5183 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5284 SECTION 1. AMENDATORY 24 O.S. 2021, Se ction 148, is
5385 amended to read as follows:
5486 Section 148. A. Prior to requesting a consumer report for
5587 employment purposes, the requestor or user of the consumer report
5688 shall provide written notice to the person who is the subject of the
5789 consumer report. The notice shall inform th e consumer that a
5890 consumer report will be used and the notice shall contain a box that
5991 the consumer may check to receive a copy of the consumer report. If
60-the consumer requests a copy of the report, the user of the co nsumer
61-report shall request that a cop y be provided to the consumer w hen
62-the user of the consumer report requests its copy from the credit

143+the consumer requests a copy of the report, the user of the co nsumer

146+reporting agency. The report sent to the consumer shall be provided
91147 at no charge to the consumer. As used in this s ection, “consumer
92148 report” shall have the same meaning as that term is defined in the
93149 federal Fair Credit Reporting Act, 15 U .S.C., Sections 1681 et seq.
94150 B. Consumer background reports as defined by 15 U.S.C ., Section
95151 1681 et seq., including criminal history background reports,
96152 provided for any purpose other than law enforce ment investigation or
97153 a pending judicial proceeding provided by any consumer reporting
98154 agency as defined by 15 U.S.C., Section 1681 et seq., including
99155 state agencies and political subdivisions, shall comply with the
100156 provisions of 15 U.S.C., Section 1681 et seq.
101157 C. Prohibitions on d isclosure of certain backgr ound information
102158 and criminal history information as provided by 15 U.S.C., Section
103159 1681 et seq. shall be considered a confidential privilege und er the
104160 Oklahoma Open Records Act.
105161 D. Employees who maintain a policy of not hiring ex-felons for
106162 whatever reason shall disclose on the job application and job
107163 posting, wherever it is posted, the following statement:
108164 “Individuals with felonies will not be considered for this
109165 position.”
110166 E. Inquiring about Felonies on Employment Applications:
111-1. Employers may not ask on the application or throughout the
112-hiring process if an employment candidate has been convicted of a

143223 2. Law enforcement, judiciary, education institutions care

155235 disregard for public or personal safety while in some dire ct
156236 violation of these provisions.
157237 G. No person shall be held liable for any v iolation of this
158238 section if such person shows by a preponde rance of the evidence
159239 that, at the time of the alleged violation, such perso n maintained
160240 reasonable procedures to assure compliance with this section.

292+SECTION 2. AMENDATORY 57 O.S. 2021, Section 138, is
293+amended to read as follows:
294+Section 138. A. Except as otherwise provided by l aw, every
295+inmate of a state correctional institution shall have their term of
192296 imprisonment reduced monthl y, based upon the class level to which
193297 they are assigned. Earned credits may be subtracted from the total
194298 credits accumulated by an inmate, upon recom mendation of the
195299 institution’s disciplinary committee, following due process, and
196300 upon approval of the wa rden or superintendent. Each earned credit
197301 is equivalent to one (1) day of incarceration. Lost cred its may be
198302 restored by the warden or superintenden t upon approval of the
199303 classification committee. If a maximum and minimum term of
200304 imprisonment is impose d, the provisions of this sub section shall
201305 apply only to the maximum term . No deductions shall be cr edited to
202306 any inmate serving a sentence of life im prisonment; however, a
203307 complete record of the inmate ’s participation in work, school,
204308 vocational training, or other approved program s hall be maintained
205309 by the Department for con sideration by the paroling a uthority. No
206310 earned credit deductions shall be cr edited or recorded for any
207311 inmate serving any sentence for a criminal act which resulted in the
208312 death of a police officer, a law enfor cement officer, an employee of
209313 the Department of Corrections, or an empl oyee of a private prison
210314 contractor and the death occurred while the police officer, law
211315 enforcement officer, employee of the Department of Corrections, or
212-employee of a private prison contractor was acting within the scope
213-of their employment. No earned credit deductions shall be credited
214-or recorded for any person who is referred to an intermediate

367+employee of a private prison contractor was acting within the scope
368+of their employment. No earned credit deductions shall be credited
369+or recorded for any person who is referred to an intermediate
242370 revocation facility for violating any of the terms and co nditions of
243371 probation.
244372 B. The Department of Corrections is directed to d evelop a
245373 written policy and procedure whereby inmates shall be assigned to
246374 one of four class levels determined by an adjustment review
247375 committee of the facility to which the inmate is assigned. The
248376 policies and procedures developed by the Department shall include,
249377 but not be limited to, written guidelines pertaining to awarding
250378 credits for rehabilitation, obtaining job skills and educational
251379 enhancement, participation in and completio n of alcohol/chemical
252380 abuse programs, incentives for inmates to accept wo rk assignments
253381 and jobs, work attendance and productivity, conduct record,
254382 participation in programs, cooperative general behavior, and
255383 appearance. When assigning inmates to a class level the adjustment
256384 review committee shall consider all aspects of the p olicy and
257385 procedure developed by the Department including but not limited to
258386 the criteria for awarding credits required by this subsection.
259387 C. If an inmate is subject to misconduct, nonperformance or
260388 disciplinary action, earned credits may be removed acco rding to the
261389 policies and procedures developed by the Department. Earned cred its
262-removed for misconduct, nonperformance or disciplinary action may be
263-restored as provided by Departme nt policy, if any.
264-D. 1. Class levels shall be as follows:

443+D. 1. Class levels shall be as follows:
292444 a. Class level 1 shall include inmates n ot eligible to
293445 participate in class levels 2 throu gh 4, and shall
294446 include, but not be limited to, inmates on escape
295447 status.
296448 b. Class level 2 shall include an inmate who has been
297449 given a work, education, or program assignment, ha s
298450 received a good evaluation for participation in the
299451 work, education, or prog ram assignment, and has
300452 received a good evaluation for personal hygiene and
301453 maintenance of living area.
302454 c. Class level 3 shall include an inmate who has been
303455 incarcerated at leas t three (3) months, has rece ived
304456 an excellent work, education, or program eval uation,
305457 and has received an excellent evaluation for personal
306458 hygiene and maintenance of living area.
307459 d. Class level 4 shall include a n inmate who has been
308460 incarcerated at least eight (8) months, has receiv ed
309461 an outstanding work, education, or program eval uation,
310462 and has received an outstanding evaluation for
311463 personal hygiene and maintenance of living area.
312-2. a. Until November 1, 2001, class level corresponding
313-credits are as follows:

358534 delinquent as a juvenile for a felony offense
359535 enumerated in subsection E of this section a re as
360536 follows:
361537 Class 1 – 0 Credits per month;
362538 Class 2 – 22 Credits per month;
363-Class 3 – 45 Credits per month;
364-Class 4 – 60 Credits per month.
365-Each inmate shall receive the above speci fied monthly credits

592+Each inmate shall receive the above speci fied monthly credits
593+for the class to which he or she is assigned. In de termining the
394594 prior criminal history of the inmate, the Department of Correcti ons
395595 shall review criminal history records available through the Oklahoma
396596 State Bureau of Investigation, F ederal Bureau of Investigatio n, and
397597 National Crime Information Center to determine the reported felon y
398598 convictions of all inmates. The Department of C orrections shall
399599 also review the Office of Juvenile Affairs Juvenile On -line Tracking
400600 System for inmates who were adjudicated delinque nt or convicted as a
401601 youthful offender for a crime that would be an offe nse enumerated in
402602 subsection E of this section.
403603 3. In addition to the criteria established for each class in
404604 paragraph 1 of this subsection, the following requirements shall
405605 apply to each of levels 2 through 4:
406606 a. satisfactory participation in the work, e ducation, or
407607 program assignment at the standard re quired for the
408608 particular class level,
409609 b. maintenance of a clean and orderly living area and
410610 personal hygiene at the standard required for the
411611 particular class level,
412612 c. cooperative behavior toward facility staff and other
413613 inmates, and
414-d. satisfactory participation in the requirements of the
415-previous class level.
416-4. The evaluation scale for assessing perform ance shall be as

445669 a. Outstanding - For inmates who display consis tently
446670 exceptional initiativ e, motivation, and work habits.
447671 b. Excellent - For inmates who display above -average work
448672 habits with only minor errors and rarely perform below
449673 expectations.
450674 c. Good - For inmates who perform in a satisfactory
451675 manner and complete tasks as required, doing what is
452676 expected, with only occasional performance above or
453677 below expectations.
454678 d. Fair - For inmates who may perform satisfactorily for
455679 some periods of time, but whose performance is marked
456680 by obviously deficient and weak areas and could be
457681 improved.
458682 e. Poor - For inmates whose performance is unsatisfact ory
459683 and falls below expected and acceptable standards.
460684 E. No person ever convicted as an adult or a yout hful offender
461685 or adjudicated delinquent as a juvenile in this state for a ny felony
462686 offense enumerated in this subsection or a similar felony offense
463687 pursuant to the provisions of another state, the United States, or a
464688 military court shall be eligible for t he credits provided by the
465-provisions of subparagraph c of paragraph 2 of subsection D of this
466-section.

7991191 F. The policy and procedure developed b y the Department of
8001192 Corrections shall includ e provisions for adjustment review
8011193 committees of not less than three members f or each such committee.
8021194 Each committee shall consist of a classification team supervisor who
8031195 shall act as chairman, the case manager for the inmate being
8041196 reviewed or classified, a correctional officer or i nmate counselor,
8051197 and not more than two other membe rs, if deemed necessary, determined
8061198 pursuant to policy and procedure to be appropriate for the specific
8071199 adjustment review committee or committees to which they are
8081200 assigned. At least once every four (4) mo nths the adjustment review
8091201 committee for each inma te shall evaluate the class level status and
8101202 performance of the inmate and determine whether or not the c lass
8111203 level for the inmate sho uld be changed.
8121204 Any inmate who feels aggriev ed by a decision made by an
8131205 adjustment review committee may utilize normal gri evance procedures
8141206 in effect with the Department of Corrections and in effect at the
8151207 facility in which the inmate is incarcerated.
816-G. Inmates granted medical leaves for treatment that cannot be
817-furnished at the penal institution where incarcerated shall be
818-allowed the time spent on medical leave as time served. Any inmate
819-placed into administrative segregati on for nondisciplinary reason s
820-by the institution’s administration may be placed in Class 2. The

8551271 paragraph 1 of subsection D of this section, beginning o n the date
8561272 of the judgment and sentence, unless th e inmate is convicted of a
8571273 misdemeanor or felony committed in the jail while the inmate is
8581274 awaiting transport to the Lexington Assessm ent and Reception Center
8591275 or other assessment and reception location dete rmined by the
8601276 Director of the Department of Correc tions.
8611277 H. Additional achievement earned credits for successful
8621278 completion of departmentally approved pro grams or for attaining
8631279 goals or standards set by the Department , acquiring postsecondary
8641280 education or vocation training and securing and maintaining
8651281 employment shall be awarded to any inmate, parol ee, or probationer
8661282 as follows:
