51	48		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	49		SECTION 1. AMENDATORY 51 O.S. 2021, Section 152, as last
53	50		amended by Section 18, Chapter 228, O.S.L. 2022 (51 O.S. Supp. 2022,
54	51		Section 152), is amended to read as follows:
55	52		Section 152. As used in The Governmental T ort Claims Act:
56	53		1. “Action” means a proceeding in a court of competent
57	54		jurisdiction by which one party brings a suit against another;
58	55		2. “Agency” means any board, commission, comm ittee, department
59	56		or other instrumentality or entity designated to act in b ehalf of
60	57		the state or a political subdivision;
61	58		3. “Charitable health care provider ” means a person who is
62	59		licensed, certified, or othe rwise authorized by the laws of this
	60	+	state to administer health care in the ordinary course of business
	61	+	or the practice of a profession and who provides care to a medically

90		-	state to administer health care in the ordinary course of business
91		-	or the practice of a profession and who provides care to a medically
92	88		indigent person, as defined in par agraph 9 of this section, with no
93	89		expectation of or acceptance of compensation of any kind;
94	90		4. “Claim” means any written demand presented by a claimant or
95	91		the claimant’s authorized representative in accordance with the
96	92		Governmental Tort Claims Ac t to recover money from the state or
97	93		political subdivisio n as compensation for an act or omissi on of a
98	94		political subdivision or the state or an employee;
99	95		5. “Claimant” means the person or the person’s authorized
100	96		representative who files notice of a claim in accordance with The
101	97		Governmental Tort Claims Act. On ly the following persons and no
102	98		others may be claimants:
103	99		a. any person holding an interest in real or personal
104	100		property which suffers a loss, provided that the claim
105	101		of the person shall be aggregated with claims of all
106	102		other persons holding an interest in the property and
107	103		the claims of all othe r persons which are derivative
108	104		of the loss, and that multiple claimants shall be
109	105		considered a single claimant,
110	106		b. the individual actually involved in the accid ent or
111	107		occurrence who suffers a loss, provided that the
112	108		individual shall aggregate in the claim t he losses of
113	109		all other persons which are derivative of the loss, or
	110	+	c. in the case of death, an administrator, special
	111	+	administrator or a personal representat ive who shall

141		-	c. in the case of death, an administrator, special
142		-	administrator or a personal representat ive who shall

145	140		6. “Community health care provider” means:
146	141		a. a health care provider who volunteers services at a
147	142		community health center that has been deemed by the
148	143		U.S. Department of Health and Human Services as a
149	144		federally qualified health center as defined by 42
150	145		U.S.C., Section 1396d(l)(2)(B),
151	146		b. a health provider who provides services to an
152	147		organization that has been deemed a federally
153	148		qualified look-alike community health center, and
154	149		c. a health care provider who provides services to a
155	150		community health center that h as made application to
156	151		the U.S. Department of Health and Human Services for
157	152		approval and deeming as a federally qualified look-
158	153		alike community health cent er in compliance with
159	154		federal application guidance, and has received
160	155		comments from the U.S. Department of Health and Human
161	156		Services as to the status of such application with the
162	157		established intent of resubmitting a modified
163	158		application, or, if denied, a ne w application, no
164	159		later than six (6) months from the date of the
	160	+	official notification from the U.S. D epartment of

195	189		7. “Employee” means any person who is authorized to act in
196	190		behalf of a political subdivision or the state whether that person
197	191		is acting on a permanent or temporary basis, with or without being
198	192		compensated or on a full-time or part-time basis.
199	193		a. Employee also includes:
200	194		(1) all elected or appointed officers, members of
201	195		governing bodies and other persons designated to
202	196		act for an agency or political subdivision, but
203	197		the term does not mean a person or other legal
204	198		entity while acting in the capacity of an
205	199		independent contractor or an employee of an
206	200		independent contractor,
207	201		(2) from September 1, 1991, through June 30, 1996,
208	202		licensed physicians, licensed osteopathic
209	203		physicians and certified nurse-midwives providing
210	204		prenatal, delivery or infant care services to
211	205		State Department of Health clients pursuant to a
212	206		contract entered into with the State Department
213	207		of Health in accordance with paragraph 3 of
214	208		subsection B of Section 1 -106 of Title 63 of the
215	209		Oklahoma Statutes but only insofar as services
	210	+	authorized by and in conformity with the terms of

244	237		the contract and the requirements of Se ction 1-
245	238		233 of Title 63 of the Oklahoma Statutes, and
246	239		(3) any volunteer, full-time or part-time firefighter
247	240		when performing duties for a fire department
248	241		provided for in subparagraph j of paragraph 11 of
249	242		this section.
250	243		b. For the purpose of The Governmenta l Tort Claims Act,
251	244		the following are employees of this state, regardless
252	245		of the place in this state where du ties as employees
253	246		are performed:
254	247		(1) physicians acting in an administrative capacity,
255	248		(2) resident physicians and resident interns
256	249		participating in a graduate medical education
257	250		program of the University of Oklahoma Health
258	251		Sciences Center, the College of Os teopathic
259	252		Medicine of Oklahoma State University, or the
260	253		Department of Mental Health and Substance Abuse
261	254		Services,
262	255		(3) faculty members and staff o f the University of
263	256		Oklahoma Health Sciences Center and the College
264	257		of Osteopathic Medicine of Oklahoma State
265	258		University, while engaged in teaching duties,

294	286		administrative capacity as an employee of an
295	287		agency of the State of Oklahoma,
296	288		(5) physicians who provide medical care to inmates
297	289		pursuant to a contract with the Department of
298	290		Corrections,
299	291		(6) any person who is licensed to practice medicine
300	292		pursuant to Title 59 of the Oklahoma Statutes,
301	293		who is under an administrative professional
302	294		services contract with the Oklahoma Health Care
303	295		Authority under the auspices of the Ok lahoma
304	296		Health Care Authority Chief Medical Officer, and
305	297		who is limited to performing administrative
306	298		duties such as professional guidance for m edical
307	299		reviews, reimbursement rates, service
308	300		utilization, health care delivery and benefit
309	301		design for the Oklahoma Health Care Authority,
310	302		only while acting within the scope of such
311	303		contract,
312	304		(7) licensed medical professionals under contract
313	305		with city, county, or state entiti es who provide
314	306		medical care to inmates or detainees in the
315	307		custody or control of law enforcemen t agencies,

343	334		(8) licensed mental health professionals as defined
344	335		in Sections 1-103 and 5-502 of Title 43A of the
345	336		Oklahoma Statutes, who are c onducting initial
346	337		examinations of individuals for the purpose of
347	338		determining whether an individual meets the
348	339		criteria for emergency detention as part of a
349	340		contract with the Department of Mental Health and
350	341		Substance Abuse Services, and
351	342		(9) licensed mental health professionals a s defined
352	343		in Sections 1-103 and 5-502 of Title 43A of the
353	344		Oklahoma Statutes, who are providing mental
354	345		health or substance abuse treatment services
355	346		under a professional services contract with the
356	347		Department of Mental Health and Substan ce Abuse
357	348		Services and are providing such treatment
358	349		services at a state-operated facility.
359	350		Physician faculty members a nd staff of the University
360	351		of Oklahoma Health Sciences Center and the College of
361	352		Osteopathic Medicine of Oklahoma State University not
362	353		acting in an administrativ e capacity or engaged in
363	354		teaching duties are not employees or agents of the
364	355		state.
365	356		c. For purposes of The Governmental Tort Claims Act, a
366	357		physician licensed to practice medic ine pursuant to

394	384		Title 59 of the Oklahoma Statutes who provides medical
395	385		services in a public trust hospital, but who is not
396	386		employed by such hospital, shall be deemed an em ployee
397	387		only for medical service s provided in such hosp ital.
398	388		d. Except as provided in subparagraph b of this
399	389		paragraph, in no event shall the state be held liable
400	390		for the tortious conduc t of any physician, resident
401	391		physician or intern while practicing medicine or
402	392		providing medical treatment to patients.
403	393		d. e. For purposes of The Governmental Tort Claims Act,
404	394		members of the state military forces on state active
405	395		duty orders or on Title 32 active duty orders are
406	396		employees of this state, rega rdless of the place,
407	397		within or outside this state, where their duties as
408	398		employees are performed;
409	399		8. “Loss” means death or injury to the body or rights of a
410	400		person or damage to real or personal property or rights therein;
411	401		9. “Medically indigent” means a person requiring medically
412	402		necessary hospital or other health care services for the person or
413	403		the dependents of the person who has no public or private third-
414	404		party coverage, and whose personal resources are insufficient to
415	405		provide for needed health care;
416	406		10. “Municipality” means any incorporated city or town, and all
417	407		institutions, agenci es or instrumentalities of a municipality;

445	434		11. “Political subdivision” means:
446	435		a. a municipality,
447	436		b. a school district, including, but not limited to, a
448	437		technology center school district establishe d pursuant
449	438		to Section 4410, 4411, 4420 or 4420.1 of Title 7 0 of
450	439		the Oklahoma Statutes,
451	440		c. a county,
452	441		d. a public trust where the sole beneficiary or
453	442		beneficiaries are a city, town, school district or
454	443		county. For purposes of The Gov ernmental Tort Claims
455	444		Act, a public trust shall include:
456	445		(1) a municipal hospital cr eated pursuant to Sections
457	446		30-101 through 30-109 of Title 11 of the Oklahoma
458	447		Statutes, a county hospital created pursuant to
459	448		Sections 781 through 796 of Title 19 of the
460	449		Oklahoma Statutes, or is created pursuant to a
461	450		joint agreement between such governing
462	451		authorities, that is operated for the public
463	452		benefit by a public trust created pursuant to
464	453		Sections 176 through 180.4 of Title 60 of the
465	454		Oklahoma Statutes and managed by a g overning
466	455		board appointed or elected by the municipality,
467	456		county, or both, who exerci ses control of the
468	457		hospital, subject to the approval of the

503	491		serves as a teaching hospital for a medical
504	492		residency program provided by a colleg e of
505	493		osteopathic medicine and provides care to
506	494		indigent persons, and
507	495		(3) a corporation in which all of the capital stock
508	496		is owned, or a limited liability company in which
509	497		all of the member interest is owned, by a public
510	498		trust,
511	499		e. for the purposes of The Go vernmental Tort Claims Act
512	500		only, a housing authority created pursuant to the
513	501		provisions of the Oklahoma Housing Authority Act,
514	502		f. for the purposes of The Governmental Tor t Claims Act
515	503		only, corporations organized not for profit pursuant
516	504		to the provisions of the Oklahoma General Corporation
517	505		Act for the primary purpose of developing and
518	506		providing rural water supply and sewage disposal
519	507		facilities to serve rural residents,

562	549		k. for purposes of The Governmental Tort Claims Act only,
563	550		an Emergency Services Provider rendering service s
564	551		within the boundaries of a Supplemental Emergency
565	552		Services District pursuant to an existing contract
566	553		between the Emergency Services Provider and the State
567	554		Department of Health. Provided, however, that the
568	555		acquisition of commercial liability insurance co vering
569	556		the activities of such Emergency Services Provider
570	557		performed within the State of Oklahoma shall not

609	595		any community action agency established pursuant to
610	596		Sections 5035 through 5040 of Title 74 of the Oklahoma

612	598		o. for purposes of The Governmental Tort Claims Ac t only,
613	599		any organization that is designated as a youth
614	600		services agency, pursuant to Section 2-7-306 of Title
615	601		10A of the Oklahoma Statutes,
616	602		p. for purposes of The Governme ntal Tort Claims Act only,
617	603		any judge presiding over a drug court, as defined by
618	604		Section 471.1 of Title 22 of the Oklahoma Statutes,
619	605		q. for purposes of The Governmental To rt Claims Act only,
620	606		any child-placing agency licensed by this state to
621	607		place children in foster family homes,

650	635		a circuit engineering district created pursuant to
651	636		Section 687.1 of Title 69 of the Okla homa Statutes,
652	637		s. for purposes of the Governmental Tort Claims Act only,
653	638		a substate planning district, regional council of
654	639		government or other entity created pursuant to Section
655	640		1001 et seq. of Title 74 of the Oklahoma Statutes, and
656	641		t. for purposes of The Governmental Tort Claims Act only,
657	642		a regional transportation authority created pur suant
658	643		to Section 1370.7 of Title 68 of the Oklahoma Statutes
659	644		including its contract operator and any railroad
660	645		operating in interstat e commerce that sells a property
661	646		interest or provides services to a regional
662	647		transportation authority or allows the authorit y to
663	648		use the property or tracks of the railroad for the
664	649		provision of public passenger rail service to the
665	650		extent claims against the contract operator or
666	651		railroad arise out of or are related to or in
667	652		connection with such property interest, services or
668	653		operation of the public passenger rail service.
669	654		Provided, the acquisition of commercial liability
670	655		insurance to cover the activities of t he regional
671	656		transportation authority, contract operator or
672	657		railroad shall not operate as a waiver of any

700	684		liabilities, immunities or defenses provided pursuant
701	685		to the provisions of the Governmental Tort Claims Act,
702	686		and all their institutions, instrumentalities or agencies;
703	687		12. “Scope of employment” means performance by an employee
704	688		acting in good faith within the duties of the e mployee’s office or
705	689		employment or of tasks lawfully assigned by a competent autho rity
706	690		including the operation or use of an agency vehicle or equipment
707	691		with actual or implied consent of the supervisor of the employee,
708	692		but shall not include corruption or fra ud;
709	693		13. “State” means the State of Oklahoma or any office,
710	694		department, agency, a uthority, commission, board, institution,
711	695		hospital, college, university, public trust created pursuant to
712	696		Title 60 of the Oklahoma Statutes of which the State of Oklahoma is
713	697		the beneficiary, or other instrumentality thereof;
714	698		14. “State active duty” shall be defined in accordance with
715	699		Section 801 of Title 44 of the Oklahoma Statutes;
716	700		15. “State military forces” shall be defined in accordance with
717	701		Section 801 of Title 44 of the Oklahoma Statutes;
718	702		16. “Title 32 active duty” shall be defined in accordance w ith
719	703		Section 801 of Title 44 of the Oklahoma Statutes; and
720	704		17. “Tort” means a legal wrong, ind ependent of contract,
721	705		involving violation of a duty imposed by general law, statut e, the
