8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 21 O.S. 2021, Section 733, is
8585 amended to read as follows:
8686 Section 733. A. Homicide is also just ifiable when committed by
8787 any person in any of the following cas es:
8888 1. When resisting a ny attempt to murder such person, or to
8989 commit any felony upon him the person, or upon or in any dwelling

142142 2. When committed in the lawful defense o f such person or of
143143 another, when the person using force reasona bly believes such force
144144 is necessary to prevent death or great bodily harm to himself or
145145 herself or another or to termin ate or prevent the commission of a
146146 forcible felony; or
147147 3. When necessarily committed in attempting, by lawful ways and
148148 means, to apprehend any person for any f elony committed; or in
149149 lawfully suppressing any riot; or in lawfully keeping and preserving
150150 the peace.
151151 B. When a person is charged with murder but is found not guilty
152152 due to justifiable homicide, the state shall reimburse the defendant
153153 for all reasonable costs including loss of wages, court costs,
154154 attorney fees, and other expenses involved in his or her defense;
155155 provided, such reimbursement shall not be an independent cause of
156156 action. To award reasonable costs, the trier of fact shall find
157157 that the defendant’s claim that the homicide was justified was
158158 sustained by a prepondera nce of the evidence. If the trier of fact
159159 determines that the homicide was justified, the court shall
160160 determine the amount of the award. If the trier of fact find s that
161161 the defendant did not meet his or her burden of proof by a
162162 preponderance of the evidence, the defendant may appeal the finding
163163 to the Court of Criminal Appeals.
164164 C. Notwithstanding a finding that a defendant’s actions were
165165 justified, if the trier o f fact determines that the defendant was

217217 engaged in criminal conduct substantially related to the events
218218 giving rise to the charges filed against the defendant, the court
219219 may deny or reduce the amount of the award. In determining the
220220 amount of the award, the court shall consider the seriousness of the
221221 initial criminal conduct.
222222 D. When a homicide is dete rmined to be justified and the
223223 defendant establishes that he or she has sustained injury due to
224224 malicious prosecution, then the defendant shall be awarded fair and
225225 just compensation.
226226 E. In order to support a claim of malicious prosecution
227227 pursuant to this sec tion, a claimant shall establish:
228228 1. That a prosecution for homicide was commenced against the
229229 claimant;
230230 2. That the prosecution was malicious;
231231 3. That the prosecution was instituted or instigated by the
232232 prosecutor;
233233 4. That the prosecution was without probable cause;
234234 5. That the prosecution has bee n legally and finally terminated
235235 in favor of the claimant; and
236236 6. That as a result of the criminal prosec ution the claimant
237237 sustained injury.
238238 F. For purposes of this section , malice may be established if
239239 the principal motive of the prosecution was other t han a desire to
240240 bring an offender to justice, or t hat the prosecution was done with

292292 ill will or hatred or willfully done in a wanton or oppressive
293293 manner, and in conscious disregard of the claimant’s rights.
294294 G. A prosecutor may be held personally liable to a claimant if
295295 malicious prosecution is establish ed pursuant to this section .
296296 H. When a malicious prosecution is established pursuant to this
297297 section, any court that presided over any stage of the prosecution
298298 shall immediately report the finding to the O klahoma Bar Association
299299 for a disciplinary investigation of both the pr osecutor and the
300300 elected district attorney who employs the prosecutor.
301301 I. The provisions of this section shall extend to pending
302302 prosecutions prior to the effective date of this act.
303303 J. As used in this section, “forcible felony” means any felony
304304 which involves the use or threat of physical force or violence
305305 against any person.
306306 SECTION 2. This act shall become effective November 1, 2023.
