to symptoms of a
220220 mental illness;
221221 2. The ward is unable to voluntarily request and receive
222222 assistance for his or her basic personal needs; or
223223 3. The ward is unable to survive safely without involuntary
224224 detention and does not have the help of family members, friends, or
225225 others to provide the person’s basic personal needs regarding food,
226226 clothing, or shelter.
227227 C. No person shall be presumed to be incompetent because the
228228 person has been evaluated or treated f or a mental disorder,
229229 regardless of whether such evaluation or treatment was voluntarily
230230 or involuntarily received.
231231 SECTION 2. This act shall become effective November 1, 2023.
