66	66	defining terms; prohibiting lewd acts or obscene

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 1024.6 of Title 21, unless there
80	80	is created a duplication in n umbering, reads as follows:
81	81	A. For the purposes of this act:
82	82	1. “Lewd acts” means any sexual behavior imitating sex or
83	83	sexual acts, groping, indecent exposure of genitalia or sexual
84	84	paraphernalia, display of replicas of genitalia, sexually touching
85	85	oneself or someone else, or convincing or forcing some one else to
86	86	sexually touch or observe sexual behavior ; and
87	87	2. “Obscene material” shall have the meaning as provided in
88	88	subsection B of Section 1024.1 of Title 21 of the Oklahoma Statutes.

140	140	B. No political subdivision of this state shall allow or permit
141	141	a public display of lewd acts or obscene material in a public place
142	142	including but not limited to parades, shows, concerts, plays, or any
143	143	other activity where a minor could witness such lewd acts or obscene
144	144	material. No individual shall be allowed to show lewd acts or
145	145	obscene material in a public place where any other individual could
146	146	witness such lewd acts or obs cene material.
147	147	C. Any individual intentionally displaying lewd acts or obscene
148	148	material in front of a minor shall be guilty of a felony. Any
149	149	person may have a cause of action against such individual w ho
150	150	intentionally commits such acts in any manner in which a minor was
151	151	exposed to the lewd act or obscene material, or an individual was
152	152	unwillingly exposed to the lewd act or obscene material.
153	153	SECTION 2. This act shall become effective November 1, 2023.
