38102 SECTION 1. AMENDATORY 70 O.S. 2021, Section 14 -108, is

44107 as provided by Section 9B , of Article X, of the Oklahoma
45108 Constitution, and such districts so established shall be operated in
46109 accordance with rules of the State Board of Career and Technology
47110 Education, except as otherwise provided in this title.

52112 corporate and shall possess the usual powe rs of a corporation for
53113 public purposes. Its official name shall be designate d by the State

56116 with, and holding real and perso nal estate.

58117 C. The governing board of a technology cen ter school district
59118 shall be a board of education consisting of not less than five (5)

67151 D. In a technology center school district that se rves seventy
68152 or more public school districts, the territory of the school
69153 district shall be divi ded into district zones by the State Board of
70154 Career and Technology Education. Between August 1 and Dece mber 31
71155 of the year following the submission by the Uni ted States Department
72156 of Commerce to the President of the United States of the official
73157 Federal Decennial Census, the Board shall reapportion the territo ry
74158 of the technology center school district into district zones. All
75159 boundaries of district zones shal l follow clearly visibl e,
76160 definable, and observable physical boundaries which are based upon
77161 criteria established and recognized by the Bureau of the Cen sus of
78162 the United States Department of Commerce for purposes of defining
79163 census blocks for its decennia l census and shall foll ow, as much as
80164 possible, precinct boundaries. District zones shall be co mpact,
81165 contiguous and shall be as equal in population as practical with not
82166 more than a five-percent variance between the most populous and
83167 least populous distr ict zones. The board o f education of a
84168 technology center school district shall consist of one m ember
85169 elected from each of the district zones of the scho ol district
86170 created pursuant to this subsection. The electors of each district
87171 zone shall elect a pers on, who is a resident o f the district zone,
88172 to represent the district zone on the school board. If during the
89173 term of office to which a person was elect ed, that member ceases to

99206 E. In technology center school districts having a population of
100207 more than two hundred twenty-five thousand (225,000) electors, the
101208 territory of the district shall be divided into board zones by the
102209 State Board of Career and Tech nology Education. The board of
103210 education of the technology center school district shall consist of
104211 one member elected from each of the district zones. Beginning July
105212 1, 2024, the board of education s hall have the option upon approval
106213 of a board resolutio n, of requiring that the electors of each
107214 district zone shall elect a person who is a resident of th e district
108215 zone to represent the dist rict zone on the school board and to not
109216 elect all board members at large, or the community continues to vote
110217 for the board members at large . If during the term of office to
111218 which a person was elec ted, that member ceases to be a resident of
112219 the district zone for which the person was elected, the office shall
113220 become vacant, and the vacancy shall be filled as provid ed for in
114221 Section 13A-110 of Title 26 of the Oklahoma Statutes. The State

119251 F. The board of education of a t echnology center school
120252 district shall have the same powers and duties that boards of
121253 education of independent school districts have. It may require
122254 nonresident students to pay reasonable tuition fees, which may be
123255 paid for a student by the independent or elementary school district
124256 in which the student resides.

126257 F. G. An election to vote on the question of making a levy of
127258 not to exceed five (5) mills on the dollar valuation of the taxable
128259 property in a techno logy center school district under the provision s
129260 of subsection A, of Section 9B, of Article X, of the Oklahoma
130261 Constitution, shall be called by the board of education and
131262 conducted by the county election board of such district in the same
132263 manner that elections for emergency levies in school districts under
133264 the provisions of subsection (d) of Section 9(d), of Article X, of
134265 the Oklahoma Constitution, are called and conducted. When such levy

302+building fund for an area school district under the provisions of
303+Section 10, of Article X, of the Oklahoma Constitution, shall be
304+called by the board of education of such district an d conducted by
305+the county election board in the same manner that elections for
306+similar levies are called and conducted in independent school
307+districts.
308+G. H. Annual estimates of needs of technology center school
309+districts shall be made and approved in the same manner that those
310+of independent school districts are made and approved. Provided,
311+that the State Board of Career and Technology Education shall
312+prescribe a list of appropriation accounts by which the funds of
313+technology center school districts shal l be budgeted, accounted for
314+and expended. Any such estimate of needs may include an estimate of
315+federal funds as probable income from sources other than ad valorem
316+tax of the district and other than any excise or other ta x assessed
317+by legislative enactme nt and distributed in lieu of a d valorem
318+taxes. If a technology center school district lies in more than one
319+county, the district’s estimate of needs shall be filed with and
320+approved by the county excise board of the count y designated by the
321+school district board of education.
322+H. I. Territory may be annexed to or detached from a technology
323+center school district, in accordance with rules prescribed by the
324+State Board of Career and Technology Education. If the State Board

352+petition in order for an election to be called for the purpose of
353+annexation or deannexation of territory to a technology center
354+school district, such petition shall not be required to bear a
355+number of technology center schoo l district electors’ signatures
356+which exceed fifty percent (50%) of the number of technology center
357+school district electors who voted in the last school board election
358+in the territory proposed to be annexed or deannexed. Pr ovided, the
359+period of time from which the petition is initiat ed to its time of
360+filing with the State Board shall not exceed ninety (90) days.
361+I. J. Schools of technology center school districts shall be
362+subject to classification, inspection , and accreditation by the
363+State Board of Education.
364+J. K. The technology center school board of education may
365+designate a county treasurer to serve as treasurer of the school
366+district or may appoint an independent treasurer.
367+K. L. Within four (4) years after the creation of a t echnology
368+center school district, such school distr ict may, at its discretion,
369+permit a teacher to transfer any or all accrued benefits upon
370+employment including credit for years of service in the previous
371+school district by the technology center school di strict, if the
372+teacher at the time of hiring is emp loyed as a teacher by an
373+independent or elementary school district which is all or partly
374+within the boundaries of the technology center school district or is

401+employed as a teacher in a skills center withi n the boundaries of
402+the school district.
403+L. M. The board of education of a technology center school
404+district may convey surplus personal property without consideration
405+to:
406+1. A school district that is within the boundary of the
407+technology center school dis trict;
408+2. A public school offering secondary lev el education which was
409+created and is operated by the State of Oklahoma this state and that
410+is within the boundary of the technology center school district ;
411+3. A technology center school district; or
412+4. The Oklahoma Department of Career and Technology Ed ucation
413+for the support or delivery of department initiatives.
414+M. N. The board of education of a technology center school
415+district may, without prior approval of the State Board of Career
416+and Technology Education, approv e all plans and specifications for
417+technology center school buildings, additions, and major
418+modifications to school buildings that are designed to provide for
419+the offering of vocational -technical education programs and services
420+when the cost of the buildin g project is to be paid with local
421+levies or state bond monies or both local levies and state bond
422+monies.
