7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. AMENDATORY 34 O.S. 202 1, Section 9, is
7575 amended to read as fo llows:
7676 Section 9. A. When a referendum is ordered by petition of the
7777 people against any measure p assed by the Legislature or when any
7878 measure is proposed by initiative petition, w hether as an amendment
7979 to the Constitution or as a statute, it shall be the duty of the
8080 parties submitting the measure to prepare and file one copy of the
8181 measure with the Secretary of State and one copy with the Attorney
8282 General.
8383 B. The parties submittin g the measure shall also submit a
8484 suggested ballot title to the Secreta ry of State which shall be
8585 filed on a separate sheet of paper and shall not be part of or
8686 printed on the petition. The suggeste d ballot title:

138138 1. Shall not exceed two hundred words , or three hundred words
139139 if the proposed measure will have a fiscal impact on the state;
140140 2. Shall explain in basic words, which can be easily found in
141141 dictionaries of general u sage, the effect of the p roposition;
142142 3. Shall be written on the eighth grade reading comprehension
143143 level;
144144 4. Shall not contain any words which have a special meaning for
145145 a particular profession or trade not commonly known to the citizens
146146 of this state;
147147 4. 5. Shall not reflect partiality in its composition or
148148 contain any argument for or against the measure;
149149 5. 6. Shall contain language which clearly states that a “yes”
150150 vote is a vote in favor of the proposition and a “no” vote is a vote
151151 against the proposition;
152152 6. 7. Shall not contain language whereby a “yes” vote is, in
153153 fact, a vote against the proposition and a “no” vote is, in fact, a
154154 vote in favor of the proposition; and
155155 7. 8. Shall indicate if a proposed measure will have a fiscal
156156 impact on the state and if so, the potential source of funding
157157 including but not limited to federal funding or legislative
158158 appropriation which may require imposition of a new tax, increase of
159159 an existing tax or elimination of existing services.

211211 C. When a measure is proposed as a constitutional amendment by
212212 the Legislature or when the Legislature proposes a statute
213213 conditioned upon approval by the people:
214214 1. After final passa ge of a measure, the Secreta ry of State
215215 shall submit the proposed ballot t itle to the Attorney General for
216216 review as to legal correctness. Wit hin five (5) business days after
217217 receipt from the Secretary of State, the Attorney General shall, in
218218 writing, notify the Secretary of State, the President Pro Tempore of
219219 the Senate, the Speaker of the House of Represent atives and the
220220 principal authors of t he bill whether or not the proposed ballot
221221 title complies with applicable laws. The Attorney General shall
222222 state with specificity any and al l defects found and, if necessary,
223223 within ten (10) business days of determinin g that the proposed
224224 ballot title is defective, prepare a preliminary ballot title which
225225 complies with the law and furnish a copy of such ballot title to the
226226 Secretary of State, t he President Pro Tempore of the Senate, the
227227 Speaker of the House of Representa tives and the principal authors of
228228 the bill. The Attorney General may consider any comments made by
229229 the President Pro Tempore of the Senate or the Sp eaker of the House
230230 of Representatives submitted within five (5) business d ays of their
231231 being furnished a copy of the preliminary ballot title. The
232232 Attorney General shall respond in writing to the comments and shall
233233 file a final ballot title with the Secre tary of State no later than

287287 2. After receipt of the measure and the official ballot title,
288288 as certified by the Attorney General, the Secretary of State shall
289289 within five (5) days transmit to the Secretary of the State Election
290290 Board an attested copy o f the measure, including the off icial ballot
291291 title.
292292 D. The following procedure shall apply to ballot titles of
293293 referendums ordered by a petition of the people or any measure
294294 proposed by an initiative petition :
295295 1. After the filing of the signed referendum petitions or the
296296 signed initiative petitions, the Secretary of State shall submit the
297297 proposed separate ballot title to the Attorney General for review as
298298 to legal correctness. Wit hin five (5) business days after the
299299 receipt of the ballot title, the Atto rney General shall, in writing,
300300 notify the Secretary of State whether or not the proposed ballot
301301 title complies with applicable laws. The Attorney General shall
302302 state with specifici ty any and all defects found and, if necessary,
303303 within ten (10) business d ays of determining that the prop osed
304304 ballot title is defective, prepare and file a ballot title which
305305 complies with the law; and
306306 2. Within ten (10) business days after completion of the review
307307 and, if necessary, the filing of a bal lot title in compliance with
308308 law, by the Attorney Genera l, the Secretary of State shall, if n o

360360 appeal is filed, transmit to the Secretary of the State Election
361361 Board an attested copy of the measure, includi ng the official ballot
362362 title, and a certification that the requirements of this section
363363 have been met. If an appeal is taken from such ballot title within
364364 the time specified in Section 10 of this title, then the Secretary
365365 of State shall certify to the Sec retary of the State Election Board
366366 the ballot title which is finally appro ved by the Supreme Court.
367367 SECTION 2. This act shall become effective November 1, 2023.
