7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 2021, Section 2-305, is
7777 amended to read as follows:
7878 Section 2-305. A. Before denying, suspending or revoking a
7979 registration, refusing a renewal of registration or taking
8080 administrative action on a n onregistrant engaged in manufacturing,
8181 distributing, dispensin g, prescribing, administeri ng or using for
8282 scientific purposes any controlled dangerous substance within or
8383 into this state, the Director shall serve upon the applicant or
8484 registrant an order to show cause why registration should not be
8585 denied, revoked or suspended or why the renewa l should not be
8686 refused. The order to show cause shall contain a statement of the
8787 basis therefor and shall call upon the applicant or registrant to

139139 appear before the appropriate person or agency at a time and place
140140 within thirty (30) days after the date o f service of the order , but
141141 in the case of a denial or renewal of registration the show cause
142142 order shall be served within thirty (30) days before the expiration
143143 of the registration. These proceedings shall be conducted in
144144 accordance with the Administrati ve Procedures Act without regard to
145145 any criminal prosecution or other proceeding . Proceedings to refuse
146146 renewal of registration shall not abate the existing registrat ion
147147 which shall remain in effect pending the outcome of the
148148 administrative hearing.
149149 B. The Director shall suspend, without an order to show cause,
150150 any registration simultaneously with the institut ion of proceedings
151151 under Section 2-304 of this title, if h e or she finds there is
152152 imminent danger to the public health or safety which warrants this
153153 action. The suspension shall continue in effect until the
154154 conclusion of the proceedings , including judicial review thereof,
155155 unless sooner withdrawn by the Director or dissolved by a court of
156156 competent jurisdiction.
157157 SECTION 2. This act shall become effective November 1, 2023.
