75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 63 O.S. 2021, Section 2-305, is
77	77	amended to read as follows:
78	78	Section 2-305. A. Before denying, suspending or revoking a
79	79	registration, refusing a renewal of registration or taking
80	80	administrative action on a n onregistrant engaged in manufacturing,
81	81	distributing, dispensin g, prescribing, administeri ng or using for
82	82	scientific purposes any controlled dangerous substance within or
83	83	into this state, the Director shall serve upon the applicant or
84	84	registrant an order to show cause why registration should not be
85	85	denied, revoked or suspended or why the renewa l should not be
86	86	refused. The order to show cause shall contain a statement of the
87	87	basis therefor and shall call upon the applicant or registrant to

139	139	appear before the appropriate person or agency at a time and place
140	140	within thirty (30) days after the date o f service of the order , but
141	141	in the case of a denial or renewal of registration the show cause
142	142	order shall be served within thirty (30) days before the expiration
143	143	of the registration. These proceedings shall be conducted in
144	144	accordance with the Administrati ve Procedures Act without regard to
145	145	any criminal prosecution or other proceeding . Proceedings to refuse
146	146	renewal of registration shall not abate the existing registrat ion
147	147	which shall remain in effect pending the outcome of the
148	148	administrative hearing.
149	149	B. The Director shall suspend, without an order to show cause,
150	150	any registration simultaneously with the institut ion of proceedings
151	151	under Section 2-304 of this title, if h e or she finds there is
152	152	imminent danger to the public health or safety which warrants this
153	153	action. The suspension shall continue in effect until the
154	154	conclusion of the proceedings , including judicial review thereof,
155	155	unless sooner withdrawn by the Director or dissolved by a court of
156	156	competent jurisdiction.
157	157	SECTION 2. This act shall become effective November 1, 2023.
